Councilmember Hastings clarified that her statement with regard to the cablecasting had been that it was a Council action, that she had not been consulted, and she had felt it should have been televised. Mr. Stark questioned how there could be a Council action without having three persons take the action. Mr. Charles Antos, 17th Street, said since the court action on the Housing Element and Mola plan are concluded, the revisions to the Housing Element prepared by the Committee should now be brought forward to the Planning Commission for action. He also asked if the status of non-profit organizations that the city is about to have dealings with have been verified with the State. Ms. Reva Olson, Seal Beach, asked if the Redevelopment Agency meetings could also be cablecast. Mayor Laszlo indicated the request could be presented to the Cable Foundation. There being no further comments, Mayor Laszlo declared Oral Communications closed. CLOSED SESSION No Closed Session was held. Ye , c1ey e k Ci of Seal Beach Seal Beach, California March 23, 1992 The City Council of the City of Seal Beach met in regular session at 7:00 p.m. with Mayor Laszlo calling the meeting to order with the Salute to the Flag. 3-23-92 ROLL CALL Present: Mayor Laszlo Councilmembers Doane, Forsythe, Hastings, Wilson-Sharp Absent: None Also present: Mr. Bankston, City Manager Mr. Barrow, Assistant City Attorney Mr. Whittenberg, Director of Development Services Mrs. Yeo, City Clerk I WAIVER OF FULL READING Hastings moved, second by Forsythe, to waive the reading in full of all ordinances and resolutions and that consent to the waiver of reading shall be deemed to be given by all Councilmembers after reading of the title unless specific request is made at that time for the reading of such ordinance or resolution. AYES: Doane, Forsythe, Hastings, Laszlo, Wilson-Sharp None Motion carried NOES: ORAL COMMUNICATIONS Mayor Laszlo declared Oral Communications open. Mr. Bruce stark, Seal Beach, expressed his complaint regarding the use of leaf blowers while playing a background recording of the noise generated by the blowers on a recent morning at approximately 8:30 a.m. in the vicinity of his residence, and stated that ridding the City of leaf blowers is long overdue. Mr. Charles Antos, 328 - 17th street, mentioned prior question of the status I of certain groups and organizations that the City has dealt with and inquired when a report from staff would be forthcoming. He said based upon the budget and lack of funds it would seem that depending upon the validity of the status of some groups and organizations some that have used City facilities may need to be billed for prior use and those that have received city funds will need to return those funds. The City Manager responded that there has been some verbal communication with the Secretary of State's office, that a request for printed information has not yet been received, however indicated that in instances where the city makes a contribution or provides financial support to a group or organization it would be prudent for that organization to the duly chartered. Mr. Antos said at such time as the report from staff is presented he would likely request that a policy be developed relating to dealings with groups and organizations. Mr. Joe Orsini, Seal Beach, extended an invitation to visit the Parker Art Gallery on Main Street the following evening to meet Andy Hopwood, candidate for the 32nd Congressional District. There being no further comments, Mayor Laszlo declared Oral Communications closed. PRESENTATION Resolution Number 4133 was presented to Council and read in full by Mayor Laszlo entitled "A RESOLUTION OF THE CITY OF SEAL BEACH I RECOGNIZING AND HONORING LOS ALAMITOS HIGH SCHOOL CIF CHAMPION SOCCER TEAM." Mayor Laszlo provided a brief overview of the accomplishments of the Los Alamitos Soccer Team that led to their first CIF Southern Section 2A Division Championship in the thirteen years the sport has been played at Los Alamitos High School. I, .-.., '.' 3-23-92 The Head Coach, Jerry stowell, and the Assistant Coach, Junior Dantas, were introduced, they in turn introduced the individual members of the Soccer Team who were each provided with a copy of Resolution Number 4133 by Mayor Laszlo. PROCLAMATION Mayor Laszlo proclaimed Saturday, April 4, 1992 as "Health Fair Expo Day" to be held in the Rossmoor Shopping Center. COUNCIL ITEMS ANNOUNCEMENTS Councilmember Forsythe announced that the Seal Beach Animal Care Center Telethon, the first telethon on local cable, raised over $5400. She invited persons interested in adopting a dog to contact the Center, and noted that the Friends of the Shelter have made the effort to ensure that the animals are disciplined before they leave the Shelter. She reported the Seal Beach Play Group recently presented a check in the amount of $2000 to the city for replacement of equipment at Marina Park, the Womens Club donated $50 as well, noted that a special 'fund has been established to receive donations for that purpose, and recognized Play Group parents Susie Barembaum and Debbie Edwards for their efforts, as well as the Instructor, Tina Stephenson, who was recently awarded the California Council of Parent Participation Nursery School Teacher/Director Award for her significant contributions to the statewide parent participation nursery school movement. Councilmember Forsythe noted also that the Lions and Lionesses recently donated $200 to a Graffiti Removal Fund, and urged all persons observing graffiti, or persons that may be thought to have questionable intents in that regard, to make a report to the Police Department, thereafter City personnel will evaluate the particular display and crews