The City has received a request from the appellant, Rocky Gentner, #o continue this
matter to the next available City Council Meeting. (E-mail request attached)
The next available City Council Meeting is Monday, August 10, 2009.
Staff recommends that the City Council open the public hearing and continue to
August 10, 2009 at the request of the appellant. No additional mailed notice is
necessary if the public hearing is opened and continued to a date certain.
If persons are in attendance tonight to speak to the public hearing matters and
cannot return on August 10 to submit testimony, those persons can provide their
testimony after the public hearing has been opened, and then the Council is
requested to continue the public hearings until August 10, 2009. At that time staff will
present the formal Staff Reports, and the appellant will be available to present
testimony on the matter.

Lee,
As per our conversation, today, we are formally requesting that the Appeal of the
Planning Commission ruling from June 3, 2009; relative to the proposed houses
at 124, 126, 202, and 204 10th Street be postponed until the August City Council
meeting.
We are scheduled to be out of town and will be pushed to return early to comply
with the July 13, 2009 scheduled date.
understand that there will not need to be any additional mailing(s), or fees,
associated with rescheduling.
Anything that you and Jerry can do to help the City Council understand that our
request is not impacted by Measure Z and is within the parameters of the current
building code will be greatly appreciated.
Thanks you for your attention to this and for you and your staffs' consideration.
Please let me know the August date when you have time.
