Home My WebLink AboutPC Res 99-39 - 1999-10-20 RESOLUTION NO 99 - 39 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL ADOPTION OF NEGATIVE DECLARATION 99- I, AND RECOMMENDING A DETERMINATION OF CONSISTENCY WITH THE CIRCULATION ELEMENT OF THE GENERAL PLAN FOR THE PROPOSED SEAL BEACH BOULEV ARD/I-405 OVERCROSSING WIDENING PROJECT THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE' WHEREAS, the Cahfornia Government Code includes certain proviSIOns regarding the content of the "Circulation Element" of the General Plan, and WHEREAS, the City has prepared a P/'oj1o,\'ed bu/wl Sludy and NeKallve DeclaratIOn 99- 1, Seal Beach Boulev",d/1--I05 Ovelc/'OS\/IIK Wldelllng Project The proposed project will improve local transportallon system capacity at the project location, and reduce the level of service (LOS) from an existing (I997) worst LOS "E" in the PM peak hour to LOS "B", and a projected future (2020) worst LOS "F" in the P M peak hour to LOS "D" These transportation Improvements will result in overall reductions in local air quality impacts within the community be allowing traffic to flow more freely Wlthm the project area, thereby reducing local CO and other air quality impacts, and WHEREAS, staff has prepared and circulated an Imtlal EnVironmental Assessment and proposed Mitigated Negal1ve Declaral10n as required by the California Environmental Quahty Act (CEQA) The comment penod on Negative Declaration 99-1 ended on August 23, 1999 As of September 9, 1999, The City has received responses on the proposed Negative Declaration from o Governor's Office of Planning and Research, State Clearinghouse, August 23, 1999 o Caldwell, Leslie, Newcombe & Pettit, August 23, 1999 o Department of the Navy, Naval Weapons Station Seal Beach, August 23, 1999 o Department of Transportallon, District 12, Environmental Planning, AU/:,'lIst 24, 1999 o Southern Cahfornia Association of Governments, August 10, 1999 o County of Orange, Planning and Development Services Department, AU/:,'lIst 23, 1999 o Orange County Fire Authonty, August 26, 1999 o Southern Cahforma Gas Company, August 7, 1999 o Cahfornla Department of Trans pOi tat ion, Distnct 12, September 9, 1999, and WHEREAS, the City's consultant, Roben Bem, Wilham Frost & ASSOCiates, has prepared a "Comments and Re~ponses" document to all of the above-received comments on Negatlye Dec1alatlon 99-1 A copy of that document was provided for the information of the Planning Commission, and C \My Documenls\RESO\Ncg u~ 99-1, SSB O\'cIlJ.I.... PC RC'-ll doc\LW\IO.20.91J Plan/I/I/g ('01/1III/S.<101/ Re.olutlOn No 99-39 Negallve Dee/arallOn 99-) Seal Beach BoulevartV}../05 Overpass Wldenmg October 20, 1999 WHEREAS, a duly noticed public hearing was held by the Planning Commission on October 20, 1999 to consider Negative Declaration 99-1 and the consistency with the CIrculation Element of the General Plan of the Seal Beach BoulevardlI-405 OYerpass Widening Project, and WHEREAS, the Planning CommIssion received into eVidence the Staff Report of October 20, 1999, along with all attachments thereto, including the Staff Report, Minutes and Memorandum of the Environmental Quality Control Board dated September 29, 1999, and considered all public testimony presented; and WHEREAS, The Planning Commission made the following findings and recommended adoption of Negative Declaration 99-1 by the City Council and determined the proposed project IS consistent with the CirculatIOn Element of the General Plan The proposed Negative Declaration adequately discloses the potential environmental impacts of the proposed Seal Beach Boulevardll-405 Overpass Widening Project, and no substantial adyerse environmental impacts will result upon the approval of the subject project, with the mItigation measures set froth in the Mitigated Negative Declaration 2 The proposed project IS consistent with the Circulation Element of the City of Seal Beach General Plan The adopted "Circulation Element - Streets and Highways of the General Plan" map was adopted by Planning CommiSSIOn Resolution No 886 on January 15, 1975, and by City Council Resolution No 2394 on January 27, 1975 This map indicates Seal Beach Boulevard from Pacific Coast Highway to the nOltherly City boundary at Bradbury Road to be a "Major- 120' nght-of-way" ThiS roadway designation is consistent with the proposed over pass widening project In that the overpass will be widened to a total nght-of-way width of 122 feet, Including 3 through traffic lanes In each direction, median, sidewalks, and bike lanes 3 The proposed ploJect IS also consIstent with the language of the Circulation Element of the City of Seal Beach General Plan, winch Indicates wIt/un the "Capital Improvements Program" provIsion for "Seal Beach Boulevard - San Diego Freeway interchange improvement" This ploject will fulfill that goal within the Capital Improvement Program section of the Circulation Element 4 The proposed plOJect IS also included withm the CIty of Seal Beach adopted 7-Year Capital Improyement Program and within the adopted Southern Cahfornla Association of Goyernment's (SCAG) 1998-2005 Regional TransportatIOn Improvement Program (RTIP), and WHEREAS, in compliance with CEQA and local CEQA gUIdelines, staff has prepared the required "Comments and Responses on Negative Declaration No 99-1 ", prepared by Robert Beln, William Frost & ASSOCiates, dated October 11, 1999, Including aliI esponses received by the City to September 9, 1999, for consideration by the City Council on October 25, 1999 NOW, THEREFORE BE IT RESOLVED, that the Planning Commission hereby recommends that the City Council Neg Dee 99-1, 8SB Ovcrpl"".
