Mr. Bill Orten, 85 Riversea Road, urged support for AB566, legislation I that would allow special districts, like the library systems, to - seek support from the electorate, and suggested that Assemblywoman Allen be encouraged to do likewise. There being no further communications, Mayor Forsythe declared Oral Communications closed. CLOSED SESSION No Closed Session was held. ADJOURNMENT It was the order of the Chair, with consent of the Council, to adjourn until Monday, July 12th at 6:00 p.m. to meet in Closed Session. ", ~'''' ... 7-12-93 , ROLL CALL Present: Mayor Forsythe Councilmembers Brown, Doane, Hastings, Laszlo None Absent: Also present: Mr. Barrow, City Attorney Mr. Whittenberg, Director of Development Services Mr. Jue, Contract city Engineer/Director of Public Works Mrs. Yeo, City Clerk Members of the Council welcomed the return of Mr. Laszlo to his Council position, and Councilman Laszlo expressed appreciation to those who had communicated best wishes. WAIVER OF FULL READING Brown moved, second by Hastings, to waive the reading in full of all ordinances and resolutions and that consent to the waiver of reading shall be deemed to be given by all Councilmembers after reading of the title unless specific request is made at that time for the reading of such ordinance or resolution. AYES: NOES: Brown, Doane! Forsythe, Hastings, Laszlo None Motion carried ORAL COMMUNICATIONS Mayor Forsythe declared Oral Communications open. Mr. Jay Covington, Garden Grove, former Seal Beach resident, extended appreciation to the City Manager for having resolved an on-going problem relating to the payment of the local utility users tax on his telephone bill. Mr. Covington said his presence was as an individual, representing no other, and presented a conceptual proposal for the acquisition of the Old Ranch Golf Course, the funds to acquire same derived from a bond issu~ secured by the property and the voluntary assumption of the balance by those property owners willing to participate from Seal Beach and the surrounding communities of Rossmoor, Los Alamitos and Garden Grove. He stated the purpose of the proposal was to assure the continued use of the property, in perpetuity, for open space, golf, recreation and other public uses; the parameters of such acquisition would be an assurance of no liability or final cost to Seal Beach and/or its property owners, except as voluntarily assumed, the purchase price to be raised by bond issue, secured by both the course and properties that are individually obligated, perpetual covenants placed on the property to assure continued use consistent with past and present operations, and a charter requirement for the operating agency to expand and permit pUblic use wherever possible. He said the benefits of such actions would resolve the on-going conflict between the current owners and public regarding future use of this property, would retain the property tax values on 20,000 homes surrounding the property and increase future sales tax and user fees to the City, and additional future public recreational facilities would be possible. He requested that if the proposal is felt to have some merit that it be passed on to the City Manager for review and consideration. Mr. Covington stated his belief that there is existing precedent whereby individual property owners have the right to obligate their property to make such an acquisition for continued public use, in turn creating some degree of equity based upon various membership levels. Given the current proposal of Bixby to develop their land, a concern was expressed that such proposal might be perceived as a barrier to their development. The City Attorney noted that the environmental documents for the Bixby proposal are being prepared and will be forthcoming in the near future, and agreed that the City would not"want to take any 7-12-93 action that could be perceived as an obstacle to development of the property, and explained that agreement would be necessary . between the interested residents and owners of the golf course 1f the conceptual proposal were to be considered, to which the city would not be a party to such negotiation. Seal Beach resident Sol John mentioned the greater value of residential properties I with the golf course, reported that his vehicles are now licensed for street use, noted a recent news article that featured -. himself, stated 'his desire to place a roller coaster, ferris wheel and merry-go-round on the beach, and spoke for more police officers. Ms. Susan Early, Corona del Mar, spoke at length regarding crimes she alleged have been committed against her by national and international public figures to ensure that her invention of a fraud proof home telephone voting system would not be made available to the public. She asked that the council obtain a copy of a video that had been made of her, distributed worldwide to discredit her, and offered to share $2 million dollars of her claim for damages of $500 million if the City will assist her in that legal action or $150 million of her legal action against the medical community for studies conducted on her. There being no further comments, Mayor Forsythe declared Oral Communications closed. PRESENTATION RESOLUTION NUMBER 4244 - RECOGNIZING RUBY SWEENEY Resolution Number 4244 was presented to Council and read in full by Mayor Forsythe entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, RECOGNIZING AND HONORING SEAL BEACH RESIDENT RUBY SWEENEY" for her safe driving record over more than eighty years and thousands of hours of volunteer work. Brown moved, second by Forsythe, to adopt Resolution Number 4244. The Mayor presented a copy of the Resolution to Ms. Sweeney who graciously accepted with appreciation. I' AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried COUNCIL ITEMS APPOINTMENTS - BOARDS/COMMISSIONS Environmental Oualitv Control Board Councilmember