SUMMARY OF REQUEST:
Authorize Mayor to execute comment letter to the Local Agency Formation
Commission of Orange County regarding requested "Sphere of Influence and
Municipal Service Review Reconfirmations" for the City of Los Alamitos, the City
of Huntington Beach, and the Sunset Beach Sanitary District. Receive and File
Staff Report.
BACKGROUND:
The Local Agency Formation Commission of Orange County ( "LAFCO ") has
distributed "Sphere of Influence and Municipal Service Review Reconfirmations"
for the City of Los Alamitos, the City of Huntington Beach, and the Sunset Beach
Sanitary District and is requesting that any commenting agencies to "Please
submit any comments on the proposed ... SOI Update and MSR reconfirmation
to LAFCO staff by no later than April 17, 2009' for the City of Los Alamitos matter
and by April 30 for the City of Huntington Beach and Sunset Beach Sanitary
District matters.
A copy of the letters from LAFCO regarding each of the referenced matters is
provided as Attachment 2 for review by the City Council in considering this
matter. As indicated in the attached LAFCO letters, these matters are scheduled
to be considered in either May or July 2009.
As part of the LAFCO reviews in 2005, and 2006, the City Manager or City
Council stated concurrence by letters on August 5, 2005, September 8, 2005,
February 27, 2006, June 26, 2006, and October 13, 2008, that the City of Seal

Beach sphere of influence be reaffirmed as coterminous with the City's existing
jurisdictional boundaries.
On October 13, 2008 the City Council considered the re- confirmation of the City
of Seal Beach Sphere of Influence, and that staff report indicated "Should the
Rossmoor incorporation effort fail and the residents there or in Sunset Beach
express interest in annexing, the Council may wish to provide clarification to Staff
regarding its position that the City of Seal Beach sphere of influence be
reaffirmed as coterminous with the City's existing jurisdictional boundaries."
In November of 2008, the residents of Rossmoor voted not to incorporate.
Staff has prepared a comment letter to LAFCO regarding the issue of sphere of
influences for the City of Seal Beach.
FISCAL IMPACT:
No impact on City.

report. Enhancement of an attractive, sustainable, community and positive image
for the City of Seal Beach is goal that all of our residents share.
Should the residents of Rossmoor and /or Sunset Beach express an interest in
joining the City of Seal Beach, the City would be amenable to a discussion
regarding this issue and any required amendments to the sphere of influence.
Any decision to annex these areas would follow discussions with the affected
residents and a full review of municipal services including fiscal impacts.

LAFCO has initiated a review of the City of Los Alamitos Sphere of Influence.
Spheres of influence are established by LAFCO to identify the future boundaries
and service areas of cities and special districts. In addition, LAFCO will consider
a reconfirmation of the Municipal Service Review completed for the City of Los
Alamitos in March 2005. Please submit any comments on the proposed City of
Los Alamitos SOI update and MSR reconfirmation to LAFCO staff by no later
than April 17, 2009.
Background
In accordance with Government Code Section 56425 and the LAFCO Sphere of
Influence policy, LAFCO is required to review an agency's Sphere of Influence at
least once every five years in conjunction with conducting Municipal Service
Reviews. LAFCO is required to establish an SOI to identify probable future
boundaries and service areas of all cities and special districts.
A map of the City's current Sphere of Influence and the March 2005 MSR
Statement of Determinations are included as Attachments A and B, respectively,
for your reference. The City's current SOI includes the unincorporated
community of Rossmoor.
Your specific comments may address, but should not be limited to, the following:
• Does the SOI accurately reflect the logical service boundary for this
agency in the next 10 to 15 years?
• Are there adjustments to the SOI that are warranted given future
development, service demands and/or operation constraints?
• Are there unincorporated islands of territory that should be included or
removed from this agency's sphere?

