RESOLUTION NUMBER 98 - 35 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW NO. 98-7, APPROVING AN ARCHITECTURAL REVIEW IN CONJUNCTlONN WITH THE PROPOSED ADDITION OF A TWO-STORY CABANA OVER AN EXISTING TRAILER AND CABANA AT 51 RlVERSEA ROAD, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE: Section 1. On August 20, 1998, Bruce Grossman ("The Applicant") submitted an application for Minor Plan Review 98-7 with the Department of Development Services. The applicant is seeking to construct a second-story cabana of 720 square feet, a second-story deck area of 315 square feet, and an 117.5 square foot addition along the north side of the first floor at an existing mobile home within the Seal Beach Trailer Park at 51 Riversea Road Section 2. Pursuant to 14 Calif. Code of Regs. ~ 15025(a) and ~ n B of the City's Local CEQA Guidelines, staff has determined as follows' The application for Plan Review 98-7 is categorically exempt from review pursuant to the California Environmental Quality Act pursuant to 14 Calif Code of Regs. ~ 15301 (Existing Uses), because it involves the negligible expansion of an existing use; pursuant to ~ 15305 (Minor Alterations in Land Use Limitations), because the proposal involves a minor alteration in a land use limitation and does not involve either a property in excess of 20% slope or a change in land use or density, and finally, pursuant to ~ 15061(b)(3), because it can be seen with certainty that there is no possibility that the approval may have a significant effect on the environment. Section 3. A duly noticed hearing was held before the Planning Commission on October 21, 1998 to consider the application for MPR No 98-7 and the matter was continued to November 4, 1998 for further consideration by the Planning Commission. Section 4 The record of the hearing on October 21 and November 4, 1998 indicates the following' (a) On August 20, 1998, Bruce Grossman ("The Applicant") submitted an application for Minor Plan Review 98-7 with the Department of Development Services (b) The applicant is requesting architectural review to construct a second- story cabana of 720 square feet, a second-story deck area of 315 square feet, and an 117.5 square foot addition along the north side of the first floor at an existing mobile home within the Seal Beach Trailer Park at 51 Riversea Road (c) The subject property is located in the Residential High Density zone, within the Seal Beach Trailer Park, and is surrounded on three sides with residential uses within the Trailer Park and to the west by the San Gabriel River. (d) The subject property is a rectangle in shape with a lot area of approximately 1,196 square feet (26' x 46') (e) As of October 14, 1998 staff has received two written responses to its mailed notice regarding Minor Plan Review 98-7, both expressing concern regarding the blockage of views by the proposed construction. (t) A "Building Department Plan Review Checklist" has been received regarding the proposed project, indicating five items that need to be addressed in the conditions of approval for the subject project Those items have been incorporated into Section 6, Conditions of Approval. (g) Previous approvals by the Planning Commission for second-story cabanas have required a minimum three-foot side yard setback from the recognized trailer space lines (Minor Plan Reviews 95-1 and 95-6) Section 5. Based upon the facts contained in the record, including those stated in ~ 4 of this resolution, and pursuant to ~ 28-2319 of the City's Code. the Planning Commission hereby finds as follows. (a) Minor Plan Review 98-7, as conditioned, is consistent with the provisions of the Land Use Element of the City's General Plan, which provides a "high density residential" designation for the subject property and permits trailer residential uses within the Seal Beach Trailer Park The use is also consistent with the remaining elements of the City's General Plan, as the policies of those elements are consistent with, and reflected in, the Land Use Element Accordingly, the proposed use is consistent with the General Plan (b) The building and property at 51 Riversea Road are adequate in size, shape, topography and location to meet the needs of the proposed use of the property (c) Required adherence to applicable building and fire codes ensure there will be adequate water supply and utilities for the proposed use (d) The proposed use, as conditioned for approval, will be compatible with surrounding uses and the community in general, because the style, height and bulk of the proposed structure, as remodeled, is consistent with the surrounding residential uses Section 6. Based upon the foregoing, the Planning Commission hereby approves Minor Plan Review 98-7, subject to the following conditions 1. Minor Plan Review 98-7 is approved to construct a second-story cabana of 720 square feet, a second-story deck area of not to exceed 200 square feet, and an 117.5 square foot addition along the north side of the first floor at an existing mobile home at 51 Riversea Road, Seal Beach 2 The overall structure shall provide a minimum setback of three (3) feet from adjacent side trailer space lines as designated on the map of the Seal Beach Trailer Park, dated October 31, 1993, on file in the Department of Development Services This includes the existing cabana structure and proposed second-story deck areas. 3 A life safety sprinkler system shall be installed throughout the trailer and cabana in accordance with the requirements set forth by the National Fire Protection Association, Section No. 13D. 4. The exterior of the cabana shall be constructed of stucco, or one (1) hour fire- rated material shall be installed under wood siding or other approved equal. 5. Approval shall be subject to compliance with all applicable portions of Title 25 of the California Administrative Code and the Uniform Building Code 6 All construction shall be in substantial compliance with the plans approved through MPR 98-7, as modified by the above conditions of approval 7. The applicant shall obtain authorization from the appropriate flood control district prior to installation of fences, decks, patios, or other landscape treatments within the San Gabriel River flood control easement area Evidence of such MPR 91-7 PC Reso 2 ; . Road November 4, 1998 authorization shall be provided to the City prior to issuance of any permits for construction in the easement area 8. A new 100 AMP electrical panel shall be installed. 9 Water heater needs to be moved and the new location must be shown on the plans 10. Rear deck must be removed from side yard encroachments. 11. Second-story side yard deck will not be allowed if it encroaches into the mandatory 3' side-yard setback. 12. Property needs to be professionally surveyed and a report provided to the City. I3 This Minor Plan Review shall not become effective for any purpose unless an "Acceptance of Conditions" form has been signed by the applicant in the presence of the Director of Development Services, or notarized and returned to the Planning Department; and until the ten (10) day appeal period has elapsed. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 4th day of November 1998 by the following vote: AYES: Commissioners Cutull, Hood, Lyon and Chairman Brown NOES: Commissioners Larson ABSENT.
