A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF SEAL
BEACH RECOMMENDING TO THE CITY
COUNCIL THE ADEQUACY OF THE FINAL
ENVIRONMENTAL IMPACT REPORT FOR
THE HELLMAN RANCH SPECIFIC PLAN
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH
DOES HEREBY FIND AND RESOLVE:
Section 1. Hellman Ranch LLC has submitted a development
application for the Hellman Ranch and adjoining properties. The request is to amend the
General Plan and adopt the Hellman Ranch Specific Plan which will replace the existing
General Plan land use designation and Specific Plan zoning designations within the
boundaries of the proposed specific plan. The proposed Specific Plan would regulate all
land use development on the project site. The Development Regulations section of the
proposed Specific Plan would provide guidance on the implementation of each Planning
Area, included the permitted uses, conditional uses, and prohibited uses. Also provided
are overall design concepts and general design guidelines for all the land uses that could be
developed within the Specific Plan area. As shown on Figure 3-3 of the Draft EIR, the
proposed Hellman Ranch Specific Plan allocates land uses over the 231. 3-acre property
into ten (10) distinct Planning Areas. The legal description for the Hellman Ranch
Specific Plan area is provided as "ExhIbit A", attached hereto and incorporated herein.
Section 2. Pursuant to 14 Calif. Code of Regs. ~ 15025(a) and ~ Il.C
and ill of the City's Loca1 CEQA Guidelines, staff prepared an Initial Study and a Draft
Environmental Impact Report (DEIR) which was circulated for public review and
comment from April 8, 1997 to May 27, 1997, in compliance with the provisions of the
California Environmental Quality Act and the City's Loca1 CEQA Guidelines. Revised
sections of the DEIR were circulated for public review and comments from June 9, 1997
to July 23, 1997. Upon completion of these public review periods, a Final Environmental
Impact Report (FEIR) was reviewed by the Planning Commission at public hearings held
on September 3, 1997.
Section 3. The City retained P&D Consultants to prepare the required
DEIR and FEIR, both of which have been submitted to the City for independent review.
Section 4. The Planning Commission conducted a public hearing on
September 3, 1997, and received public comments, both written and oral, regarding the
FEIR.
Section 5. The Planning Commission has independently reviewed the
FEIR, the staff report, additional oral and written comments, the proposed Conditions of
Approval, proposed Mitigation Measures, and the Mitigation Monitoring Program
prepared by P&D Consultants, at the above referenced public hearing.
Section 6. Based upon its review of the above mentioned documents,
and upon substantial evidence in the record, the Planning Commission recommends to the
City Council that the Hellman Ranch Specific Plan EIR, including the DEIR and FEIR,
represents the independent judgment of the City of Seal Beach, and that the FEIR is
legally adequate in terms of compliance with CEQA and the City's Loca1 CEQA
Guidelines, incorporating by reference the revisions to Mitigation Measures CR-3, CR-4,
