I ROLL CALL Present: Chairman Seitz Agency Members Kredell, Supple, Vanderstaay Absent: Agency Member Laszlo Also present: Mr. Courtemarche, Executive ~irector Mr. Stenpanicich, Assistant City Attorney Mrs. Yeo, Secretary DRAFT COMMUNICATION - ORANGE COUNTY GRAND JURY Agency Member Kredell requested that this item be held over pending receipt of additional information for transmittal with this communi- cation. It was the order of the Chair with consent of the Agency to postpone action on this item until the next regular meeting. I ORAL COMMUNICATIONS Agency Member Supple asked if the Agency wished to consider approval of October 13th minutes at this time. It was the consensus of the Agency to hold this item over to next meeting. Agency Member Kredell requested all members visit the Trailer Park and view the cabanas being constructed. The Agency discussed the number of cabanas being replaced, height limitations and safety factors. Chairman Seitz asked if a moratorium could be placed on construction of two story cabanas pending Planning Commission study and enactment of stricter city regulations. The City Attorney advised State law governs mobile home parks and cabana construction and suggested the city's zoning ordinance may be the most effective control for specific areas and stated he would review State regulations and report his findings to the Agency. The Planning Director affirmed that all permits for cabana construction are considered by the Coastal Commission. ~ordon Shanks, 215 Surf Place, a member of the Local Coastal Program Committee, suggested restrictions for cabana construction could be placed in the Local Coastal Plan. The City Attorney recommended that a legal opinion be prepared and submitted to the Agency prior to imposing a moratorium on cabana construction. Agency Member Seitz requested a copy of the second amendment to the Trailer Park Participation/Disposition Agreement. Chairman Seitz requested the Executive Director obtain a legal opinion from the Agency's Special Legal Council advising whether there would be any liability on the part of the Agency in requesting a Grand Jury Investigation. Christine Agur, Trailer Park resident, spoke regarding cabana plans presented when Park reconstruction was originally 'discussed, that complied with Municipal Code requirements. Jose Osuna, Catalina Avenue, former mobile home inspector, spoke regarding cabana inspection procedures and suggested the city's Building Code be amended to regulate cabana construction. There were no other oral communications; Chairman Seitz declared oral communications closed.
