CITY OF SEAL BEACH RECOMMENDlNG TO THE CITY , YA
COUNCIL DENIAL OF ZONING TEXT AMENDMENT 04-2, "t /
AMENDlNG SECTION 28-401; DISTRICT 1 TO REDUCE THE ~
SIDE YARD SETBACKS ON SIDE YARDS THAT ABUT
STREETS IN THE RLD ZONE TO 10% OF THE LOT WIDTH.
THE PLANNlNG COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
Section 1. At its meeting of April 7, 2004, the Planning CommiSSIOn
considered Zoning Text Amendment 04-2. This amendment would reduce the required the side
yard setbacks m the RLD zone, Distnct 1, from 15% to 10% of the lot width.
Section 2. Pursuant to 14 Cahf Code of Regs. * 15305 and 9 II.B of the
City's Local CEQA Guidehnes, staff has determined as follows: The application for Zomng
Text Amendment 04-2 is categorically exempt from review pursuant to the CalIfornia
Environmental Quality Act pursuant to 14 Calif. Code of Regs. 9 15305 (Minor Alterations m
Land Use Limitations), because it consists ofmmor alterations in land use limitations in average
slope of less than 20% and does not result in any changes in land use or density; and, pursuant to
9 15061(b)(3), because it can be seen WIth certamty that there IS no possibility that the approval
may have a significant effect on the enVIronment.
Section 3. A duly noticed public hearing was held by the Planning
Commission on Apnl 7, 2004 to consider Zone Text Amendment 04-2.
Section 4.
The record of the hearing of Apnl 7, 2004 mdicates the following:
(a) At said public hearing there was oral and written testimony and evidence
received by the Planning Commission.
(b) The proposed text amendment will revise the City's zoning ordinance and
enhance the abIhty of the City to ensure orderly and planned development in the City through an
amendment of the zoning requirements.
(c) The proposed text amendment will require that side yard setbacks in yards
that abut streets in the RLD District 1 zone be mamtained at 10% of the lot width.
Section 5. Based upon the facts contained in the record, includmg those stated
in *4 of this resolution and pursuant to *9 28-2600 of the City's Code, the Plannmg Commission
makes the following findmgs:
(a) Zoning Text Amendment 04-2 is consistent with the prOVISIons of the
various elements of the CIty'S General Plan. Accordmgly, the proposed use IS consistent with the
General Plan. The proposed amendment is administrative m nature and WIll not result in changes
111consistent with the existmg prOVisions of the General Plan.
(b) The proposed text amendment will represent potential detrimental effects on
the streetscape and negative Impacts to the visual corridors that are presently viewed down each
beach access street.
(c) Aesthetic issues and size & height/bulk issues are important to the Planning
Commission, and this application represents the potential for future development applications of
very large structures encroaching into visual SIght Imes.
Section 6. Based upon the foregomg, the Planning CommIssion hereby
recommends denial of Zoning Text Amendment 04-2 to the CIty Council.
