ApPROVAL OF AGENDA MOTION BY HOOD; SECOND BY HURLEY: TO APPROVE THE AGENDA AS PRESENTED WITH ITEMS 1 AND 2 REMOVED FROM THE CONSENT CALENDAR FOR DISCUSSION. MR. WHITTENBERG INDICA TED STAFF WOULD LIKE TO ADD AN ITEM REGARDING THE LEGAL FILINGS ON THE BOLSA CHICA LAWSUIT TO STAFF CONCERNS. MOTION CARRIED: AYES: 4-0 VOCE,HOOD, HURLEY ROSENMAN NOES: ABSENT: IV. Minutes of November 21,1995 Mr. Hurley indicated on page 4 there are a number of words missing. First line the word "for" is needed. On the second line the word "on" is needed after hearing. On the fourth line the phrase "happened in Leisure World during the flood ..." should be added. MOTION BY HOOD; SECOND BY ROSENMAN: TO ACCEPT THE MINUTES OF NOVEMBER 21, 1995 AS AMENDED. Mr. Rosenman added that meeting was actually called to order at 5:30 P.M. rather than 6:30 P.M. MOTION BY ROSENMAN; SECOND BY HOOD: TO ACCEPT THE MINUTES OF DECEMBER 5, 1995 AS AMENDED. MOTION CARRIED: AYES: 4-0 VOCE, HOOD, HURLEY, ROSENMAN NOES: ABSENT: KILKEARY VIII.STAFF CONCERNS . Mr. Whittenberg indicated staffhas provided the EQCB with a copy of the response from the County of Orange to our points and authority regarding our position regarding the inadequacy of the EIR in the Bolsa Chica project. Also included is our attorney's response to the County's response to our concerns. The matter is scheduled to go to oral arguments before the judge on February 2nd in Santa Ana. Staff included a memo which discussed the prospects of the arguments. Mr. Hurley asked what would happen if the court finds the EIR inadequate? Mr. Whittenberg indicated if the court upholds the EIR nothing will need to happen before the Coastal Commission. If the court requires major changes to the EIR and these changes materially change the project, those changes may need to go before the Coastal Commission. There is also the possibility ofa lawsuit against the Coastal Commission's action. Mr. Whittenberg indicated staff will keep the Board abreast of future developments. IX. BOARD CONCERNS . Mr. Hurley asked whether the leaf blower policy covers Leisure World? Mr. Whittenberg indicated he was not positive, but he believed it did. Mr. Hurley said the City was to get a hold of existing landscape businesses and appraise them of the policy. Has this been done? Also, can he get a copy of the leaf blower policy? Mr. Hurley also asked for suggestions regarding non substance typos in the Minutes. He wants them corrected, but doesn't want to appear a nit picker. Is there a way to correct these without pulling them from the consent calendar? Mr. Whittenberg indicated staff doesn't consider that nit-picking and we're happy to make these corrections. Mr. Whittenberg suggested that minutes not be put on the consent calendar. Mr. Rosenman asked how prepared the City and fire department was regarding the uranium facility at the Navy base? He also asked how prepared the City is ifthere is ever such a site on Navy property, given we might not know if such a facility is there? Specifically, if there is something there to be trained about, are we being trained? Mr. Rosenman indicated Commander Steadley is about to be replace. Mr. Whittenberg indicated staff would get back to the Board on this in the near future. Chairman Voce discussed the gate lock issue at Gum Grove park. He discussed why the police have given a key to a private citizen. Some type of security measure needs to be implemented. Chairman Voce suggested perhaps the City take the keys from the private resident or keep better records of who has keys, so everyone knows. Mr. Rosenman suggested this matter be forwarded to the City Council. Mr. Hood indicated he felt the first issue is some clarification Page 3 D:\....\.EQCB\.MINUTES OF JAN. 23. 1996 BC:BC . . . Environmental Quality Control Board Minutes of January 23, 1996 regarding whether there is an existing policy or is it an ad hoc policy by someone. So, staff should look into this matter to determine whether there is a policy. Chairman Voce also indicated the Surfriders Blue Water Task Force has been running tests on local ocean water quality. Gordon Lebetz indicated someone from the Surfriders could come and speak to the Board. Could the Board ask that someone come speak to the Board in February or March regarding the water quality. Mr. Hood suggested that perhaps Surfriders and the County could both come and talk. Mr. Whittenberg indicated staff would attempt to schedule this matter for the earliest possible meeting. Chairman Voce indicated the Coastal Commission's decision was politicized. Perhaps Coastal Commission experts could be experts on these issues rather than political people. x.
