HomeMy WebLinkAboutCC AG PKT 2009-12-14 #QAGENDA STAFF REPORT DATE: December 14, 2009 TO: Honorable Mayor and City Council THRU: David Carmany, City Manager FROM: Vincent Mastrosimone, Director of Public Works SUBJECT: NOTICE OF COMPLETION FOR THE CANDLEBERRY AVENUE STORM DRAIN IMPROVEMENTS PROJECT NO SD0901 SUMMARY OF REQUEST: The City Council is asked to: 1. Adopt Resolution No. 5954 to formally accept completion of the Candleberry Avenue Storm Drain Improvements Project No. SD0901. 2. Direct the City Clerk, to file a "Notice of Completion" with the Orange County Clerk- Recorder within ten (10) days from the date of acceptance. 3. Direct staff to release retention funds of $162,531.05 thirty -five (35) days from the date of filing of the "Notice of Completion ". BACKGROUND: On September 8, 2008, City Council awarded a contract to Palp. Inc. DBA, Excel Paving Company in the amount of $1,415,869 to construct the Candleberry Avenue Storm Drain Improvements Project No SD0901. The scope of work consisted of the installation of reinforced concrete pipes and boxes, vitrified clay pipe, catch basins, manholes, junction structures, ductile iron pipe, water valves and reducers for storm drain, sewer and water utility facilities. The work is near Candleberry Avenue, Lampson Avenue and Aster Street. During construction there were some unexpected situations that arose that required additional work be performed by the contractor to complete the project. Since the Contractor was the low bid, City requested additional work while under Agenda Item Q Page 2 contract for this project. The City requested that the Contractor add additional linear footage of waterline to the project, add additional water valves at the limits of the project, construct sewer repairs and replacement on 16 Street and 7th Street, perform emergency repairs to damaged water lines adjacent to Leisure World and add additional square footage of paving to the original limits of construction of the project. These items increased the project by $209,441.49. Construction is now completed and the City Engineer has accepted the project. FINANCIAL IMPACT: In the 2009/10 Budget, $2,441,000 was allocated for the 10 Year Storm Drain Improvement Project. The original bid amount was $1,415,869.00. The approved change orders totaled to $209,441.49 The final construction cost of the project is $1,625,310.49. RECOMMENDATION: It is recommended that the City Council: 1. Adopt Resolution No. 5954 to formally accept completion of the Candleberry Avenue Storm Drain Improvements Project No. SD1001. 2. Direct the City Clerk, to file a "Notice of Completion" with the Orange County Clerk- Recorder within ten (10) days from the date of acceptance. 3. Direct staff to release retention funds of $162,531.05 thirty -five (35) days from the date of filing of the "Notice of Completion ". DBA Excel Paving Company.; and WHEREAS, the City Engineer has determined that the work has been substantially completed in accordance with the contract documents. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. That the work required to be performed by said Contractor has been completed. Section 2. That the total cost of said work is $1,625,310.49. Section 3. That the work is hereby accepted and approved. Section 4. It is further ordered that a "Notice of Completion" be filed on behalf of the City in the Office of the Orange County Recorder within ten (10) days of the date of this resolution. The property on which said work of improvement was completed in the City of Seal Beach, County of Orange, State of California, and is described as follows: Lampson Avenue at Candleberry Avenue, Candleberry Avenue between Lampson Avenue and Aster Street. and Aster Street between Candleberry Avenue and Birchwood Street.
