Accordmgly, the proposed use IS consistent With the General Plan. Fmdmgs. A. The City of Seal Beach does not allow parkmg wlthm front yard setbacks m private reSidential areas anywhere m the City, and It would adversely Impact the aesthettc appeal and character of the City to allow an exception to thiS rule. B. The CIty has evaluated the reSidentIal areas of the commumty m accordance WIth the proVlSlons of Government Code SectIon 65852.2(a)( 1 )(A), whIch allows for the review of areas m lIght of Impacts as to the adequacy of water and sewer sefV1ces and the Impact of second umts on traffic flow Based on an analYSIS of parkmg and sewcr mfrastructure wltlun the commumty, the City hereby finds that there are msufficlent resources to accommodate second umts for all areas m "Old Town" that are zoned ReSIdentIal High Density and ResidentIal MedIUm DenSIty Tlus findmg is based on the followmg substantIal eVidence: D These areas of the City have been subject since 1963 to restnctlve on- street parkmg provlSlons to accommodate the demand for on-street parktng spaccs by the occupants of reSidentIal umts and the demand on the publIc streets for on-street parkmg by persons vlsltmg the publIc beaches that do not WIsh to park m the pay beach parkmg lot D The potentIal ablhty of additIonal reSIdential uruts to be constructed m these areas would senously Impact an eXlstmg highly constncted parkmg availabilIty situatIon D Several of the streets wlthm these areas of "Old Town" are very narrow, between 40 and 60 feet m width, and any additIOnal on-street parkmg pressure on these streets would exacerbate an eXlstmg publIc safety concern. The Sewer System Master Plan Identlfics the follOWIng speCIfic defiCIencIes: o The majonty of the systcm IS velOCIty deficient WIth pcak flow velOCIties less than 3 0 feet per second. o WIth the exceptIOn of the eXIst10g Electnc A venue Trunk Sewer, the system was bUIlt 10 the 1920's, and the sewers have excceded theIr expected 50-year useful lIfe. o HIgh ground water levels eXist m the Old Town area and It IS believed that an exceSSIve amount of mfiltratlon IS entenng the system through defectIve pIpes, pIpe joints, connectIons and manholes. o There are also many reaches of 6-1Och VCP sewer that reqU1re upsIz10g to the standard sewer dIameter of 8-1Oches. Those locatIons are noted 10 Table 1, Old Town 6-Inch Sewers, below. o The sewers 10 the Old Town alleys are located In close proximIty to domestic water lines These locations VIolate the baSIC separatIon rule establIshed by the Hcalth Department. "Old Town" means that area of the City lying on the southwesterly side (ocean side) of Pacific Coast Highway between the northwesterly side of the United States Naval Weapons Station and the San Gabriel River." Section 3. Subparagraph ( c) of paragraph (10) of subsection A of section 28-400 of Article 4 of Title 28 of The Code of The City of Seal Beach is hereby deleted in its entirety. Section 4. Subparagraph (d) of paragraph (10) of subsection A of section 28-400 of Article 4 of Title 28 of The Code of The City of Seal Beach is hereby renumbered as subparagraph (c). Section 5. Paragraph (10) of subsection A of section 28-400 of Article 4 of Title 28 of The Code of The City of Seal Beach is hereby renumbered as paragraph (11). Section 6. A new paragraph (10) is hereby added to subsection A of section 28- 400 of Article 4 of Title 28 of The Code of The City of Seal Beach, to read as follows: "( 1 0) Second Dwelling Units, pursuant to the requirements of Section 28- 407. " Section 7. Section 11. A new section 28-407 is hereby added to Article 4 of Title 28 of The Code of The City of Seal Beach, to read as follows: "Section 28-407. Second Dwelling units. (a) Definitions. (1) "Second Dwelling Unit" means an attached or a detached residential dwelling unit which provides complete independent living facilities for one or more persons. It shall include permanent provisions for living, sleeping, eating, cooking, and sanitation on the same parcel as the single-family dwelling. A Second Dwelling Unit also includes Efficiency Units and Manufactured Homes, as those terms are defined below. A Second Dwelling Unit is not an "Accessory Building." (2) "Efficiency Unit" means a separate living space with a minimum floor area of 150 square feet which contains partial kitchen or bathroom facilities. (3) "One-Bedroom Unit" means a separate living space that contains a living room, one bedroom, and full kitchen and bathroom facilities. (4) "Two-Bedroom Unit" means a separate living space that contains a living room, two bedrooms, and full kitchen and bathroom facilities. (5) "Manufactured Home" means a structure, transportable in one or more sections, which, in the traveling mode, is eight body feet or more in width, or 40 body feet or more in length, or, when erected on site, is 320 or more square feet, and which is built on a pennanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning, and electrical systems contained therein. A legal single-famdy dwelhng (the "Pnmary Dwelhng Umt") must eXlst on the lot or must be constructed on the lot m conjunctIOn wIth the construetlOn of the Second DwellIng Umt (d) Independent facilities. A Second Dwelling Umt shall provIde independent hvmg faclhtIes for one or more persons and mc1udc permanent proVlsions for hvmg, sleepmg, eatmg, cookmg, and samtatIon. (e) Zoning requirements. A Second Dwelhng Umt shall comply With the same hCIght, setback, lot Size, lot coverage, and othcr apphcable zomng requirements as apply to the Pnmary Dwelhng Umt. (f) Ownership. The property shall be the pnmary residence of the property owner The owner mu!>t occupy eIther the Pnmary Dwelling Umt or Second Dwellmg Umt as his or her pnmary pnnclpal resIdence. (g) Deed restriction. The Second Dwellmg Umt shall not be sold, transferred, or aSSIgned separately from the Pnmary Dwelling Umt. Before obtammg a bUlldmg permit for the Second Dwelhng Umt, the owner of the lot or parcel shall file With the County Recorder a declaratIon or agreement of restnctt ons, which has been approved by the CIty Attorney as to ItS form and content, contammg a reference to the deed under wlueh the property was acqUired by the owner and statmg that: (1) The Second Dwellmg Umt shall not be sold separately, (2) The Second Dwelhng Umt shall be considered legal only so long as eIther the Pnmary Dwelling Umt or the Second Dwelling Umt IS occupIed by the owner of record of the plOperty. (3) The restnchons shall be bmdmg upon any successor m ownership of the property and lack of compliance shall result m legal achon agamst the property owner. (h) Impact on Historic resources. No Second Dwelling Umt may be approved Ifloeated on, or adjacent to, real property that IS listed on the California Reglstel of Hlstonc Places. (I) Architectural Compatibility. The Second Dwelhng Umt shall mcorporate the same or SimIlar archItectural features, budding matena1s and colors as the mam dwellmg umt or dwellmg!> located on adjacent propertles " Section 12 Seehon 28-503 of Arttcle 5 of TItle 28 of Thc Code of The City of Seal Beach IS hereby amended to read as follows. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance or any part thereof is for any reason held to be invalid or unconstitutional, such decision shall not affect the validIty of the remaining portion of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of the fact that anyone or more section, subsection, subdivision, paragraph, sentence, clause or phrase be declared invalid or unconstitutional.
