ROLL CALL Present: Also Present: Voce, Hood, Hurley, Hotchkiss, Logan (arrived at 6:40) Barry Curtis, Administrative Assistant (planning) IV. ORAL COMMUNICATIONS - none. V. NEW BUSINESS - none. VI. OLD BUSINESS 1. REVIEW OF FINAL DRAFT OF TREE ORDINANCE Mr. Curtis presented the final draft of the public tree ordinance to the Board. Mr. Curtis indicated the draft had recently been returned from the City Attorney's office with minor changes. Mr. Curtis discussed those sections which had been modified since this item was last before the Board. Mr. Hurley presented several minor technical changes which were intended to clarify the text (changes are indicated as CAPITALIZED ITALIC BOLD text in the enclosed ordinance). The most significant concern was removal of the purpose statement. Mr. Hurley felt the purpose statement which the Board had added was an important facit of the ordinance that should remain. Mr. Curtis indicated he would discuss this matter with the City Attorney to determine why the purpose statement had been removed (memo regarding this matter enclosed with the April 20, 1993 Agenda). EQCB Minutes of March 16,1993 The Board discussed the issues raised by Mr. Hurley at length with the ultimate recommendations reflected in the amended ordinance as discussed above. Finally, the Board requested the staff report to the City Council on this issue include a recommendation from the EQCB that no public trees be removed, except in an emergency situation, until historic and specimen trees are cataloged Mr. Curtis indicated that this could be carried out as a City policy since the trees involved are public trees. MOTION BY HOOD; SECOND BY HOTCHKISS: TO ACCEPT THE DRAFT PUBLIC TREE ORDINANCE, SUBJECT TO THE AMENDMENTS PROPOSED BY MR. HURLEY, AND RECOMMEND ADOPTION OF THE ORDINANCE TO THE CITY COUNCIL. MOTION BY HOTCHKISS; SECOND BY HOOD: TO TABLE THIS MATTER, INCLUDING STANDING MOTION, UNTIL APRIL 20,1993 MOTION CARRIED: AYES: 5-0 VOCE, LOGAN, HURLEY, HOOD, HOTCHKISS NOES: VII. BOARD CONCERNS Chairman Voce discussed the proposed opening of a restaurant at 209 Main Street. Mr. Voce was concerned that there is no active list of historic properties identified by the City Council. Mr. Curtis discussed the requirements of the Code pertaining to conditional use permits for locally recognized historic structures. The Board discussed the issue of historic preservation and the issue as it pertains to the property at 209 Main Street. VIII. STAFF CONCERNS Mr. Curtis presented two items: 1) regarding the trimming of the eucalyptus windrow along Seal Beach Boulevard additionally, a number of trees at the old ARCO site at the SE corner of Seal Beach Boulevard and Lampson Avenue~ and 2) regarding the number of public trees have been removed within the past year.
