1 Minutes of June 21, 1994
Mr. Nakagawa indicated he felt Mr Hood at the previous meeting had indicated he felt
the previous practice of the City had been in keeping with the Brown Act Mr Nakagawa
asked why this had not been included in the Minutes and whether the City Attorney had
determined whether the City's past practices met Brown Act requirements Mr Curtis
indicated he would be mailing a copy of a memorandum from the City Attorney's office
regarding the new provisions of the Brown Act. It is the opinion of the City Attorney's
office that some of the former practices of the City did not fully comply with the new
provisions and that is why the modification to such items as "Board Concerns" and "Staff
Concerns" was being recommended Once the Board has reviewed the memorandum from
the City Attorney, staffwiII attempt to address any concerns which still remain Also, Mr
Curtis added that he does not prepare verbatim minutes, but if the Board wishes to include
Mr Hood's comments it could direct staff to do so

1. Review and Discussion of Proposed Mechanical Leaf Blower Policy
Consideration of EQCB Resolution No. 94-1
Mr Curtis presented a brief staff report He indicated this is a slightly revised version of
the resolution considered by the Board about a year ago. A third recommendation has
been added which recommends the City ban leafblowers after the six month review period
provided the educational program is ineffective Under this recommendation City staff
would stilI be allowed to use leafblowers in performing their duties
Chairman Voce suggested the seventh perambulatory clause be amended to add as
follows' ". is in keeping with, but additional to, noise levels "
Mr Hurley asked whether the proposed resolution had required findings Mr Curtis said
yes
MOTION BY LOGAN; SECOND BY HURLEY: TO ADOPT RESOLUTION
NO. 94-1 AND FORWARD THE MATTER TO THE CITY COUNCIL FOR
CONSIDERATION, AS AMENDED BY CHAIRMAN VOCE.

VII. BOARD CONCERNS
Mr. Nakagawa asked the status of the tree ordinance. Mr. Curtis indicated this matter is
stilI before the City Manager. His office is stilI working on the City's budget Once the
budget process is complete it's expected this matter will go before the Council within 4-6
weeks

VIII. STAFF CONCERNS - NONE.
IX. ADJOURNMENT
The Board discussed continuing this meting to a day other than a Tuesday in August to
allow Mr. Hood to be in attendance Ultimately the Board decided to continue this
meeting to Wednesday, August 24, 1994 at 6 30 P M
MOTION BY HURLEY; SECOND BY LOGAN: TO ADJOURN THE MEETING
TO AUGUST 16, 1994, DIRECTING STAFF TO POST THE MEETING
CANCELED DUE TO LACK OF A QUORUM, AND CONTINUING THE
MEETING TO WEDNESDAY, AUGUST 24, 1994 AT 6:30 P.M. IN THE CITY
COUNCIL CHAMBERS.
