RESOLUTION NUMBER 98 - 37 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL THE ADEQUACY OF THE FINAL ENVIRONMENTAL IMPACT REPORT FOR THE BIXBY OLD RANCH TOWNE CENTER THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE: Section 1. Bixby Ranch Company has submitted a development application for the Bixby Old Ranch Golf Course and Tennis Club and adjoining properties. The request is to amend the General Plan and change zoning designations to facilitate the proposed land uses described below The proposed Bixby Old Ranch Towne Center Concept Plan involves a mixed-use development consistmg of a variety of commercial/retail, hotel, restaurant, senior care, recreation and institutional land uses (''the Project"). Section 2. Pursuant to 14 Calif. Code of Regs. ~ 15025(a) and ~ II.C and ill of the City's Local CEQA Guidelines, staff prepared an Initial Study and a Draft Fnvironmental Impact Report (DElR) for the Project. The City retained Culbertson, Adams & Associates, Inc. to prepare the required environmental documents, wluch have been submitted to the City for independent review. The DElR was circulated for public review and comment from April 15, 1998 to May 29, 1998, in compliance with the provisions of the California Fnvironmental Quality Act and the City's Local CEQA Guidelines. Upon completion of these public review periods, a Pinal Environmental Impact Report (FElR) was completed and reviewed by the Planning Commission at public hearings held on September 9, October 21, and November 4, 1998. At the public hearings the Planning Commission took testimony and evidence, both written and oral, regarding the adequacy of the PElR. Section 3. The Planning Commission has independently reviewed the PElR, the staff report, additional oral and written comments, the proposed Conditions of Approval, proposed Mitigation Measures, and the Mitigation Monitoring Program prepared by Culbertson, Adams & Associates, Inc., at the above referenced public hearings. Section 4. Based upon its review of the above mentioned documents, and upon substantial evidence in the record, the Planmng Commission recommends to the City Council that the Bixby Old Ranch Towne Center EIR, including the DElR and PElR, represents the independent judgment of the City of Seal Beach, and that the PElR is legally adequate in terms of compliance with CEQA and the City's Loca1 CEQA Guidelines.
