HomeMy WebLinkAboutPC Res 06-38 - 2006-08-09 RESOLUTION NUMBER 06-38 0-9/6';, /1/4( A RESOLUTiON OF THE PLANNING COMMISSION OF THE CiTY OF SEAL BEACH APPROVING MINOR PLAN REViEW 06-9, APPROViNG A 34-INCH HiGH BBQ AND COUNTER STRUCTURE IN THE REAR YARD SETBACK AREA AT 948 BLUE HERON, SEAL BEACH THE PLANNING COMMiSSiON OF THE CiTY OF SEAL BEACH DOES HEREBY FiND AND RESOLVE: Section 1. On June 30, 2006, Beth and Joe Chen ("The ApplIcants") filed an applIcation for Mmor Plan ReView 06-9 with the Department of Development Services Through MPR 06-9, the applicant sought to construct a 34-mch hIgh BBQ and counter structure m the 15 feet rear setback area at 948 Blue Heron, Seal Beach. Section 2. Pursuant to 14 Cahf Code of Regs * 15025(a) and ~ n.B of the City's Local CEQA GUldehnes, staff has determmed as follows: The applIcatIOn for Mmor Plan ReVIew 06-9 IS categoncally exempt from review pursuant to the Cahfornla EnVironmental QualIty Act pursuant to 14 Calif Code of Regs * 15303 NEW CONSTRUCTION OR CONVERSiON OF SMALL STRUCTURES (a) single-family reSidences not m conJunction wIth the bUlldmg of two or more such umts. in urbanIzed areas, up to tluee smgle-famlly reSIdences may be constructed or converted under thIs exemptIon. * l5061(b)(3), because It can be seen wIth certainty that there IS no pOSSibilIty that the approval may have a SignIficant effect on the envIronment. Section 3. A duly notIced hearmg was held before the PlannIng COITIlTIlSSlOn on August 9,2006 to conSider the applIcatIon for Mmor Plan Review 06-9. SectIon 4, The record of the heanng on August 9, 2006 indIcates the following' (a) On June 30, 2006, Beth and Joe Chen ("The ApplIcants") filed an apphcahon for Mmor Plan ReView 06-9 With the Department of Development ServIces (b) SpeCifically, the request IS to construct a 34-mch high BBQ and counter structure m the 15 feet rear setback area. SectIOn 5. Based upon the facts contamed in the record, includIng those stated m * 4 of thIs resolutIOn, and pursuant to * 28-401 of the City's Code, the Planmng CommissIOn hereby finds as follows (a) Mmor Plan RevIew 06-9, as conditIOned, IS consIstent wIth the prOVISIOns of the Land Use Element of the City's General Plan, whIch provides a "ResIdentIal Low Density" designatIOn for the subJect property and permits the proposed development, subJect to approval of a Mmor Plan Review, The use IS also consistent with the remammg elements of the CIty's General Plan as the polIcies of those elements are consIstent with, and reflected m, the Land Use Element. Accordmgly, the proposed use IS consistent With the General Plan (b) The proposed development, as conditioned, compiles with all development standards of the Specific Plan (SPR) zone (c) The BBQ and counter structure, as condltloned, IS appropnate to the surroundmg neighborhood as the structure is an adequate distance from adJacent reSidences. Section 6, Based upon the foregoing, the Plannmg CommIssion hereby approves Mmor Plan Review 06-9, subject to the followmg conditions' Mmor Plan RevIew 06-9 is approved for a 34 inch high BBQ and counter structure located at 948 Blue Heron, Seal Beach, to be located 3 feet from the eXlstmg 6 feet hIgh fence on the rear property Ime, where the Code reqUIres a 15 feet setback. 2 All constructIOn shall be m substantial comphance With the plans approved through Mmor Plan Review 06-9. 3.
