RESOLUTION NO. 01-19
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING CONDITIONAL USE
PERMIT 00-5 (INDEFINITE EXTENSION), PERMITTING THE
PROPERTY LOCATED AT 101 MAIN ST. TO CONTINUE TO
OPERATE A PRIVATE PARKING LOT WITHIN THE MAIN
ST. SPECIFIC PLAN AREA.
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
Section 1. On March 2911',2001, Jim Watson ("The Applicant") submitted an
application for Conditional Use Permit 00-5 (Indefmite Extension) with the Department of
Developmcnt Scrviccs. The applicant sought to indefinitely extend a previously approved CUP
to operate a private parking lot on the property located at 101 Main St.
Section 2. Pursuant to 14 Calif. Code of Regs. ~ 15025(a) and ~ ILA of the
City's Local CEQA Guidelines, staff has detennined as follows: The application for Conditional
Use Permit 00-5 (Indefinite Extension) is categorically exempt from review pursuant
~ 15061(b)(3), because it can be seen with certainty that there is no possibility that the approval
may have a significant effect on the environment.
Section 3. A duly noticed hearing was held before the Planning Commission
on April 18th, 2001 to consider Conditional Use Pennit 00-5 (Indefinitc Extcnsion)
Scetion 4.
The record ofthe hearing indicates the following:
(a) On March 29th, 2001, Jim Watson submitted an application for
Conditional Use Permit 00-5 (indefinite Extension).
(b) Specifically, the applicant is seeking to indefinite extend a
previously approved CUP to operate a private parking lot on the weekcnd at the property located
at 101 Main St.
(c) Thc subject property is described as Orange County Assessor's
Parcel Number 199-034-17 and is loeated Main Street Specific Plan zonc of Old Town.
(d) The subject property is rectangular in shape with a lot arca of
11,000 square feet.
(c) The surrounding land uses and zoning are as follows:
North
Retail businesses along Main St. within thc Main Street Specific Plan
Zone
South
East
Pacific Ocean in a Public Land Use/Recreation (PLU/R) zone
Rctail businesses within the Main St. Specific Plan zone and residential
housing in a Residential High Density (RHD) zonc
West
Residential housing a High density (RHD) zone and residential housing
in a low density (RLD) zonc
(1) StafThas received one written response, but no oral, to its mailed
notice regarding Conditional Use Permit 00-5 (indefinite Extension).
Section 5. Bascd upon the evidence in the record, including the facts stated in
~ 4 of this resolution and pursuant to ~ 28-1250 of the City's Code, the Planning Commission
hereby finds as follows:
. Conditional Usc Pcnnit 00-5 (Indefinite Extension) is consistent with the provisions of thc
Land Use Elemcnt ofthc City's General Plan, which provides a "Main Street Specific Plan"
zoning designation for the subject property and pennits private parking lots subject to the
issuance of a conditional use pennit. The use is also consistent with the remaining clements
of the City's General Plan, as the policies of those clemcnts arc consistent with, and reflected
in, the Land Use Element. Accordingly, the proposed use is eonsistent with the General Plan.
. Thc proposcd parking lot is consistent with surrounding residential and commercial uses, in
that all land uses generate parking demand and the extra parking being utilized for
commercial and beach parking will help alleviate some of the problems with parking that the
area encounters.
. The building and propel1y at 101 Main St. are adequate in size, shape, topography and
location to meet the needs of the proposed use ofthc propc11y.
. Thc property has been operating for approximately a year without any extraordinary
problems.
Section 6. Based on the forcgoing, the Planning Commission hereby approves
Conditional Use Permit 00-5 (Indefinite Extension), subject to the following conditions:
1. CUP No. 00-5 (indefinite Extension) is approved for the operation of a private parking lot
at 10 1 Main St.
2. The hours ofthe "paid" parking lot shall be from 7 AM to 8 PM, Saturday, Sunday &
Holidays
3. An attendant will be on site all days in which the valet is holding keys for paid parking.
4. 21 parking spaces will be lefi open and accessible, at no charge, to customers of the
existing businesses at 101 Main SL
5. The maximum number of "paid" parking spaces shall be 19, of which no more than 3 will
be located in the center aisle.
6. This CUP shall not become effective for any purpose unlcss/until a City "Aceeptance of
Conditions" fonn bas been signed by the applicant in the presence of the Director of
Development Services, or notarized and returned to the Planning Department; and until
the ten (10) calendar-day appeal period has elapsed.
7. A modification of this CUP shall be applied for when:
a. The establishment proposes to modify any of its eurrent Conditions of Approval.
b. There is a substantial change in the mode or character of operations of the property.
8. The Planning COlmnission reserves the right to revoke or modify this CUP pursuant to
Articles 25 and 28 of The Code of the City of Seal Beach if hann or retail-related
problems are demonstrated to occur as a result of criminal or anti-social behavior,
including but not limited to the congregation of minors, violence, publie drunkcnness,
vandalism, solicitation and/or litter.
9. This CUP shall become null and void unless exercised within one (1) year of the date of
final approval, or such extcnsion of time as may be granted by the Planning Commission
pursuant to a written request for extension submitted to the Department of Development
Services a minimum of ninety (90) days prior to such expiration date.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach
at a mecting thcreofheld on the 18th Day of April, 2001, by the following vote:
