HomeMy WebLinkAboutPC Res 97-47 - 1997-12-03 RESOLUTION NUMBER 97-47 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL APPROVAL OF ZONING TEXT AMENDMENT 97-5, AMENDING SECTION 28-1300(7) BY ADDING "UP TO TWO (2) BILLIARD TABLES IN CONJUNCTION WITH A RESTAURANT" AS A CONDITIONALLY PERMIITED USE IN THE SERVICE COMMERCIAL ZONE (C-l) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE Section I At Its meetmg of December 3, 1997, the Planmng CommIssIon conSIdered and approved Zomng Text Amendment 97-5 ThIS amendment would change SectIon 28-1300(7) of the Code of the City of Seal Beach to allow "up to two (2) billiard tables 10 conjunction WIth a restaurant" as a conditionally permItted use m the Service CommercIal zone (C-l) SectIon 2 Pursuant to 14 Calif Code of Regs A 15025(a) and A~ n C and ill of the City's Local CEQA Guldehnes, staff prepared an Initial Study and a Negative Declaration, which were clTculated for public reVIew and comment from October 14, 1997 to November 4, 1997, in comphance WIth the provisions of the Callforma EnVironmental Quahty Act and the CIty's Local CEQA Guldehnes Section 3 A duly notIced pubhc heaTing was held by the Planmng CommIssion on December 3, 1997, to conSIder Zone Text Amendment 97-5 Section 4 The record of the hearIng of December 3, 1997mdlcates the following (a) At S81d public heanng there was oral and wntten testImony and eVIdence receIVed by the Planmng CommIssion (b) The proposed text amendment will reVIse the City'S zonmg ordinance and enhance the ablhty of the CIty to ensure orderly and planned development in the City through an amendment of the zonmg requIrements (c) Up to two (2) bdhard or pool tables as a secondary use to a restaurant IS appropnate for and in keepmg WIth the uses allowed m the Service Commercial zone (C-l) The use, when properly condItIOned through a conditional use peTffilt, IS slmllar m nature to other uses conditIonally permItted m the C-l zone, such as coin-operated amusement devices and entertainment cafes Section 5 Based upon the facts contamed m the record, mcludmg those stated 10 ~4 oftlus resolution and pursuant to ~~ 28-2600 of the CIty's Code. the Planmng CommiSSion makes the follOWIng findmgs (a) Zoning Text Amendment 97-5 IS consIstent WIth the provIsIons of the various elements of the City's General Plan Accordmgly, the proposed use IS consIstent WIth the General Plan The proposed amendment is admlmstratlve m nature and WIll not result m changes mconslstent with the exlstmg provisions of the General Plan (b) The proposed text amendment WIll revise the CIty'S zonmg ordmance and enhance the ability of the CIty to ensure orderly and planned development m the City through an amendment of the zomng requirements Specifically, the CIty will have a mechamsm for reVIeWIng and condItionally permlttmg up to two (2) bllhard tables m conjunction WIth a restaurant Planmng CooumSSIOD Resolubon No 97-47 December 3, 1997 (c) Up to two (2) billiard or pool tables as a secondary use to a restaurant IS appropnate for and in keepmg with the uses allowed m the Service CommercIal zone (C-l) The use, when properly condItIOned through a conditIOnal use permIt, IS simdar in nature to other uses condItionally permitted m the C-} zone, such as com-operated amusement deVIces and entertainment cafes SectIon 6 Based on the foregoing, the Planmng CommIssIon hereby adopts Negative Declaration 97-J and recommends approval of Zoning Text Amendment 97-5 to the CIty CounCIl subject to the follOWIng 1. Article 13 A new subparagraph (k) of Paragraph (7) of SectIon 28-1300 of Chapter 28 of The Code of the City of Seal Beach IS hereby added to read "(k) Up to two (2) bdhard tables m conjunctIon WIth a restaurant" PASSED, APPROVED AND ADOPTED by the Planning CommIssIon of the CIty of Seal Beach at a meetmg thereof held on the JnI day ofDecernber, 1997, by the follOWIng vote AYES CommIssIoners Brown, Hood, Law, Yost NOES CommIssioners Larson ABSENT CommIssIoners M Brown, hairman of the Planmng CommiSSIon . e Whittenberg Secretary of the Planning Commission * * * *
