1. DISCUSSION OF TREE ORDINANCES
Chairman Voce opened the item for discussion.
Mr. Curtis discussed the past tree policy drafted by the City staffin 1985. The policy
proposed in 1985 discussed public trees only.
Chairman Voce discussed the August 1, 1988, staff report which listed City-wide tree
species. He indicated that the Board could instruct staff to review the 1988 listing to
consider water usage and to consider native plant species. Further, he felt the tree policy
from Carmel could be relevant as it pertained to safeguarding trees during construction,
demolition or tree removal.
Mr. Curtis discussed the means by which the City could reasonably govern the
maintenance and removal of trees on both public and private property. He indicated that

the City has virtually total control of public trees and more limited control over private
trees. He discussed means by which the City can monitor and govern the provision and
maintenance of private trees.
Mr. Hood broke down consideration of a tree policy into several subcategories which he
felt would expedite Board discussion of the matter. Mr. Hood's breakdown was as
follows:
1. Public Trees - Street Trees and Park Trees
2. Private Trees
a. New Construction
b. Redevelopment
c. Remodel
d. As is (No Change)
The Board discussed each of the categories and determined that the City could regulate
public trees and private trees in conjunction with new construction and redevelopment of
property on a mandatory basis, while remodels of and no change to private properties
would likely require a passive approach. The Board felt a passive approach would likely
involve the development of tree maintenance guidelines which would be available to the
public. The Board felt that any remodel should require mandatory compliance with tree
policies.
Mr. Curtis indicated that he felt this method would leave a loophole in the sense that a
property owner could remove a tree from his property, then any time thereafter approach
the City with a request to remodel or add onto his dwelling without falling under the
mandatory provisions. Mr. Curtis recommended that the City amend the zoning ordinance
to require some amount of landscaping, fixed or proportionate, and requiring a tree for
every "x" square feet oflandscaped area. Mr. Curtis felt that landscaping and/or trees
required by the zoning ordinance would provide the City greater authority to enforce tree
provisions, staff levels permitting.
Mr. Logan questioned what liability the City might incur if it requires someone to install a
tree on private and the tree ultimately damages the property. Mr. Curtis indicated he
would review this matter with the City Attorney's office.
Mr. Hotchkiss felt that the Board should consider a policy for street trees first, then move
on to private trees at a later date. Further, Mr. Hotchkiss felt the City's enforcement
power relative to private trees will likely be very limited. He recommended that the City
require a permit for private tree removal, so the City could keep a fairly accurate inventory
of trees and at least attempt to maintain a tree balance whereby any trees that are removed
could be replaced at some location throughout the City.
Mr. Voce felt that in some circumstances a tree may not be appropriate due to limited area

and other considerations.
Oral Communications: Ms. Maricich indicated that additional street trees have been
removed since the Board's April 1992 meeting. Further, she felt that an ordinance should
take into account whether a tree scheduled for removal is a mature tree and if it is, a
mature tree should be replaced. Ms. Maricich indicated concern that her neighbors may
cut their trees and that will negatively impact her part of the neighborhood. She opposed
"bricking in" the City's parkway area and urged uniformity of street trees.

8-1-88 TO DRAFT AN ORDINANCE DEALING WITH PUBLIC TREES. ALSO,
THAT STAFF PRESENT A REPORT BACK TO THE BOARD AT ITS JULY 21,
1992, MEETING DISCUSSING THE PROPOSED ORDINANCE AND
PROVIDING A DRAFT VERSION, TIME PERMITTING.

Mr. Hurley requested that Mr. Eagle be in attendance at the Board's next meeting.
VI. Board Concerns
Mr. Voce discussed legislation in Washington re: wetlands. He opposes the Hayes Bill
and favors the Edwards Bill. He informed the Board that there will be a meeting of the
Technical Review Committee to discuss toxic cleanup on June 9th at 1 :00 p.m. at the
Naval Weapons Station's Conference Room.
VI. Staff Concerns
Mr. Curtis recommended that the Board's June 16, 1992, meeting be continued to July 21,
1992, as Mr. Hurley will not be present and staffhas a relatively heavy load for Planning
Commission items.
