A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF SEAL
BEACH APPROVING CONDITIONAL USE
PERMIT 00-13 (AMENDMENT), PERMITTING
THE PLANNED SIGN PROGRAM 00-1 AT
OAKWOOD APARTMENTS AT 333 1ST ST TO
BE AMENDED TO ALLOW A MONUMENT
SIGN, WHICH WILL BE PLACED AT THE
CORNER OF 1ST ST. & PACIFIC COAST
HIGHWAY.
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH
DOES HEREBY FIND AND RESOLVE:
Section 1. On January 22, 2001 Stacy Mosier of Oakwood Apts. (thc
"Applicant") filed an application with the Departmcnt of Development Services for
Conditional Use Permit 00-13 (Amendment).
Section 2. Pursuant to 14 Calif. Code of Regs. * 15301 and ~ II.B of
the City's Local CEQA Guidclincs, staff has detennined as follows: The application for
CUP 00-13 (Amendment) for the proposed Planned Sign Program is categorically exempt
from review pursuant to the Califomia Environmental Quality Act pursuant to 14 Calif.
Code of Regs. ~ 15305 (Minor Alterations in Land Use Limitations), because the
proposal involves a minor alteration in land use limitation and does not involve either a
property in excess of20% slope or a change in land use or density.
Section 3. A duly noticed public hearing was held beforc thc Planning
Commission on February 21, 2001, to consider the application for Conditional Use
Permit 00-13 (Amcndment). At the public hearing the applicant spoke in favor of the
rcqucst, with persons appearing in favor ofthe request.

The rccord of the hearing of February 21,2001 indicates
a. On January 22, 2001, Stacy Mosier of Oakwood Apts. (the
"Applicant") filed an application with the Department of Devclopmcnt Services for
Conditional Use Permit 00-13 (Amcndment).
b. Specifically, the applicant has submitted a "Sign Program" for thc
Oakwood Apartment complcx locatcd at 333 1 st St. The application calls for an
amendment to the program to add a monument sign at the comcr of 1 sl St., and Pacific
Coast Highway in addition to the existing wall sign.
c. Section 28-1803 sets forth the procedure to apply for a planned
sign program within a rcsidential zone to be through the Conditional Use Pennit process.
d. Thc subjcct property is described as assessor's parcel number 043-
160-50.
e. Surrounding land uses and zoning are as follows:
WEST San Gabriel River and the Long Beach Marina

Residential Housing in a Residential Low Density (RLD) zone
NORTH
State Lands within the Hellman Ranch Specific Plan (SPR) zone

Section 5. Based upon the facts contained in thc rccord, including
those stated in ~4 of this resolution and pursuant to ~~ 28-1803 and 28-2503 & 28-2504
of the City's Code, the Planning Commission makes the following findings:
a. Conditional Use Pem1it 00-13 (Amendment) is consistent with the
provisions ofthc Land Use Element of the City's General Plan which penn its rcsidcntial
uses on the subject property. The use is also consistent with thc remaining elements of the
City's General Plan as the policics of those elements are consistent with, and reflected in,
the Land Use Element. Accordingly, the proposed use is consistcnt with the General Plan.
b. The signs included in this planned sign program meet the
minimum design standards for signs within thc City.
Section 6. Based upon the foregoing, the Planning Commission
hereby approves Conditional Use Permit 00-13 (Amcndmcnt) subject to the following
conditions:
1. CUP No. 00-13 (Amendment) is approved for the implementation of a "Planned
Sign Program" which will include a wall sign on the "Recreation" building at the
gate on 1 sl St. and will now be amended to include a monument sign at thc Corncr
of 1.1 St. and Pacific Coast Highway.
2. A building pcrmit for the monument sign to be added as a result of this
Amendment to CUP 00-13 shall not be issued until the billboard sign at the
intersection ofthe Pacific Coast Highway and thc San Gabriel River is removed.
3. Any new signs must be approved through an amendment to this Conditional Use
Permit.
4. This CUP shall not become effective for any purpose unless/until a City
"Acceptancc of Conditions" fonn has been signed by the applicant in the presence
of the Director of Development Services, or notarized and returned to thc
Planning Department; and until the ten (10) calendar-day appcal period has
elapsed.
5. A modification ofthis CUP shall be applied for when:
a. The cstablishmcnt proposes to modify any of its current Conditions of
Approval.
b. Thcre is a substantial change in the mode or character of operations of thc
property.
6. This CUP shall becomc null and void unless exercised within one (1) year of the
date of final approval, or such extension of timc as may be granted by the
Planning Commission pursuant to a written request for extension submitted to the
Department of Development Services a minimum of ninety (90) days prior to
such expiration datc.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thercof held on the _21st_ day of
