RESOLUTION NO. 98-30
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SEAL BEACH RECOMMENDING
TO THE CITY COUNCil. DENIAL OF GENERAL
PLAN AMENDMENT 98-2 (ANAHEIM BAY
VILLAS)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES
HEREBY RESOLVE:
Section 1. D Bartlett Associates, on behalf of Ellen Musso, Et AI ("Applicant") has
submitted applications for a general plan amendment, zone change and variance approvals for
the Anaheim Bay Villas project proposed for property located at 321 Seal Beach Boulevard, the
City of Seal Beach The Applicant has submitted the aforementioned applications to allow the
construction of nine (9) single family detached residences on a zero lot line configuration
Section 2 Pursuant to 14 Calif. Code of Regs 0 IS02S(a) and O~ D.C and m of the
City's Local CEQA Guidelines, staff prepared an Initial Study and a Negative Declaration,
which was circulated for public review and comment from August 27, 1998 to September 17,
1998, in compliance with the provisions of the California Environmental Quality Act and the
City's Local CEQA Guidelines The Negative Declaration was reviewed by the Planning
Commission at a public hearing held on September 23, 1998
Section 3 A duly noticed public hearing was held before the Planning Commission on
September 23, 1998 to consider the applications At the public hearing, the Planning
Commission invited and considered any and all testimony offered in favor or opposition to said
applications
Section 4 The record of the hearings indicates the following
(a) Applicant seeks to establish the following uses as part of the Anaheim Bay
Villas project.

Section 5 Based upon substantial evidence in the record Dfthe Planning CommiSSIon
hearings regarding the application, including the facts stated in 0 4 of this resolution. and in the
environmental documentation prepared in conjunction with this project, and pursuant to ~~ 28-
2600 and 28.2602 of the City's~, the Planning Commission hereby finds that General Plan
Land Use Element Amendment 98-2 will not be beneficial to the short term and long term land
use goals of the City of Seal Beach The Planning Commission further finds that approval of the
subject applications will not promote the public health, safety and welfare Therefore, the
Planning Commission finds that the requested amendments to the General Plan Land Use
Element of the City of Seal Beach will not be in the public interest, and makes the following
findings of fact:

(a) The proposed General Plan Amendments will not conform land uses to the
goals and policies of the Land Use Element for the subject area The requested amendments
would adversely impact the existing commercial and limited-commercial land use designations
existing along Seal Beach Boulevard between Pacific Coast Highway and Electric Avenue,
creating an inappropriate mix of residential and commercial uses along Seal Beach Boulevard

(b) The proposed General Plan Amendment will be detrimental to the short
term or long term goals or objectives of the City of Seal Beach and are not in the interest of the
public health, safety and welfare. The proposed amendment is not consistent with the General
Plan, and would create an inappropriate mix of commercial and residential uses along Seal
Beach Boulevard.
Section 6. Based on the foregoing Sections 1 through 5, the Planning Commission
hereby recommends that the City Council deny General Plan Amendment 98-2
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of
Seal Beach at a meeting thereof held on the 71b day of October , 1998, by the
following vote'