Location
The City of Los Alamitos is located in northwest Orange County, north of the City of Seal
Beach, west of the Cities of Garden Grove and Cypress, and north of the unincorporated
community of Rossmoor.
Environmental Review
In accordance with the California Environmental Quality Act (CEQA), LAFCO, as lead agency
under CEQA, is responsible for conducting an initial study to address the environmental impacts
of the project.
The proposal is scheduled for LAFCO consideration at the Commission's May 13, 2009
meeting. Please submit all comments regarding this proposal to Bob Aldrich, Assistant
Executive Officer, no later than April 17, 2009. Comments may be submitted in writing or by

Location
The City of Huntington Beach is largely surrounded on all sides by other incorporated
cities in Orange County and the Pacific Ocean. To the east, along the Santa Ana River,
are the cities of Newport Beach and Costa Mesa; to the east and north are the cities of
Fountain Valley and Westminster; to the north is the City of Seal Beach; and to the west
and northwest are the unincorporated community of Sunset Beach and the Pacific
Ocean. Huntington Beach is a full service city providing its residents with police, fire,
water, local sewer, street repair /maintenance, planning /land use, redevelopment and
parks and recreation services.

1) Infrastructure Needs and Deficiencies
The City of Huntington Beach's General Plan addresses the issues of growth,
development and the demand for services to ensure that the city's service
infrastructures are sufficient in providing quality level of services to its residents.
Additionally, the city adopts an annual budget and a 5 -year capital improvement
program (CIP) to ensure that service levels are maintained or improved and that the
C1P is adequately funded. Like other municipalities of similar age, there are deferred
maintenance issues with a backlog of infrastructure needs not met with adequate
funding.
2) Growth and Population Pro 'ec� tions
The City of Huntington Beach is projected to experience an increase of approximately
19,000 residents by the year 2020.
3) Financing Constraints and Opportunities
The City of Huntington Beach uses an annual budget process that allows for mid -year
adjustments when necessary. The impact of the local revenues shift to the State from the
City of Huntington Beach, like all cities in Orange County and California, will result in
reductions in city revenues. As well, the city's revenue has been impacted by the recent
court ruling to disallow the charging of a franchise fee (in -lieu) from one of the
enterprise funds. Despite these challenges, the city's proposed FY 2005 -2006 represents
a commitment from city council and city staff to decrease expenditures without a visible
loss in service to the public.
4) Cost Avoidance Opportunities
The City of Huntington Beach is a full- service city. The city currently provides
municipal services that include building and planning, redevelopment, fire, police,
library, parks and recreation, and public works (including water, sewer, and storm
drainage). The city currently contracts with the County of Orange for animal control
services and a private contractor for solid waste collection and recycling. No significant
issues were identified.
5) Opportunities for Shared Facilities
The City of Huntington Beach participates in the sharing of facilities and services by
providing staffing assistance for emergency services to adjacent and other agencies
through mutual agreement. As one of its budget goals, the city has committed to
maximizing the available cost sharing opportunities with other levels of government
(Federal and State). No significant issues were noted.

6) Opportunities for Rate Restructuring
No issues regarding rate restructuring currently apply to the City of Huntington Beach.
7) Government Structure Options
The City of Huntington Beach's Sphere of Influence includes approximately 28 square
miles of city jurisdictional boundaries and around 1,600 acres of unincorporated
territory. Originally adopted in 1973, the City's sphere has for the most part remained
unchanged. With a pending annexation of Bolsa Chica , it is expected that the majority
of the unincorporated area will become a part of the city limits.
The city has not expressed interest in annexing the 41 -acre unincorporated area located
in the northeastern section of the city; this area should remain in the City of Huntington
Beach's sphere until completion of the MSR and sphere for the adjacent City of
Westminster.
Sunset Beach is bordered by the City of Huntington Beach on the north, south, and east.
The city directly and indirectly provides services to the community. The only other city
that could potentially provide services to Sunset Beach is the City of Seal Beach that
borders the northern tip of Sunset Beach at that gated entrance to Seal Beach's Surfside
residential community. Surfside, however, is physically separated from the main
portion of the City of Seal Beach by the Los Alamitos Bay, and is difficult at times for
even the City of Seal Beach to serve. In discussions with the City of Seal Beach staff,
they have expressed no interest in the future annexation of Sunset Beach.
The unincorporated community of Sunset Beach will likely face significant land use
changes and fiscal challenges in the next 15 to 20 years under its existing governance
structure. Staff recommends that the City's sphere of influence be amended to include
Sunset Beach to encourage the most efficient provision of municipal level services if
requested by the community.
8) Evaluation of Management Efficiencies
No significant issues were noted to the City of Huntington Beach.
9) Local Accountability and Governance
The City of Huntington Beach provides a strong outreach effort to the community
through city council meetings (also televised live through local cable), website, and the
Pubic Information Office (PIO), which serves as a vital communication link between
city representatives and the Huntington Beach community. The PIO keeps residents
informed of city services, programs, recreational activities and opportunities.

