HomeMy WebLinkAboutPC Res 98-42 - 1998-12-14 -. , .- RESOLUTION NUMBER 98 - 42 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW NO. 98-9, APPROVING AN ARCHITECTURAL REVIEW IN CONJUNCTlONN WITH THE PROPOSED ADDITION OF A TWO-STORY CABANA OVER AN EXISTING TRAILER AT 77 RIVERSEA ROAD, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE: Section 1. On November 18, 1998, Steve Smith ("The Applicant") submitted an application for Minor Plan Review 98-9 with the Department of Development Services. The applicant is seeking to construct a second-story cabana of 260 square feet and a second-story deck area of 280 square feet at an existing mobile home within the Seal Beach Trailer Park at 77 Riversea Road Section 2. Pursuant to 14 Calif. Code of Regs ~ 15025(a) and ~ n B of the City's Local CEQA Guidelines, staff has determined as follows' The application for Plan Review 98-9 is categorically exempt from review pursuant to the California Environmental Quality Act pursuant to 14 Calif. Code of Regs. ~ 15301 (Existing Uses), because it involves the negligible expansion of an existing use; pursuant to ~ 15305 (Minor Alterations in Land Use Limitations), because the proposal involves a minor alteration in a land use limitation and does not involve either a property in excess of 20% slope or a change in land use or density; and finally, pursuant to ~ 15061(b)(3), because it can be seen with certainty that there is no possibility that the approval may have a significant effect on the environment Section 3. A duly noticed hearing was held before the Planning Commission on December 9, 1998 to consider the application for MPR No. 98-9. Section 4. the following: The record of the hearing on December 9, 1998 indicates (a) On November 18, 1998, Steve Smith ("The Applicant") submitted an application for Minor Plan Review 98-9 with the Department of Development Services (b) The applicant is requesting architectural review to construct a second-story cabana of 260 square feet and a second-story deck area of 280 square feet at an existing mobile home within the Seal Beach Trailer Park at 77 Riversea Road (c) The subject property is located in the Residential High Density zone, within the Seal Beach Trailer Park, and the specific trailer space is surrounded on three sides with residential uses within the Trailer Park and to the west by Riversea Road (d) The proposed location of the second-story cabana complies with all City requirements regarding separation from existing two-story cabanas. (e) The subject property is a rectangle in shape with a lot area of approximately 810 square feet (27' x 30'). PlannIng Comml.u/Oll RuoluhOll 98-42 Mmor Plan RevIew 98-9, 77 Rn.....ea December 14. 1998 (g) A "Building Department Plan Review Checklist" has been received regarding the proposed project, indicating five items that need to be addressed in the conditions of approval for the subject project. Those items have been incorporated into Section 6, Conditions of Approval. Section 5. Based upon the facts contained in the record, including those stated in ~ 4 of this resolution, and pursuant to ~ 28-2319 of the City's Code, the Planning Commission hereby finds as follows. (a) Minor Plan Review 98-9 is consistent with the provisions of the Land Use Element of the City's General Plan, which provides a "high density residential" designation for the subject property and permits trailer residential uses within the Seal Beach Trailer Park. The use is also consistent with the remaining elements of the City's General Plan, as the policies of those elements are consistent with, and reflected in, the Land Use Element. Accordingly, the proposed use is consistent with the General Plan. (b) The building and property at 77 Riversea Road are adequate in size, shape, topography and location to meet the needs of the proposed use of the property and complies with all City requirements regarding separation from existing two- story cabanas (c) Required adherence to applicable building and fire codes ensure there will be adequate water supply and utilities for the proposed use (d) The proposed use, as conditioned for approval, will be compatible with surrounding uses and the community in general, because the style, height and bulk of the proposed structure, as remodeled, is consistent with the surrounding residential uses Section 6. Based upon the foregoing, the Planning Commission hereby approves Minor Plan Review 98-9, subject to the following conditions: 1. Minor Plan Review 98-9 is approved to construct a second-story cabana of 260 square feet and a second-story deck area of not to exceed 280 square feet at an existing mobile home at 77 Riversea Road, Seal Beach. 2. The overall structure shall maintain a minimum setback of three (3) feet from adjacent side trailer space lines as designated on the map of the Seal Beach Trailer Park, dated October 31, 1993, on file in the Department of Development Services This includes the existing structure and proposed second-story cabana and deck areas. The two-story cabana shall be located no closer than twenty-feet from any existing two-story cabanas 3 A life safety sprinkler system shall be installed throughout the trailer and cabaiia in accordance with the requirements set forth by the National Fire Protection Association, Section No. 13D. 4 The exterior of the cabaiia shall be constructed of stucco, or one (1) hour fire- rated material shall be installed under wood siding. 5. Approval shall be subject to compliance with all applicable portions of Title 25 of the California Administrative Code and the Uniform Building Code 6 All construction shall be in substantial compliance with the plans approved through MPR 98-9, as modified by the above conditions of approval. 7. Final inspection request for Building Permit 17111 is needed 8. Removal of front "eyebrows" back to the front trailer space line along Riversea Road. Applicant to obtain permit from State Department of Housing and Community Development for alteration of roof of existing trailer to install stairway through roof to the proposed second story cabana 10. This Minor Plan Review shall not become effective for any purpose unless an "Acceptance of Conditions" form has been signed by the applicant in the presence of the Director of Development Services, or notarized and returned to the Planning Department; and until the ten (10) day appeal period has elapsed. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 14th day of December, 1998 by the following vote' AYES.
