HomeMy WebLinkAboutCC Min 1992-11-23 11-23-92 Seal Beach, California November 23, 1992 The City Council of the City of Seal Beach met in regular adjourned session at 6:00 p.m. with Mayor Forsythe calling the meeting to order with the Salute to the Flag. ROLL CALL Present: I Mayor Forsythe Councilmembers Brown, Doane, Hastings, Laszlo Absent: None Also present: Mr. Bankston, City Manager Mr. Barrow, City Attorney Mrs. Yeo, City Clerk CLOSED SESSION The City Attorney announced that the City Council would meet in Closed Session pursuant to Government Code Section 54956.9(a) to discuss pending litigation in the Mola versus City of Seal Beach case. It was the consensus of the Council to adjourn to Closed Session at 6:03 p.m. The Council reconvened at 6:47 p.m. with Mayor Forsythe calling the meeting to order. The city Attorney reported that the Council had discussed the matter previously announced and that no action had been taken. ROLL CALL Present: Mayor Forsythe Councilmembers Brown, Doane, Hastings, Laszlo Absent: None I I I 11-23-92 Also present: Mr. Bankston, city Manager Mr. Barrow, city Attorney Mr. Whittenberg, Director of Development Services Mrs. Yeo, City Clerk WAIVER OF FULL READING Laszlo moved, second by Hastings, to waive the reading in full of all ordinances and resolutions and that consent to the waiver of reading shall be deemed to be given by all Councilmembers after reading of the title unless specific request is made at that time for the reading of such ordinance or resolution. AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried ORAL COMMUNICATIONS There were no Oral Communications. PRESENTATION Detective Jay Johnson, on behalf of the Seal Beach Police Officers Association, presented a check in the amount of $1,000 to the Pier Repair Fund. Mayor Forsythe and members of the Council expressed appreciation to Detective Johnson and the Association for the donation. RESOLUTION NUMBER 4191 - ARCHAEOLOGICAL ADVISORY COMMITTEE MEMBERSHIP - AMENDING RESOLUTION 4186 Resolution Number 4191 was presented to Council entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, AMENDING RESOLUTION 4186, EXPANDING THE MEMBERSHIP OF THE ARCHAEOLOGICAL ADVISORY COMMITTEE TO TEN MEMBERS." By unanimous consent, full reading of Resolution Number 4191 was waived. Some concern was expressed with the expanded membership as well as with the ability to attract interested persons during the holiday season. Councilmember Hastings noted that the intent of the increased membership was to allow a continuity of attendance and participation in the event of absence. The Director of Development Services said it is anticipated that the request for qualifications for selection of the archaeologist will be before the Council on December 14th, however the site review will likely not commence until-the first of the year. Hastings moved, second by Brown, to adopt Resolution Number 4191 as presented. AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried ARCHAEOLOGICAL COMMITTEE APPOINTMENTS Councilmember Hastings appointed Mr. Bob Cole, 11th Street, as a District One appointee, and Councilman Brown appointed Long Beach resident, Seal Beach professional, Dr. Gilbert Unatin as a District Two appointee. Hastings moved, second by Brown, to confirm the appointments. AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried CONSENT CALENDAR - ITEMS "D" thru "K" Councilmember Hastings requested that Item "H" be removed from the Consent Calendar, and Councilman Laszlo requested Item "E" be removed. By unanimous consent of the Council, a "World AIDS Day" proclamation was added to the Consent Calendar under Item "C". Brown moved, second by Doane, to approve the recommended action for items on the Consent Calendar, except Items "E" and "H", as presented. 11-23-92 D. C. Proclaimed November 16th through November 20th as "winter Weather preparedness Week" and proclaimed December 1, 1992 as "World AIDS Day". Approved regular demands numbered 89744 through 89900 in the amount of $664,105.66 and payroll demands numbered 52421 through 52589 in the amount of $191,529.04 as approved by the Finance Committee, and authorized warrants to be drawn on the Treasury for same. I F. Received and filed the Monthly Investment Report as of October 31, 1992. G. Denied the claim for damages of Mr. Randall Ogden. I. Declared a 1984 Chevrolet Camaro to be surplus and authorized the auction of same. J. Instructed staff to forwarded comments on the Draft Environmental Impact Statement/ Environmental Impact Report for the proposed Bolsa Chica Project to the U. S. Army Corps of Engineers, Los Angeles District Office, and the city of Huntington Beach. Received and filed the status report regarding the Southern california Association of Governments proposed 1993 Regional Comprehensive Plan (RCP). K. I AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried ITEMS REMOVED FROM THE CONSENT CALENDAR ITEM "E" - MINUTES Councilman Laszlo noted his abstention from voting on the minutes as he was absent from the November 9th meeting. Hastings moved, second by Brown, to approve the minutes of the November 9th regular meeting. AYES: NOES: ABSTAIN: Brown, Doane, Forsythe, Hastings None Laszlo Motion carried ITEM "H" - ASSESSMENT - SUBSURFACE CONDITIONS - CITY YARD At the request of Councilmember Hastings, the City Manager explained that monies had previously been appropriated for the purpose of conducting soil tests for contamination from a fuel tank at the City yard, that it has recently been inferred that some contaminants still exist and the Orange County Health Care Agency has requested further soil borings and monitoring wells I for contamination and determination as to whether there has been any intrusion into the water table. He indicated that the source could be the leaking of another tank, from another property, or possibly there was not total cleanup of the previous contamination. He confirmed that groundwater from this