Roll Call Present: Also Present: Voce, Hood, Hurley, Hotchkiss, Logan Barry Curtis, Administrative Assistant (planning) IV. Old Business 2. DRAFT PUBLIC TREE ORDINANCE Mr. Curtis discussed the proposed draft public tree policy. Mr. Voce questioned the 10 day notification requirement for public tree removal. Mr. Curtis indicated its primarily to allow property owners to respond or object to a proposed public tree removal. Mr. Hurley questioned whether the 10 day period would continue to run if an objection is filed to a proposed removal. Mr. Curtis indicated that the ordinance provides an appeal process and that once an appeal has been filed the 10 day period is halted, except where the City determines an immediate threat to the public health, safety and welfare exists. Mr. Voce suggested the Board attempt to have an arborist at a future meeting to discuss the City's acceptable tree list. Mr. Hood felt the responsibility of the Board should be to consider the public policy aspect of the ordinance. Which trees are appropriate should be determined by City staff Mr. Curtis presented the proposed policy to the Board section by section. EQCB Minutes of September 1, 1992 · Mr. Hurley questioned whether "Historic Trees", "Specimen Trees" and a "Memorial Tree" were basically the same. Mr. Hotchkiss hoped that the selection of such trees would not become a political process where a vocal minority could have the most historic trees in their neighborhood. Mr. Hurley recommended that in C. the following section be removed to reduce the overlapping definitions "because of its age, type or historic associations" . Mr. Hurley asked whether any decision of the EQCB could be appealed to the City Council. . Mr. Hurley suggested that the section on Preservation Policy, fifth line be amended to "removed when the need for its removal outweighs..." . Mr. Hurley requested Landscape Supervisor be capitalized. . Mr. Curtis recommended that the first sentence of Subsection C of Required Planting and Maintenance be amended to read "All such planting shall be done in accordance with the planting specifications' set forth in the Master Street Tree Plan. " . Mr. Hurley requested that the first sentence of Subsection D of Required Planting and Maintenance be amended to read ". . . where judged feasible by the Landscape Supervisor include allowances for planting strips." . Mr. Curtis recommended removal of the final two (2) sentences of Subsection D of Required Planting and Maintenance. . Mr. Voce requested that the final sentence of Subsection E of Required Planting and Maintenance be amended to read ". . . materials or chemicals which would damage or otherwise compromise the health of a tree, is prohibited. " MOTION BY HOOD; SECOND BY HURLEY: TO APPROVE, AS A FIRST READING, THE PROPOSED PUBLIC TREE ORDINANCE AS AMENDED BY THE ENVIRONMENTAL QUALITY CONTROL BOARD AT ITS SEPTEMBER 1, 1992 MEETING. MOTION CARRIED: AYES: NOES: 5-0 VOCE, HOTCHKISS, LOGAN, HOOD, HURLEY V. New Business VI. Board Concerns Mr. Voce indicated that the election of officers should be held in the near future. Staff Concerns Mr. Curtis indicated that the approved ordinance and attachments for the Archaeological Element have been provided to the Board. VIII.
