RESOLUTION NUMBER 97-3 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DENYING ZONING TEXT AMENDMENT 96-8, A PROPOSAL TO AMEND SECTION 28-2319(E)(3) OF THE MUNICIPAL CODE REGARDING SEPARATION OF TWO-STORY CABANAS THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE Section I At Its meeting of January 8, 1997, the Plann10g CommISSion considered and denied Zoning Text Amendment 96-8 ThiS amendment was a request to amend Section 28-2319(E)(3) of the Code of the City of Seal Beach to amend the required setback between two-story cabanas in a trailer park In ApnlI996 the City Council directed staff to commence research into height IllnItations and setback requirements for two-story cabanas in the Seal Beach Trailer Park The Council's acllon was a result of a concern expressed by a trailer park resident Section 2 A duly noticed public heanng was scheduled for consideration before the Planmng Commission on October 9, 1996 and then December 4, 1996, before being rescheduled and ultllnately held on JanualY 8, 1997 to con;ider Zone Text Amendment 96-8 Consideration of this matter was postponed on two occasions to allow the Orange County Fire Authority to respond With any concerns it might have regard10g the potential text amendment Section 3 The record of the January 8, 1997 heanng 10dlcates the following (a) At said public hearing there was oral and written tesllmony and evidence received by the Planning CommiSSion SpeCifically, one (I) person spoke m favor of the proposed text amendment and six (6) people spoke in OppOSition (b) ZT A 96-8 proposes to amend the required setback between two- story cabanas to potenllally allow two-story structures to'be located Within six (6') feet of each other (c) In considenng ZT A 96-8 the Commission conSidered three potential options I) Recommend removal of the 20-foot setback requirement for two-story structures, in effect allow for two-story stmcture~ on all lots of the trallel park 2) Recommend a setback for the two-story structures somewhere between the current 20-foot reqUIrement and the minimally reqUired 6 feet 3) Take no action, recommend demal of the proposed text amendment. This action would retain the 20-foot ;eparatlon requirement between two-story structures Section 4 Based upon the facts contamed 111 the record, includmg those stated in ~4 of this resolution and pursuant to ** 28-2600 of the City's Code, the Planning Commission makes the following findings (a) Proposed ZT A 96-8 does not serve to advance a pubhc mterest (b) Increased structUles sizes in the park have a strong potential to increase the number of inhabitants of the park while providing no additional parking to the park's E 'MY DOCUMENTS'ZONINGTEXT AMENDMENTS'968 RESOLUTION DOC Be Be . j'lmmlUK ('01111111,\\1011 Re,\o/ullOn No 97-3 Februarv 19, 1997 inventory The park provides I 5 park10g spaces per unit versus 2 spaces per umt for single family structures Additionally, the park provides no on street parking while the majority of residential uses 10 the City provide on street public parking on both sides of residential streets (c) The decreased separation between structures, particularly m the greenbelt area, may result in a hindrance to fire and other emergency responses (d) AlIow1Og two-story structures on every lot, once built, would reduce hght and air availability within the park Section 5 Based upon the foregoing, the Planmng Commission hereby denies Zoning Text Amendment 96-8 and determines to not to change the proVisions of SectIOn 28-2319(E)(3) of the Code of the CIty of Seal Beach PASSED, APPROVED AND ADOPTED by the Plann10g Commission of the CIty of Seal Beach at a meet10g thereofhcld on the 19'" day of Febluary, 1997, by the followmg vote AYES Commissioners Brown, Law, Sharp NOES Commissioners ABSTAIN Commissioners Hood ABSENT Commissioners Yost Br Brown, M 0 , Chairman Plannlllg Commission rte~ WhIttenberg, Secretary .I' Planning Commission '11'11 *' 111 Page 2 96-8 Rcsollllloll