Location
The Sunset Beach Sanitary District provides sewer and refuse collection
services to the unincorporated community of Sunset Beach and portions of
the Cities of Seal Beach (Surfside) and Huntington Beach. A map of the
agency's current sphere boundary is included as Exhibit A.

LAFCO, as lead agency under CEQA, is responsible for conducting an
initial study to address the environmental impacts of the project.

Growth and Population Projections
The area served by the district is largely
built -out. The District also provides refuse
collection and disposal through a contract
with Rainbow Disposal, a private company.
Any additional infrastructure required to
accommodate growth is expected to be
minimal.
infrastructure Needs or DeFciencies
In 2002 OCSD identified 20 areas of concern
primarily due to fats, oils and grease. For FY
2003 -2004, the District has budgeted
$54,000 for capital improvements to the
sewers stem.
Financing Constraints and Opportunities
Based on audited financial statements, the
District's revenues are constant and
expenditures have slightly Increased. Annual
deficits appear to be resolved with funds
from reserves. Per capita expenses for sewer
services ($138) are higher than the other
sewer agencies serving the MSR study area
($17).
Opportunities for Cost Avoidance and
District operating expenses per foot of

pipeline ($10.46) are higher than other

Our staff has previously reviewed the proposed Negative Declaration as referenced
above, and is in concurrence with the determination being evaluated in the subject
Negative Declaration that " LAFCO is recommending that the City of Seal Beach sphere
of influence be reaffirmed as conterminous with the City's existing jurisdictional
boundary." This position is based on our stated letter positions of August 5 and
September 8, 2005 regarding the recent Municipal Service Review process that all of the
impacted agencies participated in with LAFCO in the early part of 2005. The City
commented by letter on February 27, 2006 on the Negative Declaration matter.
The City Council has also reviewed the "Preliminary Report —. Rossmoor Future
Governance Options ", including a supporting report, "Rossmoor Governance
Alternatives: Fiscal Impacts" prepared by Burr Consulting, dated June 8, 2006. It is the
opinion of the City of Seal Beach that the Rossmoor governance documents referenced
above are unclear and too speculative for the City to rely heavily on and feels that many
of the assumptions and parameters regarding -the projection of revenues and expenditures
that would be generated by any of the above - mentioned alternative governance scenarios
is insufficient to make any type of an informed decision. Therefore, Seal Beach again
wishes to support its concurrence with LAFCO staff "that the City of Seal Beach sphere
of influence be reaffirmed as conterminous with the City's existing jurisdictional
boundary."
Mr. Lee Whittenberg, Director of Development Services, will be in attendance at the July
12 Commission meeting on this matter to present the positions stated in this letter and to
be available to respond to any questions that Commission may have.

revised to clearly indicate that the corporate boundary of the City extends 3 miles off-
shore the Pacific Ocean. It is unclear in the subject Negative Declaration if that boundary
adjustment has been made. Please ensure that the final "Sphere of Influence" map for
Seal Beach reflects this requested correction to the map.

