HomeMy WebLinkAboutPC Res 97-51 - 1997-12-03 , RESOLUTION NO. 97- 5/ A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL ADOPTION OF NEGATIVE DECLARATION 97-4, ADOPTION OF AMENDMENT 97-2 TO THE "CIRCULATION ELEMENT' OF THE SEAL BEACH GENERAL PLAN, AND APPROVAL OF THE SUBJECT STREET VACATION THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, the Ca1iforma Government Code mcludes certam pTOVlslons regarding the content of the "Circulation Elernent" of the General Plan, and WHEREAS, this proposed amendment of the CITCulat10n Element of the Seal Beach General Plan IS an amendment which pTOVldeS mternal consistency With Clrculatlon Element ReVISIon 97-1, approved by the City Council m October 1997. CITCulatIon Element RevlSlon 97-1 was adopted to maintam consistency between the ClTculatIon Element and the approved Hellman Ranch Specific Plan. Circulation Element ReVISIOn 97-1 was necessary to delete roadways WIthIn Hellman Ranch deSignated for constructIon 10 the General Plan that will not be constructed when the Hellman Ranch Spec1fic Plan project IS constructed; and WHEREAS, Circulation Amendment 97-1 deleted the subject roadway from the CJTCUiation Element as a future roadway, but left the roadway descnptlon 10 the "CapItal Improvement Program" portion of the ClTculatlon Element, resulting 10 an internal mconSlStencY WIthm the Circulation Element; and WHEREAS, the City is propoSlDg to amend the Circulation Element to ellmmate thiS mtemai inconSistency and vacate the subject future roadway nght-of-way, and WHEREAS, staff has prepared and CIrculated an Imt1al EnVIronmental Assessment and proposed Negative Declaration as reqUIred by the CalIfornia EnVIronmental Quality Act (CEQA). The comment penod on Negative Declaration 97-4 will end on December 8, 1997. As of December 3, 1997, The City has received responses on the proposed Negative DeclaratIOn from 1) State of CalIfornIa, Department of TransportatIon, DIstnct 12, haVIng no comments on the project; and 2) Southern Callforma ASSOCIation of Governments, mmcatlng the project IS not regionally Slgmficant and does not warrant cleannghouse comments: and WHEREAS, a duly noticed pubhc hearing was held by the Planmng ComffilsSlon on December 3, 1997 to conSIder Negative Declaration 97-4, CITculabon Element Amendment 97-2, and the subject street vacation; and C \My Documcnls\RESO\Cuoulabon Amend 97-2. The proposed Negative Declaration adequately discloses the potential enVIronmental Impacts of the proposed CITCulatlon Element amendment and street vacatIon, and no substantial adverse enVIronmental Impacts WIll result upon the approval of the subject requests 2. The proposed Circulation Element amendment will result 10 mtemal conSIstency WIthm the CITCulatlon Element. 3. The proposed CITculat10n Element amendment recogmzes the future roadway IS longer necessary due to the reductIon in future traffic Impacts from the Hellman Ranch property, which WIll compose only 70 smgle-faffilly residences. If 10 the future Boemg proposes additIonal facIlitIes on theIr property which would reqUITe additional roadway access, a future enVIronmental evaluatIon of those projects would IdentIfy If the anticipated traffic generatIon would require a publIc roadway or pnvate dnveway access. If thIs environmental evaluatIon were to determIne that a public roadway IS reqUired, that would be a conditIon of approval of the proposed project 4. The proposed street vacation IS conSIStent WIth the CITculatlon Element, as amended by Amendment 97-2 to the Circulation Element, and WHEREAS, in comphance WIth CEQA and local CEQA gUldehnes, staff WIll prepare the required "Response to Comments on Negative Declaration No. 97-4", mcludmg all responses receIved by the City to December 8, 1997, for conSideration by the Clty CouncIl on December 8, 1997. NOW, THEREFORE BE IT RESOLVED, that the Planmng CommISSion hereby recommends that the City CounCil: 1. Adopt Negative Declaration 97-4, 2. Approve Circulation Element Amendment 97-2 as set forth below' "Section Four: Implementation", subsection titled "Capital Improvements Program" , the last area of concern is deleted in its entirety. Summarily vacate the subject vacant street nght-of-way in accordance with Sections 8333 and 8334 of the Streets and Highways Code.
