HomeMy WebLinkAboutPC Res 97-30 - 1997-09-03 RESOLUTION NO. 97-30 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL REPEAL OF THE STATE LANDS SPECIFIC PLAN THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. In October, 1996, Hellman Properties LLC ("Apphcant"), completed and submItted a revIsed Specific Plan for the Hellman Ranch property and adjOlmng properties, appropnate General Plan Amendments, and Vesting Tentative Tract Map No. 15381 and 15402 (collectively "apphcatlon") WIth the Dty of Seal Beach. The Apphcant seeks amendments to the General Plan to allow the Implementation of the Hellman Ranch Specific Plan, dated October 1996, on the land descnbed m "ExhIbIt A" to Resolution No. 97-22, mcorporated by reference. Section 2. Pursuant to 14 Cahf. Code of Regs. A 15025(a) and AA lI.C and ill of the CIty'S Local CEQA GUldelmes, staff prepared an Imtlal Study and a Draft EnvITonmental Impact Report, whIch was cITculated for pubhc revIew and comment from Apnl 8, 1997 to May 27, 1997, m comphance WIth the proVISIonS of the CalIfornIa EnVIronmental QualIty Act and the CIty'S Loca1 CEQA Gwdehnes A ReVIsed DEIR was C1TCulated for pubhc review and comments from June 9, 1997 to July 23, 1997. Upon completion of the pubhc revIew penod, a Fmal EnVironmental Impact Report was reVIewed by the Planmng ComffilsSlon at a pubhc heanng held on September 3, 1997. Section 3 A duly noticed public heanng was held before the Planmng CommiSsion on September 3, 1997 to conSIder the applIcations. At the pubhc heanng, Apphcant's consultants and representatives, mcludmg Apphcant's legal counsel, and several other persons spoke 10 favor of and 10 oppoSItion to the request Section 4. The area presently known as the "State Lands" property IS IOcorporated into the Hellman Ranch Specific Plan. On September 8, 1986, the City Council adopted OrdlOance No. 1226, which adopted a revised State Lands SpecIfic Plan. ThIs specific plan, which is the current gUidance document regardmg development of the State Lands property, allows either a maxImum 2<Xl-room hotel WIth support faclhtles such as a restaurant and/or conference faClhtles, or a dmner theater The proposed Hellman Ranch Speclfic Plan would mcorporate mto Its area the State Lands Specific Plan area, rendenng the provIsions of the eXisting State Lands Specific Plan moot. Section 5. Based upon substantial evidence 10 the record of the Planning CommisSIon hearings regarding the apphcatlon, IOcludmg the facts stated 10 ~ 4 of thiS resolution, and 10 the enVIronmental documentation prepared 10 conjunction With tlus project, and pursuant to ~~ 28-2600 and 28-2602 of the City'S ~, the Plannmg Commission hereby finds that the repeal of the State Lands Specific Plan will be benefiCIal to the short term and long term land use goals of the City of Seal Beach. The Plannmg COmmisSIon further finds that approval of the subject applications will promote the pubbc health, safety and welfare. Plan Planning eomm.....'on ResolatlOn 97-30 September 3, 1997 (a) The proposed Hellman Ranch SpecIfic Plan Amendment, mcludmg the State Lands property, WIll proVIde a less mtenslve use than IS presently allowed under current Specific Plan regulations. (b) This proposal Will result 10 completion of a city process that was IDItIated in 1990, based upon denial of a prevIous development proposal by the City. That deDIal set forth specific findmgs enumerating the reasons for demal Evidence presented dunng the public heanng mdlcates that the project apphcant has reevaluated the proper balance of development and pubhc benefit for the Hellman Ranch property, and the proposed Hellman Ranch Specific Plan addresses those concerns of the CIty 10 a manner which proVides for appropriate development on the subject propertIes. (c) The City has Identified a number of objectives which are conSidered to be essential 10 achIevmg sustamable development on the Hellman Ranch property Those goals are' wetland restoration, preservation of Gum Grove Nature Park and dedication to the City; preservation of cultural resources, to the extent feasible; preservation of open space, to the extent feaSIble; mlmmal traffic and aIr qualIty Impacts; and, development of commercIal and recreatIon fllClhtles (d) The proposed Hellman Ranch Specific Plan WIll allow for the attamment of the above stated objectives of the City. (e) The proposed Hellman Ranch SpecIfic Plan wIll allow for a reasonable number of additional residences on the subject property, recogmzmg the vanous Site constramts discussed 10 the EIR and the Hellman Ranch Specific Plan, WIth the proVISIon of open space and recreation uses to address the Identified objectives of the City (t) The proposed Hellman Ranch Specific Plan, and the necessary General Plan Amendments WIll not be detnmental to the short term or long term goals or objectives of the City of Seal Beach and are 10 the interest of the pubbc health, safety and welfare. Section 6. Based on the foregomg, the Plannmg ComffilsSlon hereby recommends that the City CounCIl repeal OrdInance No. 1226, adopted by the City CounCIl on September 8, 1986, whIch wIll repea1 the "State Lands SpecIfic Plan". PASSED, APPROVED AND ADOPTED by the Planmng CommiSSIon of the City of Seal Beach at a meeting thereof held on the 3'" day of Se.ptember , 1997 by the followmg vote.
