RESOLUTION NO. 98 - 41 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL APPROVAL OF ZONE CHANGE 98- 2, A REZONING OF 0.53 ACRES LOCATED AT 321 SEAL BEACH BOULEVARD FROM GNERAL COMMERCIAL (C-2) TO RESIDENTIAL MEDIUM DENSITY (RMD) (ANAHEIM BAY VILLAS) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. D. Bartlett Associates, on behalf of Ellen Musso, Et AI ("Applicant") has submitted revised applications for a general plan amendment and zone change for the Anaheim Bay Villas project proposed for property located at 321 Seal Beach Boulevard, in the City of Seal Beach The Applicant has submitted the aforementioned revised applications to allow the construction of eight (8) single family detached residences on three parcels having twenty-six foot frontages, three parcels having twenty-nine foot frontages, and two parcels having thirty foot frontages Section 2. Pursuant to 14 Calif Code of Regs. ~ 15025(a) and ~~ n C and ill of the City's Local CEQA Guidelines, staff prepared an Initial Study and a Negative Declaration, which was circulated for public review and comment from August 27, 1998 to September 17, 1998, in compliance with the provisions of the California Environmental Quality Act and the City's Local CEQA Guidelines. The Negative Declaration was reviewed by the Planning Commission at a public hearing held on September 23, 1998 in relation to the original land use proposal and again on November 18, 1998 in relation to the revised land use proposal. Section 3. A duly noticed public hearing was held before the Planning Commission on November 18, 1998 to consider the revised applications At the public hearing, the Planning Commission invited and considered any and all testimony offered in favor or opposition to said revised applications. Section 4 The record of the hearings indicates the following (a) Applicant seeks to establish the following uses as part of the Anaheim Bay Villas project. Development Area Size. RMD, Residential Medium Density To' RMD, Residential Medium Density (c) The surrounding land uses and zoning are as follows NORTH: Mini MartlBait Shop, at the southwest comer of Pacific Coast Highway and Seal Reach Boulevard, in the General Commercial (C-2) zone. SOUTH: Residence in the General Commercial. (C-2) zone, with mixed residential and commercial uses south of Landing Avenue, in the Limited Commercial (L-C) zone. WEST: Single Family Residences in the Residential Medium Density (RMD) zone EAST' Anaheim Bay and the Naval Weapons Center in the Public Land Use/Recreation (pLU/R) zone Section 5. Based upon substantial evidence in the record of the Planning Commission hearings regarding the application, including the facts stated in ~ 4 of this resolution, and in the environmental documentation prepared in conjunction with this project, and pursuant to ~~ 28-2600 and 28-2602 of the City's Code, the Planning Commission hereby finds that Zone Change 98-2 will be beneficial to the short term and long term land use goals of the City of Seal Beach. The Planning Commission further finds that approval of the subject applications will promote the public health, safety and welfare. Therefore, the Planning Commission finds that the requested Zone Change will be in the public interest, and makes the following findings offact. (a) The proposed Zone Change will conform land uses to the goals and policies of the Land Use Element for the subject area as revised by General Plan Amendment 98-2, and provides a comprehensive development which accomplishes the following goals of the City in achieving sustainable development on the subject property. 1. Creates a land use that is compatible and consistent with the prevailing pattern ofland uses in the immediate vicinity. 2. Promotes the general integrity of the neighborhood by replacing declining and underutilized commercial land use with desirable, appropriately located residential uses 3. Creates a comprehensive development program for under- utilized and potentially incompatible properties. (b) The proposed Anaheim Bay Villas project, and the necessary Zone Change, will not be detrimental to the short term or long-term goals or objectives of the City of Seal Beach and are in the interest of the public health, safety and welfare The Zone Change 98-2 PCR 2 .' .. Section 6. Based on the foregoing Sections 1 through 5, the Planning Commission hereby recommends that the City Council approve Zone Change 98-2, to change the zoning designation of the subject property from C-2, Commercial General to RMD, Residential Medium Density on the Zoning Map of the City of Seal Beach The Commission recommends that the City Council consider minimum lot widths of30 feet PASSED, APPROVED AND ADOPTED by the Planni');Commission of the CitX of Seal Beach at a meeting thereof held on the /./79" day of No V ~J.;7<-1998, by the following vote: AYES: Commissioners Cutull, Hood, Larson and Lyon NOES: Commissioners Brown ABSENT: Commissioners None Brian rown, MD Chairman of the Planning Commission Lee Whittenberg V Secretary of the Planning Commi sion Zone Change 98-2 PCR 3
