RESOLUTION NO. 01-6
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW
01-3, PERMITTING THE EXPANSION OF A NON-
CONFORMING STRUCTURE BY APPROXIMATELY 50
SQUARE FEET AND ALLOWING THE COMPLETION OF AN
INTERIOR REMODEL AT 1101 SEAL WAY, SEAL BEACH.
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
Section 1. On February 21, 2001, Renee Bollen ("The Applicant") submitted
an application for Minor Plan Review 01-3 with the Department of Development Services. The
applicants sought to complete a prcviously approved remodel and cover an existing deck of
approximatcly 50 square feet with lattice covering.
Section 2. Pursuant to 14 Calif. Code of Regs. ~ 15025(a) and ~ IT.A of the
City's Local CEQA Guidelines, staff has determined as follows: The application for Minor Plan
Review No. 01-3 is categoricaIly exempt from review pursuant to the California Environmental
Quality Act pursuant to 14 Calif. Code of Regs. ~ 15301(a)&(e) (Existing Facilities), because the
application is for interior and exterior remodel of an existing residential structure; and, pursuant
to ~ 15061(b)(3). because it can be seen with certainty that there is no possibility that the
approval may have a significant effect on the environment.
Section 3. A duly noticed hearing was held before the Planning Commission
on March 21, 2001 to consider Minor Plan Review 01-3. No public testimony was provided
regarding the proposed project.
Section 4.
The record of the hearing indicates the following:

(d) The subject property is rectangular in shape with a lot area of
3,373 square fcct (37.48' x 90').
(e) The surrounding land uses and zoning are as follows:
SOUTH The municipal beach and the Pacific Occan located in the Public Land Use
I Recreation zone (PLUIR).
NORTH,
EAST & WEST A mixture of single-family and multi-family residential dwellings
located in the Residential High Density zone (RHD) of Old Town.
(t) Staffreceived no responses, written or other, to its mailed notice
regarding Minor Plan Review 01-3.
Section 5. Based upon thc cvidence in the record, including the facts stated in
~ 4 of this resolution and pursuant to ~ 28-2407 of the City's Code, the Planning Commission
hereby finds as follows:

. Minor Plan Review 01-3 is consistent with the provisions of the Land Use
Element of the City's General Plan, which provides a "high density residential"
designation for the subject property. The use is also consistent with the
remaining elements of the City's General Plan as the policies of those elements
are consistent with, and reflected in, the Land Use Element. Accordingly, the
proposed use is consistent wilh the General Plan.
Section 6. Based on the foregoing, the Planning Commission hereby approves
Minor Plan Review 01-3, subject to the following conditions:
1. Minor Plan Review 01-3 is approved for the property located at 1101 Seal Way. Specifically,
MPR 01-3 is approved for the expansion of approximately 50 square feet of covered deck
area and the completion of a previously approved remodel to a non-conforming structure.
The remodel was approved through MPR 94-5
2. All construction shall be in substantial compliance with the plans approved through MPR 01-
3
3. This Minor Plan Review shall not become effective for any purpose unless an "Acceptance
of Conditions" form has been signed by the applicant in the presence of the Director of
Development Services, or notarized and returned to the Planning Department; and until the
ten (10) day appeal period has elapscd.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach
at a meeting thereof held on the 21'1 day of March, 2001, by the following vote:
