HomeMy WebLinkAboutPC Res 99-43 - 1999-11-17 RESOLUTION NO. 99-43 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 99-9, PERMITTING THE INSTALLATION OF 36,000 SQUARE FEET OF TEMPORARY, MODULAR OFFICE SPACE AT THE BOEING FACILITY LOCATED AT 2700 WESTMINSTER AVE. THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section I On October II, 1999, Victor Gutierrz, on behalf of Boeing ("The Applicant") submitted an application for Minor Plan Review 99-9 with the Department of Development Services The applicant seeks to install 36,000 square feet of temporary, modular office space next to buildings 85, 86, and the Heliport, approximately 500 feet south of Westminster Blvd. Section 2 Pursuant to 14 Calif Code of Regs ~ 15025(a) and ~ IT A of the City's Local CEQA Guidelines, staff has determined as follows: The application for Minor Plan Review No. 99-9 has been reviewed through Mitigated Negative Declaration 99-2 and has been found to have less than significant impacts when mitigation measures are imposed Section 3 A duly noticed hearing was held before the Planning Commission on November 17, 1999 to consider Minor Plan Review 99-9 Section 4 The record of the hearing indicates the following. (a) On October 11, 1999, Victor Gutierrez submitted an application for Minor Plan Review 99-9. (b) Specifically, the applicant is seeking to install 36,000 square feet of temporary, modular office space while a remodel of the existing facility is underway. (c) The subject property is legally described as Orange County Assessor's Parcel Number 095-010-54 and is located in the Light Manufacturing (M-I) zone (d) The subject property is triangular in shape and has approximately 104 acres. (e) The subject property is bordered on the North by residential housing in a Residential High Density (RHO) zone, to the East by a commercial center in a general commercial (C-2) zone and the Naval Weapons Station in a Public Land Use (pLU/R) zone, to the West by a portion of the Hellman Ranch Property and a residential community in Long Beach known as "Island village"; and to the South, the subject property is bordered by the Police Station in a Public Land Use (pLU/R) zone and the Hellman Ranch Property located in a Specific Plan (SPR) zone. (t) Staff has received no responses, written or other, to its mailed notice regarding Minor Plan Review 99-9 Section 5 Based upon the evidence in the record, including the facts stated in ~ 4 of this resolution and pursuant to ~ 28-2320 of the City's Code, the Planning Commission hereby finds as follows. (a) Minor Plan Review 99-9 is consistent with the provisions of the Land Use Element of the City's General Plan, which provides a "Light Manufacturing" designation for the subject property and permits office and industrial uses The use is also consistent with the remaining elements of the City's General Plan as the policies of those elements are consistent with, and reflected in, the Land Use Element. Accordingly, the proposed use is consistent with the General Plan Planmng CommISSIOn ResolutIon No 99-43 Minor Plan RevIew 99-9 Boeing Space and CommumcatlOns DIVISIon Temporary Office Project November 17,1999 Section 6 Based on the foregoing, the Planning Commission hereby approves Minor Plan Review 99-9, subject to the following conditions: I. Minor Plan Review 99-9 is approved for the construction of 36,000 square feet of temporary office space to be located next to Buildings 85, 86, and the Heliport, approximately 500 feet northwest of Seal Beach Blvd. 2 All construction shall be in substantial compliance with the plans approved through MPR 99-9 and Negative Declaration 99-2 3. Minor Plan Review 99-9 is effective for 1 year from the issuance of the Building Permits. 4. The Applicant shall comply with the provisions of Section 28-2320 (e)(3) regarding cash deposits to guarantee removal of the temporary structures prior to the issuance of a building permit. 5. This Minor Plan Review shall not become effective for any purpose unless an "Acceptance of Conditions" form has been signed by the applicant in the presence of the Director of Development Services, or notarized and retumed to the Planning Department; and until the ten (10) day appeal period has elapsed PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 17t11 day of November, ) 999, by the following vote' J\YES' Commis~oners Brown, Cutuli, Hood, Larson, and Lyon NOES' Commissioners None ABSENT: Commissioners None David Hood, Ph D , Chairman Planning Commis~on , ee WhittenBerg, Secretary Planning Commission Page 2