will be dispatched for removal of same, however pointed out that where graffiti is placed on private property a release will be necessary from the property owner. She mentioned a recent robbery incident on the municipal pier and again urged that the police Department be contacted where something or someone may appear to be questionable. Councilmember Forsythe announced the Gum Grove Park Nature Park Day on Sunday, March 29th commencing at 9:30 a.m. and featuring various activities throughout the day. MISCELLANEOUS Councilmember Hastings extended congratulations to Mr. Rich Harbour, Harbour Surfboards, on his thirtieth year in business, the oldest, consecutively owned and operated business on Main Street. She mentioned receiving calls from Old Town residents commending the Police Department, a foot patrol attired in casual clothing, for the manner in which the March 17th celebration was handled. Councilmember Hastings asked if an ordinance could be developed against panhandling, which she said is becoming more common on Main Street, impacting the local businesses. The Assistant city Attorney responded that a number of cities have attempted regulation of panhandling however there are certain constitutional implications, that there have been a number of cases on this issue, some having gone to the Supreme court, and offered to provide a report relating to those cases upon direction from the Council. Mr. Sol JOhn, sixty year resident, relayed his observations of persons coming into the city at all hours of the day and night, and urged that people contact the Police Department when situations of question are observed. Councilmember Hastings inquired as to the status of the ordinances to limit the number of persons at public events and prohibition of live entertainment on Main street, and in view of the resolution of the Mola lawsuits to this point suggested that the Hellman Specific Plan submitted by that Committee be brought forward and acted upon and the Hellman property be rezoned. She 3-23-92 noted that there are drug activities taking place beneath the pier to which she suggested that possibly a police and canine foot patrol be reactivated to cover the pier and the restroom areas. SCAG REPORT Mayor Laszlo made reference to an Aviation Impact Analysis prepared for the City by Aires Associates relating to the Bixby Old Ranch Project and homes proposed homes on the Bixby Golf Course, the report recently released to the interested parties for comments, specifically the Bixby Company and the Los Alamitos Air station, the report addressing the existing airfield operations, the disaster support area, noise, hazardous materials, aircraft accidents, transportation, circulation, etc. He reported the current development proposal consists of one hundred sixty-eight homes on one hundred twenty-five acres, a two hundred twelve acre golf course, one hundred to one hundred twenty-five dwelling units for low and moderate income housing on the northwest corner of the golf course, and a one hundred eighty room hotel with one hundred nine parking spaces on the prior Arco site adjacent to Seal Beach Boulevard. Mayor Laszlo said the report indicates that construction of one hundred forty-three of the one hundred sixty-eight homes would be unacceptable, the report, prepared in accordance with the California Environmental Quality Act, states that the mission of the airfield is to provide support for the Armed Forces Reserve Center, also functions as a federal and state Disaster Support Area in the event of an earthquake or other disaster, the Los Alamitos site being one of two DSA's in California. He noted there were 47,349 operations at the Base last year, however certain environmental documents indicate that 127,000 are allowed, that the estimated CNEL for the project area is greater than sixty-five decibels; the ambient contour estimates noise levels between sixty-five to seventy-five decibels for the project area, the report stated also that the Orange County Airport Land Use Commission categorizes aircraft noise exposures by noise impact zones, that Zone One, anything above 65 CNEL, is unacceptable for residential. Mayor Laszlo said meters were used to measure noise levels for certain areas of the proposed project, reflecting 65.8 to 66.1 CNEL, and if there were an increase of flights approximately 70 CNEL could be realized, also stated that 89 CNEL is generated by a helicopter flight and there are 60,000 flights per year, thus the report indicates that the Airport Land Use Commission would likely deny one hundred forty-three of the proposed homes. Mayor Laszlo noted his involvement with the Southern California Association of Governments Aviation Workshop Committee as the Orange County representative, that Committee investigating airport sites, and referred to a Military Airbase contingency Study Which in part sets forth the criteria to be used for the closure of bases, specifically under consideration is the El Toro Marine Base, March Airforce Base, Los Alamitos Armed Forces Reserve Center, and the Pt. Magu Naval Air station, and said the City should be aware that should the military leave any of these bases the area would be used for commercial aviation. He also read portions of a letter from a 1988 congressional candidate supporting general aviation at the Los Alamitos site. BOARDS and COMMISSIONS Beach Commission councilman Doane moved to appoint Mr. Tom Lyon as the District Five representative to the Beach Commission for the unexpired term ending July, 1993. Adopted Ord~nance Number ~51 ent~tled "AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, REVISING REGULATIONS PERTAINING TO FOOD HANDLING BUSINESSES AND HEALTH SERVICE FEES." Accepted