Seal Beach, California October 26, 1994 I The city Council of the city of Seal Beach met in regular adjourned session at ~:OO p.m. with Mayor Brown calling the meeting to order. ROLL CALL Present: Mayor Brown Councilmembers Forsythe, Laszlo Absent: Councilmembers Doane, Hastings It was the consensus of the Council to excuse the absence of Councilmembers Doane and Hastings from this meeting. Also present: Mr. Bankston, City Manager Mrs. Yeo, City Clerk APPROVAL OF AGENDA Forsythe moved, second presented. by Laszlo, to approve the agenda as I AYES: NOES: ABSENT: Brown, None Doane, Forsy1me, Laszlo Hastings Motion carried ORAL COMMUNICATIONS There were no Oral Communications. COUNCIL ITEMS There were no Council Items for discussion. I I I 10-26-94 CONSENT CALENDAR - ITEMS "A" thru "E" As a point of clarification the City Manager advised that Rossmoor Center way, a public street, is scheduled for reconstruction/overlay, the cost of the overlay will be paid by the city however the cost for curbs, gutters and sidewalks will be shared equally with the Rossmoor Center. With regard to Item "0", the acquisition of sand the Manager explained it had been anticipated that purchase ~rders would be finalized for the purchase, trucking, etc. of the sand by this meeting, however are not as of this time, therefore recommended an action to authorize staff to proceed with the sand acquisition within the limits of the adopted budget. He noted that late last Tuesday it came to the att~ntion of the City that some sand would be available from an up-phase excavation of the Santa Ana River Project in the vicinity of Angel Stadium, a price quote was obtained from the contractor, C. A. Rasmussen, samples of the sand have been tested, which is a heavier grain and excellent quality. He advised that a separate firm will need to be retained to provide trucking, pgalde Trucking, an experienced firm, is the apparent low bid, the price of that service continues to be discussed and negotiated, under consideration also is whether the contractor or the selected trucking firm could best provide screening of the sand as needed, and noted that at one time Moffat & Nichol indicated to be economically feasible the city should set fifty thousand cubic yards as a minimum, however since this particular sand is such a high quality for beach use and given the erosion factor it is deemed to be worthwhile to secure an amount in the thirty thousand cubic yard range. The Manager indicated that Ugalde Trucking is presently estimating a pick-up and turn around time of about fifty-eight to seventy minutes, a fifteen ton truck at a cost of approximately one dollar per minute, the tentative transport route being the Fifty-Seven Freeway to the Twenty-Two. He mentioned to obtain Navy permission to traverse their property requires legal approval out of San Diego, typically the minimum approval time is twenty-one days, the local base commander having indicated such approval could possibly be shortened to between seven to ten days, that time frame important because the Army Corps has indicated whatever sand the City obtains by November 15th is the amount that will be allowed until after the winter season, however the same contractor will commit to making sand available to the City in March or April when the winter restriction is lifted. He confirmed that an estimated thirty to thirty-five thousand cubic yards of sand is presently stockpiled, the contractor feels another fifteen thousand yards could be excavated before November 15th, that somewhat dependent upon how quickly the trucking can be confirmed, adding that the reissue of permits by the Coastal Conservancy, AQMD, Water Quality, etc. have been secured, the Army Corps permit, Navy permission, and the route specified by CalTrans the only approvals remaining. He clarified that it is less expensive to purchase sand that may need some screening, which would be done a~ the direction of the City, rather than purchasing pre-screened sand, noted that the Army corp has given the tentative date of November 15th as the beginning of the winter season, should it rain prior to that date the project will likely cease, and likewise if the weather projection is favorable past the 15th, the grant of an extension of time is likely. The Manager explained that the trucks will be inspected at the source and delivery points, the sand will be shrouded during transport, the dispersement of the sand into the ocean will be somewhat different due to the smaller quantity as opposed to the one hundred thousand cubic yards that was anticipated to be dispersed during the summer months, also that Moffat & Nichol will be making recommendations as to specific locations to deposit sand initially, and the sand will be 10-26-94 stockpiled prior to spreading until such time as the ex~ct quantity is known. The Manager confirmed that the rema1ning permits are being expedited, the contractor has a CalTrans permit thus there is only need to change the recipient, the Army Corps has assured that this is an exempt project given the lesser quantity, their conditions will be the same as before with regard to grunion runs. He offered that if the sand I becomes available and