SUBJECT: NOTICE OF COMPLETION FOR THE 2009 ANNUAL
SLURRY SEAL PROJECT NO. ST0911
SUMMARY OF REQUEST:
The City Council is asked to:
1. Adopt Resolution No. 5919 to formally accept completion of the 2009
Annual Slurry Seal Project No. ST0911.
2. Direct the City Clerk, to file a "Notice of Completion" with the Orange
County Clerk-Recorder within ten (10) days from the date of
acceptance.
3. Direct staff to release retention funds of $6731.61 thirty-five (35) days
from the date of filing of the "Notice of Completion".
SACKGROUN®:
On January 26, 2009, City Counci! awarded a construction contract to Bond
Blacktop, Inc. for $49,817 to repair asphalt and slurry seal selected streets in
Bridgeport including 5th Street and traffic striping. Due to the low bids, additional
streets in Bridgeport were added to the project.
Construction is now completed and the City Engineer has accepted the project.
FINANCIAL IMPACT:
The 08/09 Budget allocated $150,000 of Measure M Turnback funds. A previous
Slurry Seal Project spent $11,497 of this year's allocation of $150,000 on slurry
sealing additional roads in College Park East which leaves a balance of
$138,503 for this project. The net cost for construction is $66,216.09 and
$3,230.00 for inspection totaling to $69,446.09. The remaining balance of

$69,056.91 shall be returned to City's Measure M Turnback funds and may be
designated by the City for other eligible projects.
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt Resolution No. 5919 to formally accept completion of
construction for the 2009 Annual Slurry Seal Project No. ST0911.
2. Direct the City Clerk, to file a "Notice of Completion" with the Orange
County Clerk-Recorder within ten (10) days from the date of
acceptance.

RESOLUTION NUMBER 5919
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL
BEACH, CALIFORNIA DECLARING WORK TO BE COMPLETED
PER CONTRACT DOCUMENTS FOR 2009 ANNUAL SLURRY
SEAL PROJECT N0. ST0911
WHEREAS, on January 26, 2009 the City of Seal Beach entered into a contract
with Bond Blacktop, Inc.; and
WHEREAS, the City Engineer has determined that the work has been
substantially completed in accordance with the contract documents.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH
DOES HEREBY RESOLVE:
Section 1. That the work required to be performed by said Contractor has
been completed.
Section 2. That the total cost of said work is $69,446.09.
Section 3. That the work is hereby accepted and approved.
Section 4. It is further ordered that a "Notice of Completion" be filed on behalf
of the City in the Office of the Orange County Recorder within ten
(10) days of the date of this resolution.

meeting hereof held on the 14th day of September .2009 by the following
