HomeMy WebLinkAboutPC Res 04-42 - 2004-08-18 RESOLUTION NUMBER 04-42 O~/6'h 1t11 ~ A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CUP NO. 04-5 (PLANNED SIGN PROGRAM 04-1), PERMITTING FREEW A Y ORIENTED BUSINESS IDENTIFICATION SIGNS AT 3850 LAMPSON AVENUE (SUNRISE ASSISTED LIVING FACILITY) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE: Section 1. On July 29, 2004, Sunrise Senior Living, Inc. and the Ayres Group (the "Applicants") filed an application with the Department of Development ServIces for Conditional Use Pe~it 04-5 (Planned Sign Program 04-1). Section 2. Pursuant to 14 Calif. Code of Regs. * 15305 and * 1LB of the City's Local CEQA Guidelines, the Planning Commission detennines as follows: The application for Conditional Use Pennit 04-5 (Planned Sign Program 04-1) IS categorically exempt from review pursuant to the California Environmental Quality Act pursuant to 14 Calif. Code of Regs. * 15305 (Minor Alterations in Land Use Limitations), because the proposal involves a minor alteration in land use limitation and does not involve either a property in excess of20% slope or a change in land use or density. Section 3. A duly noticed public heanng was held before the Planning Commission on August 18,2004, to consider the application for Conditional Use Pennit 04-5 (Planned Sign Program 04-1). At the public hearing the Planning Commission received all written and verbal comments relative to the request. Section 4. The record of the hearing of August 18, 2004 indicates the following: (a) applicant's are proposing a Plmmed Sign Program to allow Planned Sign Progrmn for freeway identIfication signs for Ayres Hotel and Sunnse Assisted Living. The proposed signs would be located on the existing 405 Freeway sound wall of the Sunrise Senior Living facility on the east-facing side of the sound On July 29, 2004, Sunrise Senior Living, Inc. and the Ayres Group (the "Applicants") filed an application with the Department of Development Services for Conditional Use Pennit 04-5 (Planned Sign Program 04-1). (b) The wall, approximately 16 feet above grade, and 9 feet below the top of the existing 25-foot high sound wall. The proposed signage would consist of a 2'- 10" x 31'-10" (approximately 88 square feet) "Sunrise Senior Living" sign and a 2' -6" x 22'-9" (approximately 57 square feet) "Ayres Hotel" sign. The lower sign will be approximately 9 feet above grade. (c) The Sunrise Senior Living facility was approved in 2001 and encompasses a three-story and a one-story structure that house a 155 unit facility (126 assisted living facility, 29 unit Alzheimer's care facility), parking lot, landscaping and other ancillary facilities on 3.9 acres located approximately 500 feet east of the southeast corner of Lampson Avenue and Seal Beach Boulevard, iImnediately adjacent to the northbound 405 Freeway off-rmnp at Seal Beach Boulevard. (d) The Ayres Hotel facility was approved in 2000 and consists of three-story, 104-room hotel structure on 2 acres along Seal Beach Boulevard, having a building frontage of approximately 155 feet. The second and third floors are identical in design with the exception as to the number of suites, with the second floor containing 39 suites and related service areas, and the third floor containing 37 suites and related service areas. (e) The subject propeIties comprise all of the properties located at the southeast corner of Seal Beach Boulevard and Lampson Avenue that have frontage to the 1-405 Freeway. (f) The subject properties are located in the General Commercial (C- 2) zone, on irregular parcels of land having approximately 245 feet of frontage on Seal Beach Boulevard for the Ayres Hotel property, and approximately 500 feet of frontage on Lampson Avenue for the Sunrise Assisted Living property. Both propertIes have approximately 895 feet of frontage along the north-bound 1-405 Freeway Seal Beach Boulevard off-ramp. The subject properties comprise 5.9 acres of the entire land area of 13.07 acres. (g) Surrounding land uses and zoning are as follows: North: Bixby Old Ranch Golf Course in the Recreation-Golf (R-G) Zone, across Lampson A venue. North of the Ayres Hotel facIlity are two commercial developments that comprise approximately 19,000 square feet and are located m the C-2 Zone. South: I-~05 Freeway, with the Seal Beach Weapons Support Facility located south of the Freeway, in the Public Land Use/Recreation (PLU/R) Zone. East: ApproXImately 1,500 feet to the east is the Bixby Old Ranch Tennis Club, currently in the Public Land Use/Recreation (PLU/R) Zone and proposed to be dedIcated to the City, based on City Council actions of November 23, 1998. West: Across Seal Beach Boulevard, in the General Commercial (C-2) and Light Industrial (M-I) zones is the Bixby Old Ranch Office Park development, in the City of Seal Beach. Section 5. Based upon the facts contained in the record, including those stated in ~4 of this resolution and pursuant to ~~ 28-1803 and 28-2503 & 28-2504 ofthe City's Code, the Planning Commission makes the following findings: (a) Planned Sign Program 04-1 is consistent with the intent of Article 18 (Sign Provisions) by virtue of the nature of the signs, proposed placement of the signs on the freeway-oriented noise wall, and proposed construction materials. (b) The proposed signs meet the minimum design criteria established through Section 28-1803 of the Municipal Code. (c) The approval of this request does not constitute the granting of special privileges by virtue of the fact that several similar approvals have been granted in the past; the most recent in this area of the City bemg within the Bixby Old Ranch Towne Center. Section 6. Based upon the foregoing, the Planning Commission hereby approves Conditional Use Pennit 04-5 (Planned Sign Program 04-1), subject to the following conditions: 1. Any new signs or substantial deViation from the program approved herein by the City must be approved through an amendment to this Planned Sign Program. 3. This Planned Sign Program shall not become effective for any purpose unless/until a City "Acceptance of Conditions" fonn has been signed by the applicant in the presence of the Director of Development ServIces, or notarized and returned to the Planning Department; and until the ten (10) calendar-day appeal period has elapsed. 4. This Planned Sign Program shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of tune as may be granted by the Planning Commission pursuant to a wlitten request for extension submitted to the Department of Development Services a mimmum of ninety (90) days prior to such expiration date. 5. The applicant shall indemnify, defend and hold hannless City, its officers, agents and employees (collectively "the City" hereinafter) from any and all claims and losses whatsoever occurring or resulting to any and all persons, finns, or corporations furnishing or supplying work, services, materials, or supplies in connection with the perfonuance of the use permitted hereby or the exercise of the rights granted herein, and any and all claims, lawsuits or actions arising from the granting of or the exercise of the rights penuitted by this Conditional Use Penuit, and from any and all claims and losses occurring or resulting to any person, finu, corporation or property for damage, mjury or death arising out of or connected with the perfonuance of the use pennitted hereby. Applicant's obligation to indemnify, defend and hold harmless the City as stated herein shall include, but not be limited to, paying all fees and costs incurred by legal counsel of the City's choice in representing the City in connection with any such claims, losses, lawsuits or actions, expert witness fees, and any award of damages, judgmcnts, verdicts, court costs or attorneys' fees in any such lawsuit or action.