the resignation of Mr. George Brown as the District Two representative to the Beach Commission for the unexpired term ending July, 1993. ~. Adopted Policy statement ~01, allowing an administrative waiver of off-street parking requirements for commercial/industrial developments which are less than one-half parking space of complying with the required number of off-street parking spaces, when based on gross floor area of the structure. N. Authorized an Amendment to the Agreement between the County of Orange and the City of Seal Beach for fire services by extending the Agreement an additional twelve months from July 1, 1992 to July 1, 1993. AYES: Doane, Forsythe, Hastings, Laszlo, I Wilson-Sharp NOES: None Motion carried ITEMS REMOVED FROM THE CONSENT CALENDAR ITEM "L" - GENERAL PLAN - COMPREHENSIVE UPDATE PROCESS Councilmember Forsythe inquired if the proposed Assembly Bill relating to microzonation of seismic safety had been passed. The Director of Development Services confirmed that it had and offered that the State would be developing guidelines for participation in that program, however those guidelines have not as yet been provided, and noted that seismic issues would be 3-23-92 included within the Safety Element of the General Plan. With regard to amendments of General Plan Elements to accommodate the Mola development, he reported his belief that they were the Land Use and Circulation Elements which accommodated the proposed single family residential units as opposed to the current designation for a combination of single family and condominium units, also a connection street from Seal Beach Boulevard to I Pacific Coast Highway. He explained that the Housing Element would be amended at minimum to include the 1990 census information that was not available when the current Element was adopted, also the changes proposed by the Housing Element Review Committee have been submitted to the City Attorney's office and forwarded to the State Department of Housing and Community Development. Councilmember Hastings stated she had forwarded the Committee recommendations to the State H/CD office for their review, and through conversations their suggestions were sought as to changes or additions that could be considered and whereby compliance with State requirements would be realized. Forsythe moved, second by Hastings, to approve the proposed Seal Beach General Plan Comprehensive Update Process. AYES: Doane, Forsythe, Hastings, Laszlo, Wilson-Sharp None Motion carried NOES: ITEM "M" - CONTRACT EXTENSION - AMBULANCE SERVICE Mayor Laszlo inquired as to ~he ambulance service charges. The City Manager reported the charges are consistent with the rates throughout the County and other ambulance companies, the County Department of Health, Emergency Medical Services, the agency that conducts hearings and establishes the rates, and noted that those I rates are accepted by Medicare. He offered to provide a breakdown of the various charges if desired. The Manager advised that the bid proposal of four years ago provided for an assessment of service performance upon the fourth year of the contract, reported that Medix has met or exceeded the performance standards, that fact confirmed by the Orange County Fire Department, therefore there is the one-time option to extend the ambulance service contract for an additional term of four years. Laszlo moved, second by Doane, to approve the extension of the contract with Medix Ambulance Company under the one-time extension provisions of the current contract. NOES: Doane, Forsythe, Hastings, Laszlo, Wilson-Sharp None Motion carried AYES: COUNCIL CONCERNS Councilman Doane noted his continuing attendance and evaluation of the various City Boards and Commissions, as is Councilman- elect Brown. He noted however that the Beach Commission appear to be having some problems as a result of lack of direction, and suggested that since there have been a number of recent resignations and appointments to that Committee, that each'member be made aware of their duties through Ordinance Number 1313 that estabiished the Commission. He commended the many persons who I are serving the community on the various groups, and noted that the City Manager will be providing further clarification of the duties and responsibilities of the boards and commissions, which may provide an opportunity to combine some of the duties and reduce the number of committees. Councilmember Hastings reported the city Manager, Mayor, herself, Planning Commissioner Orsini, and Mr. Chi Kredell will meet with the Army Corps of Engineers and Congressman Rohrabacher on April 6th at 9:30 a.m., and asked that the Beach Commission be invited to attend in order to share information that they had received from Scripps Institute. The City Manager noted that the Corps has been scheduled to meet with I I, I ; I. " " " 3-23-92/4-7-92 the Beach Commission on March 31st and unless that body were to adjourn to April 6th there would be a violation of the Brown Act, therefore it would be more appropriate to simply make the commission aware of the meeting. Mayor Laszlo again noted that the Aviation Report indicates that one hundred forty-three of the homes proposed by the Bixby company would not be feasible to be built. Councilmember Wilson inquired as to the status of the alcohol use ordinance for special events. The City Manager noted that the ordinance had received first reading, that the City Attorney had been directed to research the feasibility of an attendance limit, the result of which has been received, and indicated his preference to present a special event policy, which is nearing completion, in conjunction with the proposed ordinance, the two documents to work in concert.
