HomeMy WebLinkAboutPC Res 97-33 - 1997-09-03 RESOLUTION NO. 97-33 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL APPROVAL OF TENTATNE TRACT MAP NO. 15402 THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. In October, 1996, Hellman Properties LLC ("Apphcant"), completed and submitted a reVIsed Specific Plan for the Hellman Ranch property and adjoimng properties, appropnate General Plan Amendments, and Vesting Tentative Tract Map No. 15381 and 15402 (collectively "applIcation") With the City of Seal Beach. The Apphcant seeks amendments to the General Plan to allow the Implementation of the Hellman Ranch Specific Plan, dated October 1996, on the land descnbed 10 "Exh1blt A" to Resolution No 97-22, mcorporated by reference. Section 2 Pursuant to 14 Calif Code of Regs. A 15025(a) and AA II C and ill of the City'S Local CEQA GUldelmes, staff prepared an Imt1ai Study and a Draft EnVITonrnental Impact Report, which was CITculated for pubhc revIew and comment from Apnl 8, 1997 to May 27, 1997, 10 comphance With the proVISions of the CallfoTDIa EnVlTOnmental QualIty Act and the City'S Loca1 CEQA GUldehnes. A ReVIsed DEIR was clTculated for pubhc revIeW and comments from June 9, 1997 to July 23, 1997. Upon completion of the pubhc reVIew penod, a Fmal EnVIronmental Impact Report was reVIewed by the Planmng CommiSSIon at a pubhc heanng held on September 3, 1997 Section 3. A duly noticed pubhc heanng was held before the Plannmg ComffilsSlon on September 3, 1997 to conSider the apphcatlons. At the pubhc heanng, Apphcant's consultants and representatives, mcludmg Apphcant's legal counsel, and several other persons spoke 10 favor of and 10 opposItion to the request. Section 4 The record of the heanngs indicates the followmg: (a) Apphcant seeks to establish the followmg uses as part of the Hellman Ranch Specific Plan: c 70 detached smgle-famlly reSidences on 14.7 acres; c a 107.5 acre, 18-hole pubhc golf course: c 23.1 acres of restored saltwater wetlands c 9.7 acres of freshwater wetlands c 20,000 square feet of vISItor-serVIng commercIai uses, mcludmg an mteTpretauve center and publIc faClhty (Krenwinkel House), on 1.8 acres; c DedIcation of Gum Grove Nature Park to the City of Seal Beach, 10.2 acres; c MIneral Production/Future Development on 28.2 acres; c Mamtam the Los Alamltos Retardmg Basm, 34.7 acres (b) Apphcant IS propoSIng to subdIVIde the property 10 accordance with the conveyance subdIVISIon approved 10 accordance WIth Vestmg Tentative Tract Map 15381,10 order to subdIVIde up to 70 single family homes on mdlVlduallots for implementation of the Hellman Ranch Specific Plan (c) Vesting Tentative Tract Map (VTTM) 15402 will create the intenor roadways and the proposed residential subdiviSion. A summary of the proposed residential subdiviSion IS provided below' lJ 70 S1Dgle famIly residential lots, WIth nummum lot SIZeS of 5500 square feet lJ 7 open space landscape lots, compnsmg 2.08 acres lJ Private roadway system, only providing access to the reSidential SUbdiVISIon WIth a single access point at the mtersectlon of Seal Beach Boulevard and Forrestal Dnve NOW, THEREFORE, BE IT RESOLVED that the Planmng Commission of the CIty of Seal Beach does hereby make the follOWIng findmgs regardmg Vesting TentatIve Tract Map 15402: 1. Vesting Tentative Tract Map 15402 IS consistent WIth the apphcable General and Specific Plans 10 that the map would allow the construction of a maximum of 70 smgle famIly homes on Lot 2 of VTTM 15381, a 14 94 acres parcel. 2. The Site IS phYSically SUitable for the proposed type of development, in that reSIdential development wIll be hmlted to that portIon of the property whIch has been Identified as SUitable for development by Converse Consultants Orange County 10 a report dated August 23, 1996 entItled "Evaluation of GeologiC Hazards and Geotechmcal Constramts, Hellman Ranch Property, Seal Beach, California 3. The SIte IS phYSically SUitable for the proposed denSIty of development, proposes less denSity than either the General Plan or the prevIous Hellman Specific Plan allowed, and generally conforms to the development standards for the adjacent smgle family reSIdentIal area known as Manna Hill. 4. The design of the subdiVISion IS not hkely to cause substantial environmental damage because all mitigation measures contained 10 the EIR done for thiS project have been mcorporated as condItions of approval and WIll be Implemented. 5. The deSign of the subdiVISion IS not hkely to cause senous pubhc health problems because all necessary utIhtIes and servIceS are aVaIlable to serve the project. 6. The design of the subdiviSIon wIll not conflict With easements acquired by the pubhc at large for access through, or use of, property withm the proposed subdivlSlon because all easements will be adequately preserved, mamtamed and/or abandoned With new easements created. 7. The discharge of water from the subdiVISion into the eXlstmg community sewer system wIll not VIOlate eXiSting reqUirements prescnbed by the local regIOnal water quality control board 8. The project attempts to address the wetlands ISSUes of the Site, and final approval of this wetlands configuration Will be reqUIred by the Department of Fish and Game, and the U S. Corps of Engmeers. 9. The subdiVISion map addresses the Gum Grove area, and seeks to preserve the grove by dedication to the CIty of Seal Beach 10. The Vesting Map IS subject to Federal and State laws, and the Map could be affected if It conflicts WIth the proVision or enforcement of these regulatIons and conditions that have been placed on thIS Map reflecting these regulatIons.