Future Sphere of Influence Studies:
We note with interest that the City of Los Alamitos Sphere of Interest study has been
scheduled for completion in early 2006 and that this future report will "include
recommendations regarding placing Rossmoor in either the Seal Beach or Los
Alamitos Sphere of Influence." We also note that the Sunset Beach Special Study Area
will ,aga n,.be considered by your Agency as part of_ a Municipal Services Review
( "MSR'.•')` r the City of Huntington Beach be
nning in September 2005 with the
' anticipated completion in early 2006, and that Sunset Beach will be placed in a "special
SOI study area' while this MSR for Huntington Beach is being prepared. This MSR
study will "include recommendations at that time regarding placing Sunset Beach in
either the Huntington Beach or Seal Beach SOE"
It should be noted that Seal Beach indicated concurrence with the proposed SOI for Los
Alamitos under SOI 05 -31 as being coterminous with the current corporate boundaries of
Los Alamitos on August 5, 2005 in our letter to you, and continues to stand by that
determination.
We look forward to reviewing and commenting on these subsequent LAFCO reviews at
the time they are available for public comments.

adoption of the SOI for Seal Beach "as coterminous with the City's existing
jurisdictional boundary as shown on Exhibit B' with a change being made to
Exhibit B to clearly indicate that the corporate boundary of the City extends 3
miles off -shore the Pacific Ocean, as is referenced on page 4, Previous SOI
Determinations for QU ofSeal Beach of your Staff Report.
In addition, it is not clear in the Staff Report dated September 14, 2005 why the
Joint Forces Training Center in Los A iamitos is discussed under "Present and
Probable Need for Public Facilities and Services ", and also in the proposed
"Statement of Determinations" under "Present and Probable Need for Public
Facilities and Services ", as any future land use changes at the Joint Forces
Training Center will be determined by the City of Los Alamitos, and there would
not be any services provided to this property by the City of Seal Beach. The same

We had commented on August 5, 2005 that the Surfside Colony Community
Services Tax District (SOI 05 -36) and Surfside Colony Storm Water Protection
Tax District (SOI 05 -37) maps do not appear to include the Surfside Colony area
up to Anderson Street, and that these maps should be revised to indicate the
southeasterly boundary is Anderson Street. The current documents provided to
the City did not include the •SOI maps, so it uncertain if the requested map
boundary corrections have been made. . Please ensure that the district map
boundaries are correct in the final documents to be approved by LAFCO.
In addition, Figure 3b on page 5 of the " Surfside Colony Community Services
Tax District & Surfside Colony Storm Water Protection Tax District — Municipal
Service Review and Sphere of Influence Review" document includes a
photograph of a structure that is not within Surfside Colony. The pictured
structure is a residence, but is located outside of Surfside Colony. It is suggested
that another picture of residences within Surfside Colony be inserted.
With the above corrections and modifications, the City of Seal Beach supports
your proposed Categorical Exemptions and adoption of the SOI for Surfside
Colony Community Services Tax District and Surfside Colony Storm Water
Protection Tax District.
❑ Rossmoor Community Services District Sphere oflnfluence Update (SOI 05 -33) '

The City of Seal Beach supports your proposed Negative Declaration and
adoption of the SOI for Rossmoor Community Services District.. The City notes
that Rossmoor Community Services District has requested LAFCO to consider
"the expansion of Rossmoor's SOI to include the immediately adjacent area
known as Rossmoor Center ", and that LAFCO has not considered that request.
Seal Beach would not agree to any such transfer of Rossmoor Center under any
circumstances that we can identify at this time, and would categorically reject any
such effort. Any effort to reduce the revenues of the City of Seal Beach will be
vigorously fought by the City, including the initiation of litigation if the idea of
transferring Rossmoor Center is contemplated.
The City of Seal Beach supports your proposed Negative Declaration and
adoption of the SOI for Rossmoor/Los Alamitos Area Sewer District.
In addition, it is not clear in the Staff Report dated September 14, 2005 why the
Seal Beach Naval Weapons Station in Seal Beach is discussed under "Present and
