7 Chairperson Voce called the meeting of the Environmental Quality Control Board
8 (EQCB) to order at 6:30 p.m. on Wednesday, April 29, 2009. The meeting was held in

9 City Manager’s Conference Room and began with the Salute to the Flag.

20 with any revisions determined appropriate and forward to the City Council and

25 Member Hurley referred to Paragraph 2, Line 7 of the comment letter on Page 8 of the
26 Staff Report and requested that it read: “. . . regarding potential impacts on the Seal
27 Beach National Wildlife Refuge . . .”

29 Chairperson Voce noted that much methane gas seeping out was a big concern and he
30 is glad to see that the Navy will be working to eliminate this problem.

32 MOTION by Hurley; SECOND by Navarro to authorize Chairman to sign proposed
33 comment letter, as revised and forward to the City Council and Planning Commission
34 for information. Receive and File Staff Report.

2 Chairperson Voce suggested that because Staff is still awaiting a response from the
3 SCAQMD, the discussion should be tabled until the next scheduled meeting, to allow
4 more time to receive a response. Mr. Olivera stated that the Director of Development
5 Services had requested that AQMD provide a flyer or other information related to Rule
6 445 on wood burning fireplaces that could be included as an insert with utility bills. He
7 noted that since this rule was enacted, Staff has received at least two more inquiries
8 about constructing an outdoor fireplace. Mr. Olivera commented that although the
9 AQMD has ruled wood burning fireplaces as illegal people can still purchase an open pit
10 for wood burning at stores like Home Depot. He added that enforcement of this rule
11 may be difficult. Chairperson Voce then commented on how the smoke emanating from
12 the wood burning grills at Hennessy’s Tavern and Walt’s Wharf is affecting the health of
13 its employees and the general population within the Main Street area. He stated that
14 the City should make some kind of statement regarding this concern, as it is an
15 ongoing, daily problem. He indicated that this only adds to the everyday ambient
16 pollutants and is an important quality of life issue. The Board was in agreement to table
17 the discussion until the next scheduled meeting of May 27, 2009.

25 Member Navarro proposed that the City provide electronic copies of the agenda packet
26 on the City website to cut down on the need to drive the packets out to the individual
27 members’ homes and to save on paper. She stated that she would prefer to receive her
28 documentation in this manner. Member Barton said that she would have a difficult time
29 reading all of the documents online, and Member Hurley noted that he does not own a
30 computer. Mr. Olivera stated that most agencies now provide electronic copies of
31 documentation, or one can request electronic copies. He indicated that the committee
32 to redesign the City’s website recently met to discuss ideas for updating the site to
33 make it more “user friendly.” The Members discussed ideas for upgrades.

35 Member Hurley asked if there are any legal penalties for not meeting the proposed
36 numbers as set in AB32 and SB 375. Mr. Olivera stated that there are penalties if
37 counties and cities do not attempt to address the issue of greenhouse gases. Member
38 Hurley stated that this is state law and applies to state actions. He asked how the state
39 proposes to regulate itself.

41 Member Barton asked if the EQCB will be reviewing the proposed project at 1300
42 Pacific Coast Highway (Chevron Station). Mr. Olivera stated that the Board would
43 discuss IS/MND 09-2 for this project at the next scheduled meeting.
