RESOLUTION NO. 99-23 01>~ G~ ~< A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 99-6, PERMITTING A 215.5 SQUARE FOOT ADDITION TO A NONCONFORMING MULTI-FAMILY DWELLING AT 1100 OCEAN AVENUE, SEAL BEACH. SPECIFICALLY, 69.5 SQUARE FEET WllL BE ADDED TO UNIT A, AND 144 SQUARE FEET Wll.L BE ADDED TO UNIT B. THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: ' Section 1. On June 29tlo, 1999, AI Higgenbotham ("The Applicant") submitted an application for Minor Plan Review 99-7 with the Department of Development Services The applicant sought to add a new bathroom and balcony at a nonconforming multi-family building located at 1100 Ocean Avenue, Seal Beach. . Section 2. Pursuant to 14 Calif. Code of Regs. ~ 15025(a) and ~ II A of the City's Local CEQA Guidelines, staffhas determined as follows: The application for Minor Plan Review No. 99-7 & Conditional Use Permit 99-8 is categorically exempt from review pursuant to the California Enviromnental Quality Act pursuant to 14 Calif Code of Regs ~ 15301(e) (Existing Facilities), because it involves an addition to an existing residential structure which increases the floor area by less than 50% and is less than 2,500 square feet in area; and, pursuant to ~ 15061(b)(3), because it qan be seen with certainty that there is no possibility that the approval may have a significant effect on the enviromnent. Section 3 A duly noticed hearing was held before the Planning Commission on August 18, 1999 to consider Minor Plan Review 99-6 Section 4. The record of the hearing indicates the following. On June 2g'h, 1999, AI Higginbotham submitted an application for (a) Minor Plan Review 99-6 (b) Specifically, the applicant is seeking to add a new bathroom and Balcony at a nonconforming multi-family property located at 1100 Ocean Avenue, Seal Beach The subject property is nonco,nforming due to inadequate parking and density (c) ,The subject property is legally described as Orange County Assessor's Parcel Number 19~-071-18 and is located in the Residential High Density zone of Old Town (d) The subject property is rectangular in shape with a lot area of3,635 square feet. NORTH & EAST (e) The surrounding land uses and zoning are as follows. A mixture of single family and multi-family residential uses in the Residential High Density zone (RHD). WEST Residential Housing in a Residential High Density Zone (RHD) and a commercial area located on Main Street, located in the Main Street . Specific, Plan (MSSP) Zone. SOUTH Multi-family residential uses in a Residential High Density (RHO) Zone and the municipal beach and Pacific Ocean in the Public Land Use / Recreation zone (pLU/R). , . Plannmg ct,sslOn ResolutIOn No 99-23 (f) Staffhas received no responses, written or other, to its mailed notice regarding Minor Plan Review 99-6. Section 5. Based upon the evidence in the record, including the facts stated in ~ 4 of this resolution and pursuant to ~ 28-2407 of the City's~, the Planning Commission hereby finds as follows: I (a) Minor Plan Review 99-6 is consistent with the provisions of the Land Use Element of the City's General Plan, which provides a "high density residential" designation for the subject property and permits single- and multi-family residential uses. The use is also consistent with the remaining elements of the City's General Plan as the policies of those elements are consistent with, and reflected in, the Land Use Element. Accordingly, the proposed use is consistent with the General Plan. Section 6. Based on the foregoing, the Planning Commission hereby approves Minor Plan Review 99-6, subject to the following conditions 1. Minor Plan Review 99-6 is approved for the addition of a 69.5 square foot bathroom, and a new 144 square foot balcony to a nonconforming multi-family building at 1100 Ocean Avenue, Seal Beach. 2. All construction shall be in substantial compliance with the plans approved through MPR 99- 6. ' 3 The following repairs shall be completed in conjunction with this approval a. Apartments A, B, & C will change their kitchen electrical outlets within 6 feet of the sink to be on a ground fault. b Apartment C will add a smoke detector in the bedroom. c. Any and all holes in the garage ceiling must be repaired and fixed to the satisfaction of the Sr. Building Inspector. d. The Flex vent line in the laundry room must be replaced with a metal vent e. AU electrical meters must be replaced with 100 amp services. This will total four (4) 100 amp services. f. A new service drop must be installed to the roof to the satisfaction of the Senior Building Inspector. 4. This Minor Plan Review s,hall not become effective for any purpose unless an "Acceptance of Conditions" form has been signed by the applicant in the presence of the Director of Development Services, or notarized and returned to the Planning Department, and until the ten (10) day appeal period has elapsed I PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 18th Day of August, 1999, by the following vote AYES: Commissioners Cutuli.
