HomeMy WebLinkAboutPC Res 97-31 - 1997-09-03 RESOLUTION NO. 97-31 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL APPROVAL OF REDEVELOPMENT PLAN AMENDMENT 97-1 THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1 In October, 1996, Hellman PropertIes LLC (" Apphcant"), completed and submitted a reVIsed SpecIfic Plan for the Hellman Ranch property and adjolmng properties, appropnate General Plan Amendments, and Vesting Tentative Tract Map No 15381 and 15402 (collectively "apphcatlon") WIth the City of Seal Beach The ApplIcant seeks amendments to the General Plan to allow the Implementation of the Hellman Ranch Specific Plan, dated October 1996, on the land descnbed 10 "Exhibit A' to Resolution No. 97-22, mcorporated by reference Section 2. Pursuant to 14 Calif. Code of Regs A 15025(a) and n II C and ill of the City'S Loca1 CEQA GUldehnes, staff prepared an Imtlal Study and a Draft EnVlronrnental Impact Report, which was ClTculated for public review and comment from Apnl 8, 1997 to May 27, 1997, 10 comphance WIth the proVISIons of the Cahfonua EnVITonrnental Quality Act and the CIty'S Loca1 CEQA GUldehnes. A ReVIsed DEIR was CIrculated for publIc review and comments from June 9, 1997 to July 23, 1997 Upon completion of the pubhc reVieW penod, a Pmal EnVlTOnmental Impact Report was reVIewed by the Planmng CommiSSIon at a pubhc heanng held on September 3, 1997 Section 3. A duly noticed pubhc heanng was held before the Planmng CommIsSIon on September 3, 1997 to conSider the apphcatlons At the pubhc heanng, Apphcant's consultants and representatives, mc1udmg Apphcant's legal counsel, and several other persons spoke 10 favor of and 10 oppoSItion to the request. Section 4. Portions of the Hellman Ranch, all of Gum Grove Nature Park, and the State Lands parcel are WIthm the boundaries of the RIverfront Redevelopment Project area, estabhshed by the City CounCil and Redevelopment Agency by Ordmance No. 780 on March 3, 1969. The redevelopment plan estabhshes certam land uses for vanous areas of the Redevelopment PrOject area, and those land use designations for the areas affected by the Hellman Ranch SpecIfic Plan require amendments to conform to the proVISions of the proposed SpecIfic Plan. Section 5. Based upon substantial evidence 10 the record of the Planmng Comffilssion heanngs regardmg the apphcatlon, mcludmg the facts stated 10 ~ 4 of thIs resolution, and in the environmental documentation prepared 10 conjunction With this project, and pursuant to ~A 28-2600 and 28-2602 of the City'S Code, the Plannmg ComffilsSlon hereby fmds that Redevelopment Plan Amendment 97-1 w1ll be beneficlal to the short term and long term land use goals of the City of Seal Beach. The Planmng Comffilssion further finds that approval of the subject apphcatlons will promote the pubhc health, safety and welfare. Therefore, the Planmng Commission finds that the requested amendments to the Redevelopment Plan will be 10 the pubhc mterest, and makes the follOWIng findmgs of fact: (a) The proposed Hellman Ranch Specific Plan Amendment Will provide a less intenSIVe use than is presently allowed under current Redevelopment Plan C \My Docume...\RESOlRedcvelopmenl PIa. (b) This proposal wlll result 10 completion of a City process that was Imtlated 10 1990, based upon deDlal of a prevIous development proposal by the City That denial set forth specific findmgs enumerating the reasons for demal EVidence presented dunng the public hearing mdlcates that the project apphcant has reevaluated the proper balance of development and pubhc benefit for the Hellman Ranch property, and the proposed Hellman Ranch Specific Plan addresses those concerns of the City 10 a manner which prOVides for appropnate development on the subject propertIes. (c) The CIty has Idenl1fied a number of objectives which are conSIdered to be essentIal 10 acmevmg sustamable development on the Hellman Ranch property. Those goals are: wetland restoration; preservation of Gum Grove Nature Park and dedication to the City; preservation of cultural resources, to the extent feaSIble, preservation of open space, to the extent feaSIble; mlmmal traffic and aIr qualIty Impacts, and, development of commercial and recreation faclhties (d) The proposed Hellman Ranch Specific Plan will further the above stated objectives of the City. (e) The proposed Hellman Ranch Specific Plan will allow for a reasonable number of addItional reSIdences on the subject property, recogmzmg the various site constramts dISCUSsed 10 the EIR and the Hellman Ranch Specific Plan, WIth the proVISion of open space and recreation uses to address the Identified objectives of the City. (t) The proposed Hellman Ranch Specific Plan, and the necessary Redevelopment Plan Amendments will not be detnmental to the short term or long term goals or objectives of the City of Seal Beach and are 10 the mterest of the pubhc health, safety and welfare Section 6. Based on the foregomg, the Planmng CommiSSIon hereby recommends that the City Councll approve Redevelopment Plan Amendment 97-1, as set forth below: 1. Section 503.1 - Sin&le FamilylRecreation DeveloDment is revised to read as follows: " Area 20 shown on the map shall be developed and used for SIngle famIly reSIdential, golf course, wetland, and park and recreational development accordmg to the followmg standards: Smgle faffilly residential parcels shall not contam less than 5000 square feet per parcel. Development standards shall be those as established in the Hellman Ranch Specific Plan. " 2. Section S06 - Commercial is revised to read as CoUows: "Areas; 1, 8, 18 and 19 shown on the map shall be developed and used for profeSSIonal offices or seTVIce or general commercial uses. SlIld areas, with the exception of Area 19, shall be developed accordmg to the followmg standards: The amount of land which may be covered by bwldmgs shall not exceed 60 per cent. The height of buildmgs m these areas shall not exceed three stones. Parkmg spaces shall be proVIded With a ffilmmum of one space per 200 square feet of gross floor area Permanent off-street loadmg spaces shall be proVIded on Site; allloadmg spaces shall be SItuated to avoid mterference WIth pedestnan and vehIcular traffic.
