THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: SectIOn 1. On June 7, 2006, TIm Deeds ("The Applicant") submitted an apphcatlOn for HeIght Vanallon 06-2 with the Department of Development Services. The apphcant IS proposmg to construct a covered roof access structure (CRAS) leadmg to a roof deck m excess of the height lImIt m conjunctIOn with the constructIOn ofa new smgle farrllly reSIdence at C-25 South PaCIfic Section 2 Pursuant to 14 CalIf. Code of Regs. ~ 15025(a) and * IT A of the CIty's Local CEQA GUldelmes, staff has determmed as follows: The applIcatIOn for HeIght Vanallon No 06-2 IS eategoncally exempt from review pursuant to the CalIfornIa EnVIronmental QualIty Act pursuant to 14 Cahf. Code of Regs * 15303(a) (New ConstructIOn of Small Structures), because the apphcatlOn IS for the constructIon of three (3) or less smgle family dwellIngs m an urbaruzed area, ~ 15305 (Mmor AlteratIons m Land Use LImitatIOns) because the request IS for a mmor alterallon m land use lImItatIOns m an area With an average slope of less than 20% and no changes m land use or denSIty are mvolved, and, pursuant to ~ 15061(b)(3), because It can be seen With certamty that there IS no POSSlblhty that the approval may have a slgmficant effect on the environment. Secl10n 3 A duly nOllced pubhc hearing was held before the Planning CommIssIOn on August 9,2006 to conSIder Height Vanallon 06-2 Section 4 The record of the heanng mdlcates the followmg: (a) On June 7, 2006, Tim Deeds submitted an applIcatIOn for Height VanatlOn 06-2 (b) The applicant IS requestmg to construct a CRAS in conjunctIon WIth a new single-family dwellIng located at C-25 South Pacific. (c) The subject property IS descnbed as Orange County Assessor's Parcel Number 178-461-20 and IS located within Surf sIde Colony. (e) The surroundmg land uses and zoning are as follows: NORTH Seal Beach Naval Weapons Station and the Pacific Coast HIghway beyond. SOUTH Smgle-family dwellIngs m the Residential Low Density zone (RLD) of Surf side Colony, PacIfic Ocean and the beach m a Pubhc Land UselRecreal10n zone (PLU/R). EAST Smgle-family dwellings located m the ResIdentIal Low Dcnslty zone (RLD) of Surfs ide Colony WEST Smgle-family dwellIngs located in the Resldenl1al Low DensIty zone (RLD) of Surf sIde Colony (f) As of July 25, 2006 staff has received no responscs, wntten or other, to ItS mailed nol1ce regardmg Height Vanal10n 06-2 Section 5. Based upon the eVIdence in the record, mcludmg the facts stated m ~ 4 of thIs resolution and pursuant to * 28-2317(4) of the CIty'S Code, the Plannmg CornmlsslOn hereby finds as follows: (a) HeIght Vanation 06-2 IS consIstent with the provlSIons of the Land Use Element of the City's General Plan, which prOVIdes a "low densIty residential" desIgnation for the subject property and permIts single-family resIdential uses. The use IS also consIstent wIth the remammg elements of the CIty'S General Plan as the polICIes of those elements are consIstent wIth, and reflected m, the Land Use Element. Accordmgly, the proposed use IS consIstent wIth the General Plan. (b) The proposed covered roof access structure feature IS archItecturally m keepmg with the remamder of the structure, with the roofing matenals and sldmg matchmg those of the other portIOns of the bUIlding. (c ) The proposed covered roof access structure IS appropnate for the character and mtegnty of the surroundmg neighborhood and is permlsslblc by code (d) No habItable IIvmg space IS provided wlthm the structure (e) Due to the relatIvely flat terram in the vlcmlty of the proposed structure, It does not SignIficantly Impair the pnmary view of any property located wlthm 300 feet of the subject property Page 2 Planmng COmml>51On ResoflltlOn No 05-36 HeIght VariatIOn 05-2,8-/06 Surfs/de Augu51 9, 2005 SectIon 6. Based on the foregoing, the Plannmg CommIssion hereby approves HeIght Vanatlon 06-2, subJect to the followmg condItIons I HeIght VariatIOn 06-2 IS approved for the construction of a covered roof access structure (CRAS) m excess of the height lImIt m conjunctIOn WIth the construction of new a smgle famIly dwellmg at C-25 South PacIfic, Scal Beach. 2 All constructIon shaH be in substanl1al complIance WIth the plans approved through HV 06-2 3 There shall be no habItable space permitted within the covered roof access structure 4. ThIS HeIght Variation shall not become effective for any purpose unless an "Acceptance of CondItIOns" form has been SIgned by the apphcant m the presence of the Director of Development ServIces, or notanzed and returned to the Plannmg DeparlInent; and untIl the ten (10) day appeal penod has elapsed PASSED, APPROVED AND ADOPTED by the PlannIng CommIssIon of the CIty of Seal Beach at a meetmg thereof held on the 9th day of August 2006 by the following vote: AYES, CommIssIoners Deaton, Bello, and O'Malley NOES CommIssIoners None ABSENT CommissIoners Roberts ABSTAIN.