area is not being drawn for public consumption. Hastings moved, second by Laszlo, to approve the installation of the additional soil borings and monitoring wells by ECE Services, Inc. in the amount of $13,802.86, and authorized the City Manager to execute said contract on behalf of the City. I I I 11-23-92 AYES: NOES: Brown, Doane, Forsythe, Hastings, Laszlo None Motion carried Mayor Forsythe commended the report and comments of staff to the Draft Environmental Impact Statement/Environmental Impact Report for the proposed Bolsa Chica Project and inquired about a means for public comments. The Director of Development Services reported that the Draft EIS/EIR documents are available for public review in the local libraries, and that public comments may be forwarded to the City of Huntington Beach by the comment deadline, December 3rd. CONTINUED PUBLIC HEARING - REFUSE COLLECTION RATES / RECYCLING PROGRAM Mayor Forsythe noted that the public hearing to consider refuse collection rates had been continued from the October 26th meeting, also the staff request that this item be continued until the next meeting. The Mayor invited public comments at this time. Mr. Mario Voce, Catalina Avenue, suggested that everyone should learn about and practice recycling. The Mayor reported concern has been expressed with regard to the size of the refuse receptacles and specifics of the recycling program. It was the order of the Chair, with consent of the Council, to continue the public hearing regarding refuse collection rates until the next meeting. PUBLIC HEARING - FEES FOR GOOD AND SERVICES Mayor Forsythe declared the public hearing open to consider adjustment of various fees for goods and services. The City Clerk certified that notice of the public hearing had been advertised as required by law, and reported no communications received either for or against this item. It was the order of the Chair, with consent of the Council, to continue this public hearing until the next meeting. COUNCIL CONCERNS Councilman Doane inquired if staff has pursued the concerns previously expressed to the Council by Mr. Tom Lyon, member of the Golden Rain Foundation Board, with regard to the noise and air pollution from the Los Angeles Department of Water and Power Haynes Steam Plant. The City Manager said the issue of air pollution has been researched to the degree of verifying that enforcement power lies within the authority of the Air Quality Management District, the other issues as yet have not been addressed. He reported there has been an effort to schedule a meeting with a representative of Long Beach with regard to noise monitoring, one evident problem being the differences between the acceptable noise levels of the respective city ordinances. Mr. Jerry Dominguez, Edison Company representative, confirmed that there is considerable variation of acceptable noise levels between cities, also noted that safety issues at their facility are dealt with as quickly as possible and such occurrences are much less frequent than in the past. Councilman Brown inquired as to when the Rossmoor Theater issue will again be discussed. The Director of Development Services reported that several alternatives are at the point of being finalized, that cost estimates will be prepared for those, and the issue will likely not be considered again until after the first of the year. Councilman Laszlo expressed appreciation ~o Councilman Doane for the presentation at the recent Orange County League meeting on his behalf which resulted in his reappointment as the representative to the SCAG Aviation Committee. He suggested that consideration be given to having the City'S truck fleet be of one standard brand for cost savings when repairs and maintenance are required. The City Manager confirmed that the suggestion has been looked into however explained that through the bidding process specifications can not be written to benefit a specific 11-23-92/12-14-92 manufacturer, yet it may be possible to identify a class of vehicle. Councilmember Hastings reported on a recent meeting of the Save Our Beach Committee at which Chief Miller and Captain Davis of the Long Beach Marine Department made a presentation ' relating basically to the nearly year old artificial reef off of a portion of the Long Beach coastline. She noted that there is insufficient information at this time to determine if such a reef would aid Seal Beach in its sand erosion problem given the difference in tidal flow and wave action, yet there was a consensus that a means to replenish sand on the east beach must be found. Councilmember Hastings mentioned that a question was raised as to whether the new Long Beach dredge, in conjunction with the Navy barge, could be rented to dredge the San Gabriel River as a source of beach sand. She suggested that more time be given an evaluation of the Long Beach reef prior to a presentation before this City Council. I ORAL COMMUNICATIONS Mayor Forsythe declared Oral Communications open. Mr. Mario Voce, 730 Catalina Avenue, requested that the staff report relating to recycling be forwarded to the Solid Waste Committee for their review and comment. The City Manager noted that the Committee function ceased upon adoption of the Source Reduction/Recycling Element, however offered to meet with the former members and to forward the rate increase report as well. He noted that the concept of the type of recycling program and once versus twice per week refuse collection had been combined with the hearing relating to a refuse rate adjustment for calculation purposes, however indicated those issues could be separated if so desired, also that January 1st is the deadline for adoption of a recycling program. There being no further comments, Mayor Forsythe declared Oral Communications closed. ADJOURNMENT It was the order of the Chair, with consent of the Council, to adjourn the meeting until Monday, December 14th at 6:00 p.m. to meet in Closed Session.
