PUBLIC HEARINGS - none. VIII. SCHEDULED MATTERS 4. Consideration of Draft Response Letter re: CALIFORNIA'S OCEAN RESOURCES REPORT Mr. Curtis presented the staff report (on file at the Department of Development Services). He indicated the staff report summarizes the main contents of the document. Staff has prepared a draft response letter and is requesting the Board review the proposed letter and forward it, including in additions or amendments, to the City Council. . Chairman Voce indicated he felt the letter was very well done, he complimented Mr. Curtis. Mr. Curtis indicated Mr. Whittenberg had prepared the letter, but he would pass on the Page 2 1=\ I,I;;QCIN1INosa BCC Environmental Quality Control Board Minutes of August 15, 1995 compliment. Chairman Voce suggested several changes to the response letter (redlined version of . letter showing changes is attached). Mr. Hurley discussed the issue of tourism in the wildlife refuge. He asked if the only access was through the Sunset Aquatic Park. Mr. Curtis said by vehicle yes, that was the only way to access the preserve. Mr. Curtis indicated he has seen bird watchers along Pacific Coast Highway and on occasion along the Breitburn oil island service road. . MOTION BY HOOD; SECOND BY HURLEY: TO RECEIVE AND FILE THE STAFF REPORT, FORWARD THE RESPONSE LETTER TO THE CITY COUNCIL AS AMENDED BY CHAIRMAN VOCE AND AUTHORIZE THE CHAIRMEN TO SIGN THE LETTER. Update on Request to Remove or De-energize 66 kv Power Lines Mr. Curtis indicated this matter was originally brought before the Board by a member of the public, Paul Yost, at its June 1995 meeting. Mr. Curtis paraphrased the issue as a request to remove or deactivate the 66 kv power lines that travel along First Street, Marina Drive, Bolsa Avenue and Seal Beach Boulevard. These lines serve as a backup power supply for Rockwell. Mr. Curtis indicated that at this point the City is just monitoring the actions of Mr. Yost. Mr. Yost will meet with Rockwell and SCE on Friday and it appears all parties may be in agreement to de-energize the lines but leave them in place. Finally, if a project is ever approved for the Hellman Ranch property a requirement will be to relocate the lines across Hellman. Mr. Paul Yost spoke regarding his concerns and presented a history of the situation. He indicated he felt the lines served little purpose at this time. Rockwell has been very responsive to this point. Finally, Mr. Yost indicated his interest on the ultimate removal of the lines if a project is ever approved on the Hellman Ranch. Negative Declaration 95-3 Beach Replenishment Project - Naval Weapons Station Dredge Project Mr. Curtis presented the staff report. He indicated the City is attempting to acquire approximately 150,000 cubic yards of sand to place on the beach between 12th Street and the west Anaheim jetty. This is essentially a continuation of the beach replenishment project begun last year. Mr. Curtis indicated an environmental assessment and negative declaration has been prepared and circulated. Mr. Hurley asked why the environmental assessment says the City needs 240,000 cubic yards of sand to reach equilibrium but the City is only seeking 150,000. Why is this? Also, what is meant by equilibrium? Mr. Curtis indicated he wasn't sure why there was a discrepancy. He felt equilibrium referred to attaining the natural beach width in this instance. Mr. Hurley indicated he was confused by the layout of the attachment. Mr. Curtis indicated this was the standard layout for an environmental assessment: first a cover memo to interested governmental agencies; second the environmental assessment, including any mitigation measures; and, third the actual Negative Declaration document including mitigation measures again. The Negative Declaration is actually a separate document which is mailed alone to the County for filing. Mr. Hurley noted the date on page 43 is different from the other dates. Also, what does "LAD" stand for on the bottom of page 3? Mr. Curtis indicated he thought it was somewhere in the document but he was unable to find it. Mr. Hurley thought the photo on page 7 should be farther out to sea. On page 13, what are air quality credits? Mr. Curtis explained it's a program whereby businesses can have greater flexibility in meeting clean air standards by trading credits with other businesses. Credits are obtained for certain activities which are set forth by SCAQMD. MOTION BY HOOD; SECOND BY LOGAN: TO RECEIVE AND FILE THE STAFF REPORT. . MOTION CARRIED: AYES: 4-0-1 VOCE, LOGAN, HURLEY, HOOD NONE NAKAGAWA NOES: ABSENT: IX. STAFF CONCERNS Mr. Curtis indicated this is the second consecutive unexcused absence for Mr. Nakagawa. He has been unable to reach or locate Mr. Nakagawa to determine his status. He asked if any Boardmember has any contact with Mr. Nakagawa please have him call Mr. Curtis at the City. Presentation on Water Issues - Consideration of Agendizing Chairman Voce indicated this was a matter he originally brought up after the flooding earlier this year. He feels it's an important issue to consider. He envisions it including flooding, drinking water quality, sewage an~ effects on the City's water system from outside agencies. Mr. Curtis suggested scheduling this matter for consideration at the Board's November hearing. The Board unanimously agreed to consider this matter in November. XI.
