HomeMy WebLinkAboutPC Res 01-03 - 2001-02-21 RESOLUTION NO. 01-3 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY Of SEAL BEACH APPROVING MINOR PLAN REVIEW 01-1, PERMITTING THE ADDITION OF APPROXIMATELY 264 SQUARE FEET TO UNIT A AND 39 SQUARE FEET TO UNITB AT THE PROPERTY LOCATED 515 OCEAN AVE. THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. On January 17, 2001, Charles Dickinson ("Thc Applicant") submitted an application for Minor Plan Revicw 01-1 with the Department of Development Services. The applicant sought to expand umt "A" by approximately 264 square feet (242 squarc fcct to the master bedroom and 22 square feet on the 151 floor for a closet) and expand unit "B" by 39 squarc fect (Living area). Section 2. Pursuant to 14 Calif. Code of Rcgs. ~ 15025(a) and ~ 11.A of the City's Local CEQA Guidelines, staff has dctcrmined as follows: The application for Minor Plan Review No. 01-1 is categorically exempt from review pursuant to the California Environmental Quality Act pursuant to 14 Calif. Code of Regs. ~ 15301(e) (Existing Facilities), because it involvcs an addition to an existing residential structure which increases the 0001.' area by less than 50% and is less than 2,500 squarc feet in area; and, pursuant to ~ 15061 (b )(3), becausc it can be seen with certainty that there is no possibility that the approval may have a significant effect on the environment. Section 3. A duly notiecd hearing was held before the Planning Commission on February 21,200] to consider Minor Plan Rcvicw 01-1. Section 4. The record of the hearing indicates the following: (a) On January 17,2001, Charles Dickinson submitted an application lor Minor Plan Review 01-1. (b) Specifically, the applicant is sccking to expand unit "A" by approximately 264 square feet (242 square feel on thc mastcr bedroom and 22 on a new closet on the 1'1 floor) and to expand unit "B" by approximately 39 squarc fcet (living area) at a nonconforming prope11y located at 515 Ocean Ave, Seal Beach. The subject propcrty is nonconlonning due to density. (c) The subject properly is dcscribed as Orangc County Asscssor's Parcel Number 199-031-19 and is located in the Residential High Density (RHD) zone of Old Town. (d) Thc subject propel1y is trapezoidal in shape with a lot area of approximately 2,750 squarc feet. (e) Thc surrounding land uses and zoning are as follows: NORTH, EAST & WEST A mixturc of single and multiple family housing in a Residential High Dcnsity (RHD) zone. SOUTH Singlc family residences in a Residential Low Density (RLD) zonc and the Pacific Occan in a PLU/R zone. (f) Stall' has received no responses, written or other, to its mailcd notice regarding Minor Plan Rcvicw 01-1. Section 5. Bascd upon thc evidence in the record, including the facts stated in . ~ 4 of this rcsolution and pursuant to ~ 28-2407 ofthc City's Code, the Planning Commission hcrcby finds as follows: PI'lIIning Commis.sion Resolution No. 01-3 (a) Minor Plan Review 01-1 is consistent with the provisions of the Land Use Element of the City's General Plan, which provides a "high density rcsidcntial" designation for the subject property and pelmits single- and multi-family residential uses. Thc use is also consistent with the remaining elements ufthe Cily's General Plan as the policics of those clements are consistent with, and rellected in, the Land Use Elcl11cnt. Accordingly, thc proposed use is consistent with the General Plan. Section 6. Based on the loregoing, the Planning Commission hereby approvcs Minor Plan Review 01-1, subject to the following cOlldilions: 1. Minor Plan Review 01-1 is approved for interior and exterior remodel at 515 Ocean Ave. Specifically, MPR 01-1 is approved for thc expansion and remodel of the master bedroom of unit A by approximately 242 square fect, inclusivc ofa new 22 square foot closet. In addition, MPR 01-1 is approved for a ncw 22 squarc foot closet on the first floor to unit A. Further MPR 01-1 is approved for a 39 &quare foot addition to unit B. 2. All construction shall be in substantial compliance with the plans approved through MPR 01-1. 3. This Minor Plan Review shall not become effcctive for any purposc unlcss an "Acceptance of Conditions" forol has been signed by the applicant in the presencc of the Director of DevelopmCl1t Services, or notarized ami rctumed to the Planning Department; and until the ten (10) day appeal period has elapsed. 4. Thc wood shinglcs on the roof must be repaircd to the satisfaction ofthc Sr. Building inspector due to tcrmite damagc. 5. The wood stairs which go up to unit "B" must be repaired to thc satisfaction of the Sr. Building inspector due to tennite damage.
