I .1 I . .. 1-24-94 ROLL CALL Present: Mayor Forsythe Councilmembers Brown, Doane, Hastings, Laszlo Absent: None Also present: Mr. Bankston, city Manager Mr. Barrow, city Attorney Mr. Whittenberg, Director of Development services Mrs. Yeo, city Clerk WAIVER OF FULL READING Doane moved, second by Brown, to waive the reading in full of all ordinances and resolutions and that consent to the waiver of reading shall be deemed to be given by all Councilmembers after reading of the title unless specific request is made at that time for the reading of such ordinance or resolution. AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried PRESENTATION RESOLUTION NUMBER 4284 - HONORING LOS ALAMITOS HIGH SCHOOL FOOTBALL TEAM Mayor Forsythe read Resolution Number 4284 in full entitled "A RESOLUTION OF THE CITY OF SEAL BEACH HONORING LOS ALAMITOS HIGH SCHOOL CALIFORNIA INTERSCHOLASTIC FEDERATED CHAMPION FOOTBALL TEAM" and acknowledged each member of the team, the coach and assistant coaches. Councilman Laszlo awarded a personal copy of the Resolution to those present, as well as the framed Resolution for display at the High School. A spokesman for the team expressed appreciation for the City's support and recognition. Resolution Number 4284 was unanimously adopted by the city Council. ORAL COMMUNICATIONS Mayor Forsythe declared Oral Communications open. Mr. Jay Bulmash, Seal Beach, encouraged citizens to attend and participate in City Council meetings. with re~ard to his comments of last meeting relating increased cr1me, deterioration of the quality of life, and the quaint village image becoming a fond memory, he made reference to the more recent confiscation of weapons and an assault crime in daylight hours, to which he noted the needed revenues lost with the UNOCAL denial at last meeting based on what he deemed to be hypotheticals and theoreticals. Mr. Bulmash said he wanted to take back the village, to do so means that money needs to be spent, and cited Seal Beach as having one of the lowest number of sworn officers per capita of all cities in Orange County. He spoke favorably of the potential hiring of two new sworn officers, and requested that the candidates for the upcoming election pledge their efforts to increase the police force. Councilman Laszlo responded that the Reserve Officer Program is proposed to be reinstated as well, initially comprised of five officers. RESIGNATIONS - BEACH COMMISSION Mayor Forsythe announced the receipt of resignations from all members of the Beach commission, this commission originally formed to accomplish certain goals, which they have done, however other goals desired by the Commission can not be accomplished at this time due to the lack of funds. Mayor Forsythe suggested acceptance of the resignations and consideration of disbanding the Commission. The Manager offered to prepare an ordinance to disband the commission for 1-24-94 consideration at the next meeting if that were the direction of the Council. Expressing regret for the resignations and citing the concern of the Commission members with the beach and pier, Councilmember Hastings reported the forwarding of extensive information packets to county, state and federal legislators and agencies seeking financial assistance for pier/groin repair and sand replenishment, as well as personal contacts with the I legislators, to which the only response received was from the U. - S. Navy and they, recognizing the problem, have moved up their dredging project by one year. She noted that to replace the beach sand would cost approximately $3 million, money the City does not have, therefore assistance is needed from outside agencies, the County Parks and Recreation Department as an example should donate a million dollars or so given the fact that all Orange County residents use the beach. Councilmember Hastings concluded that all sources have been pursued short of floating a bond issue. Hastings moved, second by Laszlo, to accept the resignations of Dr. Gordon LaBedz, Mr. Larry Michaels, and Mr. Tom Lyon as the District Three, Four and Five representatives to the Beach Commission, and that an ordinance be prepared to officially disband the Beach Commission. AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried Members of the Council expressed appreciation to the members of the Commission for their dedicated efforts. CONSENT CALENDAR - ITEMS "c" thru "E" I" At the request of Councilmember Hastings, the Director of Development Services explained that Item "D" relates to the South Coast Air Quality Management District proposed Rule 1402 and proposed amendment to Rule 1401, the AQMD to hold public hearings in February to consider adoption of those rules, one applies to new sources of air contaminants, the other to facilities that currently/exist, the goal being to reduce the amount of toxic air contaminants that are emitted from certain types of facilities. He reported the complete text of the proposed rules are available for review at city Hall and the staff report is available at each library. Brown moved, second by LaSZlo, to approve the recommended action for items on the Consent Calendar as presented. C. Approved regular demands numbered 4160 through 4360 in the amount of $593,448.11 and payroll demands numbered 4928 through 5266 in the amount of $459,6430.64 as approved by the Finance Committee, and authorized warrants to be drawn on the Treasury for same. D. Received and filed the status report of Proposed Rule 1402 - Control of Toxic Air Contaminants from Existing Sources and Proposed Amendments to Rule 1401 - New Source Review of Carcinogenic Air contaminants, South Coast Air Quality Management District, and directed that the report be forwarded to the Planning commission and Environmental Quality Control Board for information purposes. I I I f~ iii ...,,," 1-24-94 AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried POLICE RESERVE UNIT The city Manager presented a proposal to re-establish/ reactivate a police reserve unit, which had been disbanded some years past. He explained that the purpose of and guidelines for the Reserve unit are proposed to follow POST guidelines, personnel levels of one, two and three, each having a different level of training and certification, and under State law ,each allowed to perform different types of duties. He noted that the Unit is proposed to be established with five uniformed, armed officers at levels one and two, and required to serve a specified number of hours per month to retain their reserve classification. He noted that there are presently two level three reserves who have technical office expertise, are not uniformed nor carry weapons, yet provide technical support and assistance. The Manager explained that with Council approval of the Reserve unit the applications of twenty-two persons having shown an interest in the Unit will be reviewed and/or applications will be sought to fill the positions, and that interviews could commence as early as two weeks. In response to Council, the Manager offered that the program is not meant to train participants to go on to become officers, however it does provide a good base from which to observe and evaluate performances, and could be an advantage to a participant in a future selection process. From past experience