HomeMy WebLinkAboutPC Res 97-34 - 1997-09-03 RESOLUTION NUMBER 97-34 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING APPROVAL TO THE CITY COUNCIL OF A DEVELOPMENT AGREEMENT BETWEEN THE CITY OF SEAL BEACH AND HELLMAN PROPERTIES LLC, REGARDING THE "HELLMAN RANCH SPECIFIC PLAN" THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. Hellman PropertIes LLC has apphed for approval of the "Hellman Ranch Specd'ic Plan" by the Clty of Seal Beach. The City and Hellman Properties LLC deSIre to enter mto a development agreement pursuant to Government Code SectIons 65864 through 65869.5, and ArtIcle 27 5 of Chapter 28 of the Code of the City of Seal Beach, California WIth respect to that certalD real property commonly known as the "Hellman Ranch Specific Plan" area, and more partIcularly descnbed 10 the proposed development agreement, attached hereto as Exhibit A. Section 2. Pursuant to 14 Calif. Code of Regs ~ l5025(a) and n II.C and ill of the City'S Local CEQA GUIdelInes, staff prepared an Imtlal Study and a Draft EnVIronmental Impact Report, which was ClTculated for pubhc revIew and comment from Apnl 8, 1997 to May 27, 1997, 10 complIance With the proVISIons of the CahfoTDIa EnV1TOnrnental Quality Act and the City'S Loca1 CEQA GUldehnes. A ReVIsed DEIR was CJTCUlated for pubhc review and comments from June 9, 1997 to July 23, 1997 Upon completion of the publIc review penod, a Fmal EnVIronmental Impact Report was reviewed by the Planmng ComffilsSlon at a pubhc heanng held on September 3, 1997. Section 3. Pursuant to SectIon 28-2759 of the Code of the City of Seal Beach, the Planmng Commission held a properly noticed pubhc heanng regardmg the proposed development agreement on September 3, 1997. Section 4. Based upon the evidence presented, and on the enVIronmental documentatIon referenced above, pursuant to Government Code Section 65867.5, and SectIon 28-2759 of the City's ~, the Plannmg CommiSSIon hereby finds and declares as follows. A. The proposed development agreement IS conSIstent With the current General Plan for the CIty of Seal Beach, the obJectives, pohCles, general land uses, and programs specified therem, and With the Hellman Ranch SpecIfic Plan, as each has been amended to date, 10 that the General Plan and Hellman Ranch Specific Plan proVIde for allowable uses of the subject property, which mclude the reSidential, open space, recreation, retaIl and other uses contemplated by the proposed development agreement. The Hellman Ranch SpeCIfic Plan IS apphcable to the proposed development agreement B. The various land uses contemplated by the proposed development agreement are compatible WIth the land uses set forth in the Hellman Ranch Spectfic Plan area, m which the subject property IS located. C. D. The proposed development agreement WIll not adversely affect the orderly development of property, but wlllmstead further the orderly development process by guaranteemg the timely construction of necessary mfrastructure and pubhc Improvements, along WIth the protection and enhancement of open space areas, 10 conjunction with residential development. E. The proposed development agreement WIll have a posItive fiscal impact on the City of Seal Beach 10 that the agreement encourages economically productive use of the property and ensures that Developer WIll absorb the costs of development Section 5 The proposed development agreement IS WIthm the scope of the Environmental Impact Report prepared by the Clty and recommended for certIfication by the Planmng ComffilSSlon, and no substanbal change or new slgmficant enVIronmental Impact has been brought forward With respect to the circumstances under WhICh the EnVIronmental Impact Report was prepared which would reqUIre revIsions 10 or to the EnVITonmental Impact Report. Section 6. Based upon the foregomg, the Planmng Commission of the City of Seal Beach does hereby recommend to the City Council of the City of Seal Beach that the proposed development agreement between the City of Seal Beach and Hellman Properties LLC, attached hereto as ExhibIt" A ", be approved. PASSED, APPROVED AND ADOPTED by the Planmng CommisSIon of the City of Seal Beach at a meeting thereof held on the 3" day of September ,1997 by the follOWIng vote: AYES CommIssioners Brown, Hood, Larson, Law, and Yost NOES Commissioners ABSENT CommIssioners _ .
