After closing of the public hearing, adopt Resolution No. 5898, A Resolution of the City Council of the City of Seal Beach Establishing Fees and Charges for Goods, Services and Facilities Provided by the City of Seal Beach and Superseding Resolution Numbers 5783, 5800, and 5863. SACICGROt.9N®: On September 8, 2008 the City Council adopted Resolution Number 5783, establishing fees and charges for goods, services and facilities provided by the City of Seal Beach. Additional revisions to the fee resolutions were adopted pursuant to Resolution Number 5800 on October 13, 2008 and Resolution. Number 5863 on April 27, 2009. As part of the general fee revision process of the City, certain revisions to the fees and charges established by Resolution 5783, 5800, and 5863 are requested for adoption by the City Council. Provided below is a general summary of the requested fee revisions. Provided as Attachment 1 is proposed Resolution No. 5898, which sets forth the fees for all city-provided services, including the requested fee revisions discussed below. Provided as Attachment 2 is a compilation of the requested revisions provided in a strikethrough/underline version to clearly indicate the requested revisions to the current fee resolution. Agenda Item U Page 2 The Council will consider adopting the following amendments to the current fees: SECTION 2. BlJILDING FEES: ^ New fee, Section 2, Building Fees, Sub-section B.6., Miscellaneous Fees, establish a new sub-section O., Standard Residential Photo-Voltaic Installation fee. Fee is proposed to be established at $325.00 in accordance with the recommendations of the Sierra Club and the Building Official. SECTION 3. PLANNING FEES: ^ Annual Adjustment, Section, Planning Fees, Sub-sections C and D, Transportation Facilities & Programs Development Fees and Transportation Facilities & Programs Development Application Fees, proposed to be increased by 3.4% in accordance with the provisions of City Council Resolution No. 4405, adopted August 14, 1995. SECTION 4. POLICE FEES: ^ Deleted and Revised Fees, Section 4, Police Fees, Section A, Alarm System Application Fees, Sub-section A.1, Direct Alarm System Application Fee, proposed to be deleted as the City does not have any direct alarm connections from permit holders and establish a new "Indirect Alarm -Business Permit at $35.00. The current Indirect Alarm Application Fee of $25.00 would be applicable to residential permits. ^ New, Deleted and Revised Fees, Section 4, Police Fees, Section H, Photographs, Deletion of current Sub-section H.1, proposed to be replaced with a new Sub-section H.1, Digital reprints or digitally scanned photos, and new sub-section H.2, Digital audio file reproduction (currently Section M) proposed to be increased from $25.00 to $40.00 to reflect increased personnel and supply costs in providing such files; New sub- section H.3, Video reproduction, proposed to be established at $40.00 to reflect personnel and supply costs in providing such files as police vehicles will now be equipped with new in-car video recording systems. Current sub-section H.3 to be renumbered to Section H.4. ^ Revised Fees, Section 4, Police Fees, Section J, Vehicle Storage, Sub- section J.1, Copy of signed vehicle storage release form, proposed to be increased from $50.00 to $80.00 to reflect increased administrative personnel and overhead costs in providing such documents; revised sub- section J.2, Copy of signed vehicle impound release form associated with a 30 day impound, proposed to be increased from $150.00 to $180.00 to reflect increased administrative personnel and overhead costs in providing such documents. Page 3 ^ Revised Fees, Section 4, Police Fees, Section L, Parking Violation Fees, Include fee schedule for specified California Vehicle Code violations to be proposed to be increased from $35.00 to $40.00 pursuant to SB 1407. ^ New Fee, Section 4, Police Fees, Section M, Public Ride Along, proposed to be established at $20.00 to cover the administrative, personnel and criminal history inquiries fbr persons approved fora "ride along" in a police vehicle. ^ New Fee, Section 4, Police Fees, Section N, Firearm Safe Keeping Storage, proposed to be established at $65.00 per 6 months to cover the administrative and CLETS required overhead costs for such firearm storage. ^ New Fee, Section 4, Police Fees, Section O, Booking Fee, proposed to be established under California Government Code (CGC) 29550.3 at $254.00, to cover the administrative costs to book an arrested person and levied upon conviction. SECTION 5. PUBLIC WORKS FEES: ^ Annual Adjustment, Section 5, Public Works Fees, Sub-section F.3, Sewer Service Connection Charge - "Buy In", proposed to be increased by 3.4% in accordance with the provisions of City Council Resolution No. 5349, adopted June 13, 2005. ^ Annual Adjustment, Section 5, Public Works Fees, Sub-section G.8, New Water Service Connection Charge - "Buy In", proposed to be increased by 3.4% in accordance with the provisions of City Council Resolution No. 5349, adopted June 13, 2005. SECTION 8. WATER USE BILLING FEES: ^ New Fee, Section 8, Water Use/Billing Fees, add a note for subsection 3, Water Turn On Fee, establishing an "after hour turn on fee (after 5 PM)", of $150.00. All other fees will remain the same for fiscal year 2008/09 as previously established by City Council Resolution 5783, 5800, and 5863. Staff is continuing to research the fees for special event activities in regards to concerns expressed by the City Council regarding the College Park East Neighborhood Association and anticipates returning at a future City Council meeting with additional recommendations on this concern.
