Recalling past discussions, Councilmember Hastings requested that revised personnel rules and whistle-blower legislation be developed for Council consideration. Mayor Forsythe commended the efforts of those who conducted the recent Rough Water Swim, also the Lions Club activities that raised over I $10,000, the benefit of which will come back to the community. She reported contributions are continuing to the pier repair fund, a rummage sale and a comedy night being upcoming fund raising efforts of two local groups also for that purpose. ORAL COMMUNICATIONS Mayor Forsythe declared Oral Communications open. Mr. Charles Antos, 328 - 17th Street, suggested that Orange County campaign regulations be obtained and reviewed for application to Seal Beach. Ms. Reva Olson, Seal Beach, said the book entitled Money and Politics referred to by Councilman Laszlo was authored by Robert Stearn, and suggested that any local ordinance considered be reviewed by him as an authority on campaign reform. She praised the Orange County campaign regulations, and reported a number of groups in Orange County are banding together to promote a similar State initiative for campaign finance reform. Ms. Norma Strohmeir, Seal Beach, spoke in support of the Peace and Dignity Journey run through Seal Beach, expressed appreciation to those who resolved the noise problem in the area of her residence on Seal Beach Boulevard, and spoke highly of the new rock and shell business on Main Street. There being no further comments, Mayor Forsythe declared Oral Communications closed. CLOSED SESSION No Closed Session was held. Present: Mayor Forsythe Councilmembers Brown, Doane, Hastings, Laszlo Absent: None Also present: Mr. Bankston, city Manager Mr. Barrow, City Attorney Mrs. Yeo, City Clerk WAIVER OF FULL READING Hastings moved, second by Doane, to waive the reading in full of all ordinances and resolutions and that consent to the waiver of reading shall be deemed to be given by all councilmembers after reading of the title unless specific request is made at that time for the reading of such ordinance or resolution. AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried ORAL COMMUNICATIONS Mayor Forsythe declared Oral Communications open. Ms. Norma Strohmeier, Seal Beach, advised the Council that the vacant lot adjacent to the apartments on Seal Beach Boulevard has recently been usurped by a truck, trailer, and old vehicles, this the result of a citizen having informed the residents of the apartments that they could not park their vehicles on the vacant lot, and the ownership of the lot is unknown. She said the residents and manager of the apartments should not be held responsible for this problem, and asked that the City look into the situation. Mr. Bill Ayres, 707 Central Avenue, expressed his views to what he deemed to be an over-population of drinking and liquor establishments in the small geographical area of Old Town, Claiming the residue of such activities creates drunkenness, unacceptable behavior, damage to public and private property, impacting the quality of life, and a substantial profit to the business establishment through the sale of liquor from which the city realizes nearly nothing. Mr. Ayres suggested drunk driving checkpoints in the downtown area, a foot patrol of the neighborhoods, no promotion of additional drinking establishments, and the use of caution in allowing certain activities in Old Town that often attracts problem people. Mr. Mario Voce, 730 Catalina Avenue, extended appreciation to Mayor Forsythe, the City Manager, City personnel, a number of citizens and participants for their efforts to make the 1992 Peace and Dignity Journey a success as it passed through this community. Ms. Reva Olson, Seal Beach, expressed appreciation to Mr. Voce, the participants, and the community as well. Mr. Bruce Stark, Seal Beach, agreed with the comments of Mr. Ayres. Noting the / 8-10-92 impact of the state on the City budget, Mr. stark suggested a ten to fifteen percent pay reduction for department heads, as well as a ballot measure for the direct election of the city attorney, as means of reducing city costs. There being no further comments, Mayor Forsythe declared Oral Communications closed. PROCLAMATIONS I Mayor Forsythe proclaimed Saturday, August 15th, 1992 as "Volunteer Firefighter Recognition Day." Volunteer Captain Joe Kalmick accepted the proclamation with appreciation, noted there are six hundred thirty-two men and women volunteers in the Orange County Fire contingent with nearly thirty in Seal Beach. Captain Kalmick announced the passing of former Seal Beach Fire Chief Ron Adams. Mayor Forsythe proclaimed August 22nd, 1992 as "Homeless Animals Day." APPOINTMENTS - BOARDS and COMMISSIONS Mayor Forsythe requested that the District Three appointments to the civil Service Board, Project Area Committee, and Seal Beach Administration Building Authority be held over until the second meeting in September. Councilman Laszlo likewise requested that the District Four appointments to the Seal Beach Administration Building Authority and the Local Coastal Program Committee be held over. CONSENT CALENDAR - ITEMS "D" throuah "P" Mayor Forsythe noted the request of staff that Items "0" and "P" be