he said the participants are generally professionals who are interested in providing a service to the community, often officers in other agencies who live in the city, sometimes a retired officer. He reported the average number of participants in the prior program was ten, and confirmed that the Police Captain will be in charge of the program. Brown moved, second by Hastings, to approve the program description to establish a Police Reserve Unit and authorize staff to proceed with Reserve Officer selections. AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried As a point of information, the Manager reported a recruitment is in progress for two police officers to fill existing vacancies as approved by the 1993/94 budget. COUNCIL CONCERNS Councilman Brown inquired about the Rossmoor wall and the Super Saver Cinema issues. The City Manager reported two engineering firms have inspected the wall and advised there does not appear to be pressure from the wall to the degree that would require a delay in repairing the sidewalk, that specifications for the sidewalk replacement are currently in the process of preparation, the project could commence within six to eight weeks, and pointed out that both engineering firms recommended the installation of fencing at the time the sidewalk is replaced as a protective measure in the event of falling debris. He noted there was no further deterioration of the wall due to the earthquake, and the Rossmoor Association has requested patience for a determination on the wall as they will be going to election on that issue in November. with regard to the theater, the Manager reported there has been a cooperative effort between the theater and the shopping center to share the cost of private security of the area, staff is in the process of reviewing a landscaping and parking proposal submitted by the Center, one issue of the plan being to take the parking areas along the wall and configure islands and landscaping so that there is less incentive to park in that area, and should problems continue the area could be segregated and secured separately from the remaining parking. To Councilman Brown's mention of 1-24-94 disturbances relating to auto alarms in that area, the Manager recalled the adopted ordinance that allows a police officer to disengage an alarm after its activation for a period of ten minutes. Councilman Laszlo referred to the Ruby's Diner expansion considered and continued by the Planning Commission pending further information from the Department of Fish and Game, and expressed his desire that this issue be considered by I the City Council as well. The city Manager confirmed that the request of Ruby's will be considered by the Council as the City is the property owner and any modification of the agreement with Ruby's would likewise require City Council approval, the issue under consideration by the Commission being the design, etc. Noting this City's sound level standard of sixty-five decibels, Councilmember Hastings inquired if it could be lowered to fifty- five decibels as other cities have done. The Director of Development Services explained that the decibel readings are set forth in the Code and would require amendment to change those standards. He pointed out that the background noise level of cities in other areas of the State may be lower than levels found in Southern California where normal background noise may in itself be sixty-five decibels, along Pacific Coast Highway or Seal Beach Boulevard as examples. Councilmember Hastings cited the noise standard in San Clemente as an example, and suggested it would be desirable to have a lower noise level for Main Street where there are backing residential properties, and asked that this subject matter be scheduled for a future agenda discussion. To another question of Councilmember Hastings, the Manager advised that requests for proposals from local architects for a police substation have not as yet been solicited as the information is not available through the computer and the architects are having to be identified by hand I search. Citing the busy downtown area especially during summer months, Councilmember Hastings spoke of the need for a substation as a deterrent to crime, which she indicated her understanding could be paid from the extended half-cent sales tax. The Manager explained that the current budget provided funding for architectural services however funding for construction was not budgeted, that approximately $119,000 is anticipated from Proposition 172 funds over a period of four quarters and the Council could appropriate a portion of those monies once the actual amount is known, and confirmed that monies for construction would not be appropriated from the General Fund. Councilman Laszlo mentioned that in the vicinity of a Vons Market frequented by College Park East residents there is a nearby bank which houses a police substation, and suggested that downtown businesses could be explored to house a similar facility. Councilmember Hastings said her preference would be that it be located in the area of the pier. Councilman Brown' said if there is a substation he envisioned officers on patrol rather than being inside an office. Mayor Forsythe reported a resident complaint regarding noise from errant aircraft over Seal Beach and provided telephone numbers for residents to immediately report such incidents to the Long Beach Airport. Mayor Forsythe said subsequent to the earthquake she reviewed documents relating to local emergency preparedness and found that the City'S Disaster Plan is concise, a recently updated I' document, another document addressed the planning scenario for a 7.1 magnitude quake on the Newport/lnglewood fault, legal documents are prepared to initiate disaster recovery, restoration of services, etc. She described the reaction of liquefaction soils, as experienced in the Redondo Beach area, as the collapse of the ground and anything of weight on top of that soil sinks. Mayor Forsythe announced that the Flower Market at Marina/PCB and the Lucky Market in Rossmoor Center are accepting donations of food for earthquake victims. The city Manager offered his belief that the City is as prepared as is humanly possible to respond to a Newport/lnglewood fault incident, .1 .1 I :~ .~ 1-24-94 I 2-14-94 however the separation of major portions of the community is a concern given the location of the fault line through the city, to which there is an effort to encourage Surfs ide Colony to have a link with Huntington Beach should there be damage to the transportation corridor, likewise College Park East and Rossmoor with Los Alamitos and Garden Grove, and College Park West with Long Beach. It was noted that no large gas lines traverse the fault line, yet there is one line on Lampson, one near the steam plant, and the off-shore oil line runs First street to Pacific Coast Highway and north on PCB. The Mayor encouraged all residents to secure their homes and belongings and noted that the Planning Scenario cites the potential of citizens being on their own for up to seventy-two hours, and suggested that they become familiar with nearby Neighborhood Watch programs, identification of local sources of medical assistance, etc. ORAL COMMUNICATIONS There were no Oral Communications.
