HomeMy WebLinkAboutPC Res 97-43 - 1997-11-19 , RESOLUTION NUMBER 97-43 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 97-5, A REQUEST TO ADD APPROXIMATELY 234 SQUARE FFET OT THE FRONT UNIT OF A NONCONFORMING DUPLEX LOCATED AT 1217 ELECTRIC AVENUE, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOL VB Section I On November 5, 1997, Francme De France ("The Applicant") submitted an appbcation for Minor Plan ReVIew 97-5 with the Department of Development SeTVIces Through MPR 97-5, the apphcant IS seekmg to add 234 square feet to the front umt of a nonconfoTffilng duplex located at 1217 Electnc Avenue, Seal Beach The proposed addltionlremodelmcludes a remodel and addition to the second floor bedroom and bathroom and the addItion ofa small deck to the second floor Section 2 Pursuant to 14 CalIf Code of Regs ~ l5025(a) and ~ II B of the City's Local CEQA Guidebnes, staffhas deteTffilned as follows The apphcatlon for Minor Plan ReVIew 97-5 is categoncally exempt from review pursuant to the CaiIforrua Environmental Quality Act pursuant to 14 CalIf Code of Regs ~ 15301 (Exlstmg Uses), because It mvolves the negbgtble expansIon of an existmg use, and pursuant to ~ 15061(b)(3), because It can be seen WIth certainty that there IS no POSSlblhty that the approval may have a slgmficant effect on the enVIronment Section 3 A duly notIced hearing was held before the Planmng COmffilsslon on November 19, 1997 to conSIder the apphcatlOn for MInor Plan ReVIew 97-5 SectIon 4 The record of the heanng on November 19, 1997mdlcates the follOWIng (a) On November 5, 1997, Francme De France submitted an apphcatlOn on for Minor Plan Review 97-5 WIth the Department of Development SeTVIces (b) SpeCIfically, the apphcant is seekmg to add 234 square feet to the front umt ofa nonconfoTffilng duplex located at 1217 Electnc Avenue, Seal Beach The proposed addltlOnlremodelmcludes a remodel and addition to the second floor bedroom and bathroom and the addItion of a small deck to the second floor (c) The subject property IS legally descnbed as Orange County Assessor's Parcel Number 199-136-21 and is located 10 the ReSidential HIgh DenSIty zone of Old Town (d) The subject property IS a parallelogram 10 shape With a lot area of 3,190 square feet (30' x 110') (e) The subject property IS surrounded by a mIxture of slOg Ie faffilly and multi-family dwelhngs 10 the ReSIdential High and MedIum DenSIty zones (RHO and RMD) (f) As of November 13, 1997, staffhas receIved no wntten responses to its lOaded notice regarding Minor Plan Review 97-5 SectIOn 5 Based upon the facts contamed in the record, mcludmg those stated 10 ~ 4 of this resolutIon, and pursuant to ~~ 28-2407 of the City's Code, the Planmng COmffilsslon hereby finds as follows (a) Minor Plan ReVIew 97-5 is consIstent WIth the provIsions of the Land Use Element of the CIty'S General Plan, w!uch prOVIdes a "!ugh denSIty reSIdentIal" designation for the subject property and permits single- and multi-family residential uses The use D \My DooumcnIs\M1IlOI" Plan Re_7-' Rosolullon doo BCC be Planmng CommIssIon ResolutIOn No 97-43 is also consistent with the remlUmng elements of the City's General Plan as the pohcles of those elements are consistent with, and reflected in, the Land Use Element Accordmgly, the proposed use IS consistent with the General Plan (b) As conditioned herein, the proposed additIon WIll meet all requIred setbacks for the RHD zone Section 6 Based upon the foregomg, the Planmng CommissIOn hereby approves Minor Plan ReVIew 97-5, subject to the follOWIng conditIons 1 Mmor Plan Review 97-5 is approved to add 234 square feet to the front umt of a nonconfoTffilDg duplex located at 1217 Electnc Avenue, Seal Beach The proposed addition/remodel mcludes a remodel and addItion to the second floor bedroom and bathroom and the addItion of a small deck to the second floor 2 All constructIOn shall be in substantial comphance with the plans approved through MPR 97-5, subject to an amendment to the plan to prOVide the reqUired 12 foot average front yard setback 3 The lattIce work located at the front of the structure WIthm the SIde yard setback shall be removed 4 The water heater shall be strapped to meet UBC standards 5 The front units electncal seTVIce shall be upgraded and the electnca1 drop shall be relocated so as not to cross over the neighbonng residence to the east 6 Cut drywallm the garage shall be repaired per Code 7 This MInor Plan ReVIew shall not become effective for any purpose unless an "Acceptance of Conditions" form has been Signed by the applicant m the presence of the DIrector of Development SeTVIces, or notarized and returned to the Planmng Department, and untd the ten (10) day appeal penod has elapsed PASSED, APPROVED AND ADOPTED by the Plannmg Conurussion of the CIty of Seal Beach at a meetmg thereof held on the 19th day of November, 1997 by the follOWIng vote AYES ConurussioneTS Brown.
