SUBJECT: AUTHORIZE AGREEMENT AMENDMENT NO. 1 FOR
PIER DECK REHAEILITATION GRANT WITH THE
WILDLIFE CONSERVATION BOARD
SUMMARY OF REQUEST:
This is a request for the City Council to adopt Resolution No. 5881 approving the
attached agreement Amendment No. 1 with the Wildlife Conservation Board of
the State of California regarding replacing the decking on the Seal Beach
Municipal Pier.
BACKGROUND:
The Seal Beach Municipal Pier was constructed in 1906, and is 1800 feet long,
consisting mostly of poly-wrapped timber piles, timber support members and a
timber deck. A study was conducted by Moffatt & Nichol in 2006 which included
a life cycle cost analysis on the rehabilitation of the decking on the pier. A
"Greenheart" hardwood was selected and funding was approved originally in the
City's FY 2006-2007 Capital Improvement Program, phased into four years.
Phase 1 began in November 2006 and was completed in June 2007. Phase 2 of
the project was delayed for one year and combined with Phase 3 after the City
was able to secure a California Coastal Commission Permit to perform the work.
In 2007 the City was awarded a grant from the Wildlife Conservation Board
(V11CB) in the amount of $200,000 for the deck rehabilitation project. The grant
contains many stipulations and detailed regulations including an official lease of
the Pier to the State fora 25 year period.
This grant was initially to be used during Phase 2, however, Coastal Commission
permitting requirements and the WCB previously halting all grant payments have
delayed the ability of the City to be reimbursed through this grant. The Grant
agreement between the WCB and the City will lapse on June 30, 2009. The

WCB drafted Amendment No. 1 which extends the expiration date from June 30,
2009 to June 30, 2010. The City plans to seek reimbursement from the WCB
after final completion and retention release of the Pier Deck Rehabilitation
Project, Phases II & III No. 50217, which is expected by the end of summer,
2009.
FISCAL IMPACT:
There is no fiscal impact at this time, however; the grant program requires a 50%
City match from City funds. This match has already been fulfilled in the
completed City Phase II & III Project No 50217.
RECOMMENDATION:
It is recommended that City Council adopt Resolution No. 5881 approving the
attached agreement Amendment No. 1 with the Wildlife Conservation Board of
the State of California regarding replacing the decking on the Seal Beach
Municipal Pier.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEAL BEACH, CALIFORNIA AUTHORIZING AGREEMENT
AMENDMENT NO. 1 FOR PIER DECK REHABILITATION
GRANT WITH THE WILDLIFE CONSERVATION BOARD
EXTENDING EXPIRATION DATE TO JUNE 30, 2010
WHEREAS, the Wildlife Conservation board (WCB) of the State of California
has a program of developing lands for public access to the wildlife resources of
the State; and '
WHEREAS, improving of existing public access facilities at the City of Seal
Beach in the County of Orange, State of California, has been proposed which
would benefit the people of the City of Seal Beach, the County, and the State by
providing for recreational use of our wildlife resources.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH
DOES HEREBY RESOLVE:
Section 1. The City Council hereby authorizes the City Manager to execute the
Agreement Amendment No. 1.

Whereas, due to circumstances beyond their control, the Contractor may not be able to complete
this project by the original termination date of this Agreement (June 30, 2009), and
Whereas, both State and Contractor agree that a time extension is necessary and reasonable for
this project, and
Whereas, the parties agree that a one year time extension for this project is appropriate.
Therefore, the termination date for this Agreement is extended to June 30, 2010.
All other terms and conditions shall remain the same.
