HomeMy WebLinkAboutCC AG PKT 2009-04-27 #GAGENDA STAFF REPORT DATE: April 27, 2009 TO: Honorable Mayor and City Council THRU: David Carmany, City Manager FROM: Lee Whittenberg, Director of Development Services Douglas Shur, PD Support Services Manager SUBJECT: REVISING FEES ESTABLISHED BY RESOLUTION 5783, REGARDING BUILDING PLAN CHECK AND POLICE PARKING VIOLATION FEES SUMMARY OF REQUEST: Adopt Resolution No. 5853, revising fees established by Resolution 5783, regarding Building Plan Check and Police Parking Violation Fees. BACKGROUND: Revision to Section 2: Building Fees: This proposed revision to the Fee Schedule is based on direction of the City Council at the March 23, 2009 City Council Meeting regarding a proposed policy statement to address disaster-related reconstruction assistance programs that will be provided by various City Departments. The City Council is also considering the adoption of a Council Policy regarding disaster-related reconstruction assistance programs at this Council meeting. The specific direction of the City Council was to include a provision to "waive" the "Expedited Plan Check Fee" that is currently established by Section 2.B.5.c of City Council Resolution Number 5783. The proposed revised language set forth below, and indicated in italicized and underlined text, will accomplish that direction of the City Council. Proposed Revised Language -Section 2.B.5.c: "c. Expedited Plan Check Fee - 50% of standard plan check fee. Exception: The expedited plan check fee shall be waived by the Building Official in the case of reconstruction due to a disaster- related occurrence." Agenda Item G Page 2 Revision to Section 4: Police Fees: The revisions to this portion of the Fee Schedule are based on the provisions of new State legislation, SB 1407, which authorized the issuance of up to $5 billion in lease revenue bonds by the State for the purpose of financing, planning, design, construction, rehabilitation, renovation, replacement, and leasing or acquisition of state trial court facilities. The bill also authorizes various increases to penalties and fees, to be deposited into a new account within the State Court Facilities Construction Fund, the "Immediate and Critical Needs Account." Provided below is a summary of the various surcharges applicable to parking violations: D SB 1407 -Immediate and Critical Needs Account: Gvt. Code 70372: $ 3.00 O SB 1407 -State Court Facilities Fund: Gvt. Code 70372: 1.50 Total of all SB 1407 State Parking Surcharge Fees: $ 4.50 The proposed revisions are intended to recover the total of these various parking surcharges as mandated by the State of California Government Code, and to also minimally compensate for additional accounting expenses that will be incurred in calculating the correct .distribution to the various accounts specified by the Government Code. The proposed revised fees set forth below, and indicated in # for fee amounts to be deleted, and by italicized and underlined text for fee amount to be revised, will accomplish this action. FISCAL IMPACY: Minimal impact. No other changes to fees currently in effect are proposed.