Hastings requested that the District One appointment to the Environmental Quality Control Board be held over until the first meeting in September. Parks and Recreation Commission / Proiect Area Committee The District One appointments to the Parks and Recreation Commission and Project Area Committee were held over until next meeting. Golf Courses Councilman Laszlo announced that the Environmental Quality Control Board will be considering the Aviation Report relating to the Bixby Ranch property proposal at their meeting of July 20th. I CONSENT CALENDAR - ITEMS "0" thru "G" Brown moved, second by Hastings, to approve the recommended action for items on the Consent Calendar as presented. D. Approved the minutes of the regular City Council meeting of June 28, 1993. E. Accepted the resignation of Ms. Edith Wolff as a District Five appointee to the I I I 7-12-93 Archaeological Advisory Committee, and declared the position vacant. F. Received and filed the Annual Financial statement for fiscal year 1991/92 for the city of Seal Beach single Audit of Federally Assisted Grant Programs. Authorized staff to proceed with notification to the County of Orange that the City of Seal Beach will not participate in the Teeter Plan for property tax allocation. G. AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried PUBLIC HEARING - STREET LIGHTING ASSESSMENT DISTRICT - 1993/94 Mayor Forsythe declared the public hearing open to consider Street Lighting Assessment District No. 1 for fiscal year 1993/94. The city Clerk certified that notice of the public hearing had been advertised as required by law, and reported no communications received either for or against this item. The City Engineer presented the staff report relating to consideration of the Street Lighting District that was initially enacted in 1988, and noted that the assessments for 1993/94 are unchanged from those of 1992/93, the total of which is approximately $140,000. In response to a question of Council, he explained that the basic unit of assessment is a single family dwelling, multi-units are assessed a one-half unit per living unit up to twenty units after which another formula is applied. There being no public comments, Mayor Forsythe declared the public hearing closed. RESOLUTION NUMBER 4245 - STREET LIGHTING ASSESSMENT DISTRICT - 1993/94 Resolution Number 4245 was presented to Council entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH CONFIRMING THE DIAGRAM AND ASSESSMENTS AND LEVYING ASSESSMENTS FOR STREET LIGHTING DISTRICT NO.1 FOR FISCAL YEAR 1993/94." By unanimous consent, full reading of Resolution Number 4245 was waived. Hastings moved, second by Laszlo, to adopt Resolution Number 4245 as presented. AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried PUBLIC HEARING - DEVELOPMENT AGREEMENT - BJ's CHICAGO PIZZERIA Mayor Forsythe declared the public hearing open to consider a Development Agreement for Conditional Use Permit 92-23, BJ's Chicago Pizzeria. The City Clerk certified that notice of the public hearing had been advertised as required by law, and reported no communications received for or against this item. Hastings moved, second by Brown, to continue the public hearing until the July 26, 1993 regular meeting. AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried ORDINANCE NUMBER 1371 - MUNICIPAL CODE VIOLATIONS/PENALTIES Ordinance Number 1371 was presented to Council entitled "AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, AMENDING CHAPTER 1 OF THE CODE OF THE CITY OF SEAL BEACH RELATING TO VIOLATIONS AND PENALTIES." Staff explained that the proposed amendment will allow greater flexibility in determining the type of violation for certain provisions of the Municipal Code, where most are now misdemeanors, the Council could designate certain provisions as infractions which, in most cases, would allow for a more timely 7-12-93 resolution of violations. In response to Council, the City Attorney offered to provide examples of typical violations where an infraction would apply prior to second reading of the Ordinance. Hastings moved, second by Forsythe, to approve the introduction of Ordinance Number 1371 and that it be passed to second reading. AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried I COUNCIL CONCERNS councilmember Hastings made reference to and quoted from a recent news article profiling Seal Beach resident, Sol John. Councilman Laszlo mentioned the efforts of a local resident in assisting him in developing a campaign reform proposal. Councilman Brown mentioned that the new market in the Leisure World Center is progressing, and noted that a meeting is scheduled with Leisure World residents to describe the upcoming operation of the market. ORAL COMMUNICATIONS Mayor Forsythe declared Oral Communications open. Mr. James Goodwin, 1405 Crestview Avenue, expressed pleasure with the understanding that the Council has agreed to consider local campaign reform regulations. To Mr. Bill Orton, 85 Riversea Road, Councilman Laszlo inquired why he once referred to himself as Mr. Orszewsky and why he changed his name. Councilman Laszlo noted his understanding that Mr. Orton is working towards seeking the District Three Council seat in 1994, mentioned his employment is with a Democratic Assemblywoman in the area, and objected to Mr. Orton interrupting members of the Council at the last meeting. Mr. Orton replied with an explanation of his family ,- _ having changed their name in 1948, orton being his legal name, Orszewsky his pen name. Mr. Orton said he had provided the members of the Council with a letter at their Council seats relating to his review of the budget. He commended Mr. Laszlo for his leadership towards campaign reform and Mr. Goodwin for his thorough research of the matter. There being no further comments, Mayor Forsythe declared Oral Communications closed. CLOSED SESSION No Closed Session was held.
