HomeMy WebLinkAboutPC Res 99-24 - 1999-08-04 RESOLUTION NUMBER 99-24 0-9,t& ~<' A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL DENIAL OF ZONING TEXT AMENDMENT 99-2, AMENDING SECTION 28-401; 28-701; and 28-28-801 TO REDUCE THE SIDE YARD SETBACKS ON SIDE YARDS THAT ABUT STREETS IN THE RLD, RMD, AND RHD ZONES TO 10% OF THE LOT WIDTH. THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE. Section 1. At Its meetmg of August 4, 1999, the Planning CommiSSIOn considered ZOnIng Text Amendment 99-2. ThIs amendment would reduce the reqUIred the SIde yard setbacks m the RLD, RMD, and RHD zones from 15% to 10% of the lot WIdth. Section 2. Pursuant to 14 CalIf. Code of Regs ~ 15305 and ~ II.B of the City's Local CEQA Guidelmes, staff has determmed as follows: The application for ZOning Text Amendment 99-2 IS categoncally exempt from reView pursuant to the Callforma EnVironmental Quality Act pursuant to 14 CalIf. Code of Regs ~ 15305 (Mmor Alterations m Land Use Limitations), because It consIsts ofmmor alterations m land use limitations In averagc slope of less than 20% and does not result m any changes m land use or denSity, and, pursuant to ~ 15061(b)(3), because It can be seen With certamty that there IS no pOSSIbility that the approval may have a Significant effect on the envIronment Section 3. A duly notIced public hearing was held by the Planning Commission on August 4, 1999 to conSider Zone Text Amendment 99-2. Section 4. The record of the hearmg of August 4, 1999 mdlcates the following (a) At said public hearing there was oral and wntten testimony and eVidence received by the Planning Commission. (b) The proposed text amendment wIll revise the City's zOning ordmance and enhance the abilIty of the City to ensure orderly and planned development m the City through an amendment of the ZOnIng requirements. (c) The proposed text amendment will requIre that Side yard setbacks m yards that abut streets m the RLD, RMD, and RHD zones be mamtamed at 10% of the lot WIdth. SectIOn 5. Based upon the facts contamed m the record, mcludmg those stated m ~4 of this resolution and pursuant to ~~ 28-2600 of the City's Code, the PlannIng Commission makes the followmg findmgs. (a) Zoning Text Amendment 99-2 is consistent with the prOVISions of the vanous elements of the City's General Plan. Accordmgly, the proposed use IS consIstent With the General Plan The proposed amendment is admmlstratIve m nature and will not result m changes mconslstent With the eXlstmg provlSlons ofthe General Plan. (b) The proposed text amendment will revise the City'S zoning ordinance and enhance the ability of the City to ensure orderly and planned development m the City through an amendment of the zOning reqUIrements. (c) The proposed text amendment would reduce the viSibility along the stub street entrances to the beach in a negative manner that WIll Impact grcatly the ability of the general public to enJoy Seal Beach's greatest asset, the beachfront. Augwt4, /999 (e) The proposed text amendment would be the eqUivalent to granting a special priVilege to homeowners along the Gold Coast by Virtue of their bemg able to bUild closer to a side property lme than other Similarly situated corner properties throughout the City and the City wishes to keep umform setback standards on comer properties regardless of circumstance Section 6. Bascd upon the foregoing, the Planning Commission hereby recommends denial of Zoning Text Amendment 99-2 to the City COunCIl.
