HomeMy WebLinkAboutCC Res 5896 2009-07-13RESOLUTION NUMBER 5896 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA REQUESTING THAT THE ORANGE COUNTY TRANSPORTATION AUTHORITY ALLOCATE COMBINED TRANSPORTATION PROGRAM FUNDS FOR SEAL BEACH/LOS ALAMITOS BLVD BETWEEN PACIFIC COAST HIGHWAY AND CERRITOS AVENUE WHEREAS, Orange County Transportation Authority approved a Combined Transportation Funding Program (CTFP) for fiscal year 08-09; and WHEREAS, the program includes $190,553.86 in fiscal year 08-09 for a Signal Improvement Project (03-LSAL-SIP-1177) and $50,000 in Growth Management Area (08-SBCH-GMA-2891) on Seal Beach/Los Alamitos Blvd between Pacific Coast Highway and Cerritos Ave; and WHEREAS, the City Council of the City of Seal Beach has adopted a General Plan Circulation Element which does not preclude implementation of the MPAH within its jurisdiction, and; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. That the Seal Beach City Council requests the Orange County Transportation Authority allocate $240,553.86 of CTFP funds from the Signal Improvement Program for construction of said project to the City of Seal Beach. This request is in conformance with the CTFP allocation process and does not exceed ninety (90%) percent of the programmed amount or ninety (90%) percent of the construction contract. Section 2. That the Seal Beach City Council, agrees to fund its share of the improvement costs of the above indicated fiscal year and any additional costs over the identified programmed amount. Section 3. That the Seal Beach City Council has awarded the contract for the project on August 13, 2008 for $239,800. Section 4. That the City of Seal Beach has designed the project improvements, and completed required preparatory work in accordance with the standards required by the City of Seal Beach and other affected jurisdictions involved with said project. Section 5. That the remaining ten (10%) percent in CTFP funds will be transferred to the City of Seal Beach when construction is completed and a Final Report on the project is accepted by the Orange County Transportation Authority. The Seal Beach City Council agrees to submit the final report to the Orange County Transportation Authority within one hundred twenty (120) days after the City's acceptance of the improvements.