purchase orders are executed for the sand and trucking yet access permission by the Navy has not yet been granted, the beach can be accessed via Seal Beach Boulevard, that it is hopeful all of the issues can be resolved by the upcoming Friday which would allow possible transport of sand by early the following week. He noted the trucking firm has indicated their capability of possibly delivering a load every three to five minutes. A Council consensus was indicated to direct staff to continue negotiations for purchase of the maximum amount of san1, trucking thereof, etc. up to the maximum of $400,000. In reference to Item "E",- the Manager explained that the County is responsible for lifeguard services to Sunset Beach, those services provided by private contract for the past five years, and the County is now going to bid for a new contract. He requested authorization for the City to participate in this bidding process, noting that there could possibly be a saving to the City in that such services are being provided to Surfside, if Sunset Beach were included the deployment of personnel, vehicles, etc. could be shared, all costs would be recovered plus a fee for admini~trative overhead and any additional equipment needed. He reported the City Attorney is presently reviewing the proposal, and should the County accept the proposal this item would again be presented to the Council for I consideration. Forsythe moved, second by Laszlo, to approve the recommended action for items on the Consent Calendar as follows: A. Approved the waiver of reading in full of all ordinances and resolutions and that consent to the waiver of reading shall be deemed to be given by all Councilmembers unless. specific request is made at that time for the reading of such ordinance or resolution. B. Approved reqular demands numbered 6932 through 7082 in the amount of $280,967.68 and payroll demands numbered 8724 through 8916 in the amount of $273,661.45, and authorized warrants to be (drawn on the Treasury for same. C. Bids were received until October 17, 1994 at 2:00 p.m. for Project Number 646, Rossmoor Center Way Reconstruction/Overlay, at which time they were publicly opened by the city Clerk as follows: E. C. Construction Company, in the amount of $69,150.95 and authorized the City Manager to execute the contract on behalf of the city. Authorized staff to proceed with negotiations and purchase of sand, trucking, screening, etc. for beach sand replenishment in an amount not to exceed the approved budget figure of $400,000. E. Authorized staff to proceed with the Response to Request for Proposals (RFPl of the County of orange for lifeguard services for the Sunset Beach area. D. AYES: NOES: ABSENT: Brown, Forsythe, Laszlo None Doane, Hastings Motion carried COUNCIL REPORTS Councilmember Forsythe reported that a productive meeting was held the prior evening relating to traffic/pedestrian safety in the area of McGaugh School, the draft traffic engineering report indicates it is felt that there is justification to lower the speed limit on Bolsa Avenue to fifteen miles per hour and to twenty-five miles per hour on Seal Beach Boulevard 'when children are present', that to include periods of spring/summer activities as well, noted there is a desire to lower the speed limit on Riviera Drive as well in that many children are being dropped there to access the School, a proposal to relocate the middle school bus stop, the Navy has indicated their effort to secure a maximum of $300,000 from their special account fund towards the construction of a bridge across Seal Beach Boulevard, the total =ost of which is estimated to be $700,000. Councilmember Forsythe indicated disagreement with the traffic engineer's determination that botch dots should not be used at the corner .of the Boulevard and Bolsa, indicating her desire that as many deterrents be placed in the vicinity of the School as possible, all of which will require increased enforcement. She noted anticipation of a resolution for Council consideration on November 14th relative to the speed limits and the posting of new signs thereafter, suggested also that.there is a need for more communication with the School District with regard to placing a cap on the number of children allowed to attend the Seal Beach/Los Alamitos schools from outside the area. Councilman Laszlo menl.ioned a vehicle accident the prior day involving a bus bench where children await the school bus in the vicinity of College Park East, and reported his request that the city Manager discuss with the School District the moving of the bus stop. ADJOURNMENT It was the order of the Chair, with consent of the Council, to adjourn the meeting until Monday, Novembe~ 14th at 6:30 p.m. to meet in Closed Session. I CLOSED SESSION By unanimous consent, the council adjourned to Closed Session at 6:35 p.m. to meet with legal counsel pursuant to government Code Section 54956.9(c) with regard to initiating a potential litigation case. The Council reconvened at 6:46 p.m. with Mayor Brown calling the meeting to order. The City Attorney announced that the council had discussed the item listed on the agenda, gave direction to legal counsel, and took no other action.
