SUBJECT: MUNICIPAL CODE REVISION RELATING TO
PARKING RESTRICTIONS AT THE SUNSET
AQUATIC MARINA PARK
SUMMARY OF REQUEST:
Introduce Ordinance No.1589, AN ORDINANCE OF THE CITY OF SEAL
BEACH APPLYING THE SEAL BEACH MUNICIPAL CODE TO ROADS AND
AREAS WITHIN SUNSET AQUATIC PARK, ESTABLISHING SUNSET
AQUATIC PARK PARKING RESTRICTIONS AND AMENDING TITLE 8
(VEHICLES AND TRAFFIC) OF THE SEAL BEACH MUNICIPAL CODE.
Instruct staff to schedule for second reading and adoption at next regular City
Council meeting.
BACKGROUND:
At this time the Seal Beach Municipal Code does not contain language allowing
enforcement of parking regulations in Sunset Aquatic Marina Park. The Sunset
Aquatic Marina Park is a unique area within the city limits of the City of Seal
Beach and it poses a set of unique issues related to parking enforcement. The
park is open to any person and vehicle except for those areas where access is
controlled by electronic gate arms (boat ramp, dry boat storage). The remaining
parking areas are open and accessible to the public. These parking lots are
located adjacent to the marina docks and are intended for the use of the boat
owners who rent boat slips from the private operator of the park.
Overnight parking is restricted and vehicles must obtain a permit from the marina
operator to park between the hours of 10:00 PM and 6:00 AM. There are
currently signs stating this prohibition but there is no municipal code allowing for
enforcement.

The proposed revision will amend Code section 8.05.015 and add section
8.20.015.
The Ordinance has been reviewed and approved as to form by the City Attorney.
FISCAL IMPACT:
The potential negative or positive fiscal impacts of the proposed Municipal Code
amendment, if any, would be minor.
RECOMMENDATION:

ORDINANCE NUMBER 1589
AN ORDINANCE OF THE CITY OF SEAL BEACH APPLYING
THE SEAL BEACH MUNICIPAL CODE TO ROADS AND AREAS
WITHIN SUNSET AQUATIC PARK, ESTABLISHING SUNSET
AQUATIC PARK PARKING RESTRICTIONS AND AMENDING
TITLE 8 (VEHICLES AND TRAFFIC) OF THE SEAL BEACH
MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION 1. Seal Beach Municipal Code Section 8.05.015 relating to the
application of traffic laws to certain roads and areas is hereby amended to read
as follows:
" §8.05.015 Applicability to Private Roads and Parking Areas.
A. The city council finds and declares that the public interest will best
be served by the application of this title and the Vehicle Code to the following
roads and areas due to their proximity to or connection with highways and
streets: Surfside Avenue; Pacific Avenue; Seal Way; Phillips Avenue; and each
road, lane and parking area within the respective boundaries of Rossmoor
Business Center and Sunset Aquatic Park.
B. The city will enforce traffic laws on the roads and areas listed in
subsection A and such roads and areas shall be subject to all applicable
provisions of this title and the Vehicle Code. The city shall not be deemed to
assume any responsibility or liability for the maintenance or care of such roads
and areas."
SECTION 2. Municipal Code Chapter 8.20 relating to motor vehicle
parking lots is amended by adding a new section 8.20.015 to read as follows:
" §8.20.015 Sunset Aquatic Park Parking Restrictions.
A. No person shall park any vehicle within Sunset Aquatic Park
between 10:00 PM and 6:00 AM, unless the vehicle contains a properly
displayed valid parking permit, issued by the operator of the Sunset Aquatic
Park. Such permit shall be clearly visible from the exterior of the vehicle.
B. No person shall park a camper, recreational vehicle or vehicle and
boat combination within Sunset Aquatic Park"
SECTION 3. If any section, subsection, subdivision, paragraph, sentence,
clause or phrase of this Ordinance or any part thereof is for any reason held to
be invalid, such invalidity shall not affect the validity of the remaining portions of
this Ordinance or any part hereof. The City Council hereby declares that it would
have passed each section, subsection, subdivision, paragraph, sentence, clause
or phrase hereof, irrespective of the fact that any one or more sections,
subsections, subdivisions, paragraphs, sentences, clauses or phrases be
declared invalid.
SECTION 4. The City Clerk shall certify to the adoption of this Ordinance
and shall cause the same to be published in the manner prescribed by law.