removed from the Consent Calendar, a member of the audience requested Item "D" removed, and the Mayor requested Item "I" I removed. Hastings moved, second by Brown, to approve the recommended action for items on the Consent Calendar, except Items "D, I, 0, and P," as presented. E. Approved the minutes of the July 27, 1992 regular meeting. F. Adopted Ordinance Number 1356 entitled "AN ORDINANCE OF THE CITY OF SEAL BEACH RELATING TO THE LIMITATIONS PERIOD FOR CHALLENGING THE ADMINISTRATIVE OR QUASI-JUDICIAL ACTIONS OF THE CITY OF SEAL BEACH AND AMENDING THE SEAL BEACH MUNICIPAL CODE." Mayor Forsythe responded that the three entries reflect the various types of legal services, in addition advised of her request for a breakdown of legal costs directly related to Mr. Stark's property on Central Avenue, preliminarily estimated to be $7,000. Brown moved, second by Doane, to approve the regular demands numbered 88699 through 88829 in the amount of $492,948.01 and payroll demands numbered 51134 through 51322 in the amount of $301,215.56 as approved by the Finance Committee, and authorized warrants to be drawn on the Treasury. AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried ITEM "I" - RESOLUTION NUMBER 4170 - MAINTENANCE AGREEMENT 1 STATE HIGHWAYS Mayor Forsythe mentioned the need for improvements to the intersections along Pacific Coast Highway, specifically at 12th 8-10-92 street where the north/south traffic flow has increased over the years and a study of a three-way signal may be warranted, however expressed concern with requesting such study given the annual maximum authorized reimbursement figure of $10,000. The City Manager explained that the subject agreement is specific to maintenance of the highway, and that major improvement projects would be dealt with under a separate agreement with CalTrans, the I increase of the reimbursement from $2,000 to $10,000 merely allows for a more realistic reimbursement of the maintenance costs without having to seek additional CalTrans approvals. The Mayor also mentioned the need for roadway repair on the San Gabriel River bridge. Councilmember Hastings also pointed out the use of the 12th Street/Pacific Coast Highway intersection by many McGaugh School students. Hastings moved, second by Forsythe, to adopt Resolution number 4170 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, APPROVING AN AGREEMENT FOR MAINTENANCE OF STATE HIGHWAYS IN THE CITY OF SEAL BEACH." Assistant Chief Hennessy, Orange County Fire Department, explained that the primary difference between the 1988 and 1991 Fire Code relates to identification of I hazardous waste materials and adoption of more current fire standards, updating the reference material technology primarily with regard to enforcement activity. Hastings moved, second by Doane, to adopt Ordinance Number 1359 entitled "AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, ADOPTING BY REFERENCE THE UNIFORM FIRE CODE, 1991 EDITION, AND AMENDMENTS THERETO, AMENDING PORTIONS OF CHAPTER 5 AND DELETING CHAPTER 9 OF THE CODE OF THE CITY OF SEAL BEACH AND DECLARING THE URGENCY THEREOF." AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried I STATE BUDGET UPDATE The City Manager reported the most recent budget proposal failed to garner the required two-thirds vote for approval, the concern now is that action could be taken to adopt a budget proposal without due consideration and study. He noted that SB 617 and SB 844, budget trailer bills, are to be acted upon tomorrow, those bills somewhat clouding the AB8 take-away and focusing on redevelopment funds, the League in opposition to both SB 617 and SB 844. He advised that it is unlikely there will be a State I I I 8-10-92/8-24-92 budget for at least another ten days. The Manager reported most banks are no longer accepting state IOU's, that to date the city has received only its sales tax revenue in the form of an IOU, other subventions being withheld at this time, noting an ultimate impact the City's cash flow unless the state budget is acted upon by late September to mid-October. He also confirmed that capital and a number of other expenditures are being held in abeyance, travel and meeting expenses eliminated, programs postponed, etc., in anticipation of the budget shortfall. Mayor Forsythe reported that a number of residents have submitted some worthwhile ideas relating to the budget crisis issue. COUNCIL CONCERNS Councilmember Hastings announced the upcoming Comedy Night sponsored by the Save Our pier Group to benefit the pier restoration. Councilman Laszlo reported receipt of a letter from a doctor in Golden Valley, Minnesota, expressing appreciation to the Seal Beach Lifeguards and paramedics for their assistance as a result of an incident that occurred in the surf off of Seal Beach. Councilman Laszlo also made reference to a recent news article reporting a SCAG projection of six million more people in California by the year 2000 creating a need for one million more housing units. Councilman Doane offered a quote of Supervisor Wieder at a recent Chamber breakfast relating to problems associated with the State budget, that 'Republicans are being Republicans and Democrats are being Democrats and none of them are being legislators.'
